He stressed that these issues needed to be taken into consideration when discussing the Oxbow incident. CLOSED SESSION REPORT City Attorney Sonia Carvalho informed that the Mayor and City Council had unanimously approved the filing of a receivership case to address code enforcement issues at a property located at 1595 North D Street and there was no further reportable information. CITY MANAGER UPDATE City Manager Rob Field spoke on the Inland Empire 66’ers first game since the re- opening; he mentioned the partnership with the County of San Bernardino in hosting an event Operation Fire and Ice (Cream!) to encourage individuals to get vaccinated against Covid-19. Mr. Field informed of the various Cinco de Mayo and Earth Day celebrations taking place throughout the City’s community center; provided a brief Regular Meeting Agenda May 5, 2021 Mayor and City Council of the City of San Bernardino Page 3 Printed 5/11/2021 update on the General Plan; and informed that the Mt. Vernon Bridge demolition had been completed. MAYOR AND CITY COUNCIL UPDATES Mayor Valdivia spoke of his recent visit to Build A Scoop, a new business in the City of San Bernardino, and his attendance at the 66’ers season opener at the San Manuel stadium. Council Member Sanchez spoke of the new soccer field at Nunez Park and the teamwork that made this accomplishment happen. Mayor Pro-Tem shared that the parking lots at Perris Hill Park were being repaved; fences were installed on Harrison and Highland Avenue. She informed that the State was funding a renter’s and landlord assistance program and stated more information could be found on the Housing is Key website. Mayor Pro-Tem encouraged residents living between Highland and 9th Street to begin a neighborhood association or neighborhood watch. Council Member Figueroa mentioned his visit to Build a Scoop and thanked Council Member Sanchez for sharing resources for City parks. He encouraged residents to join their local neighborhood associations and stated more information could be obtained by emailing nacsbcal@gmail.com or visiting the City’s website. Council Member Figueroa shared that the Neighborhood Association Council would be holding a plant sale on May 8th from 8 a.m. to 12 p.m. at the Garcia Center for the Arts. He encouraged residents to use the bulky item pick-up through Burrtec to help keep San Bernardino clean. Council Member Shorett echoed Council Member Figueroa’s comments on the neighborhood association and bulky item pick-up. He offered his congratulations to Council Member Sanchez for the soccer field in the 1st Ward and wished everyone a Happy Cinco de Mayo. Mayor Valdivia and Council Member Shorett wished a Happy Mother’s Day to all the mothers in the community. Council Member Reynoso reminded everyone that Cinco de Mayo is not Mexican Independence Day and that date falls on September 16th. Cinco de Mayo celebrates the Battle of Puebla, and it was a significant battle where French colonizers were fought off. He highlighted Joy Anderson of the 7th Ward, who is the President of Hudson Neighborhood Association. He informed the next meeting would be held on May 7th and encouraged the community to join their neighborhood association. He announced that the Little League was re-opening this summer, and more information could be found on littleleague.org Council Member Calvin informed that Coffee with a Cop would be held on May 18th at 9:00 a.m. at Anne Shirells Park. She announced that Cimarron Ranch would be holding their first neighborhood association meeting on May 20th and that Supervisor Baca would be joining the discussion with her. Council Member Calvin recognized the following non-profits within the City of San Bernardino: Young Visionaries- Terrance Stone, Community Action Partnership, Hope Culture, and Victor Outreach. She also recognized Knock Knock Angels, a non-profit out of Fontana that has been serving the County of San Bernardino and identifying families who need home makeovers. Council Member Alexander shared that the State of California was awarding grant relief funds for small businesses ranging from $5,000 to $25,000, and more information could be found on the City’s website. He reminded everyone that National Day of Prayer was on May 6th; he spoke on the Assistance League’s 59th Annual Headdress Ball held on May 1st at the San Manuel Stadium. Council Member Alexander shared that his wife Felicia Alexander participated in the Grease theme ball. He wished all the mothers a Happy Mother’s Day. PRESENTATIONS 1. Proclamation for National Public Works Week - May 16-21. 2021 Mayor Valdivia proclaimed May 16-21st as National Public Works Week, recognized and thanked Public Works Director Kris Jensen and the Public Works team. 2. Proclamation for National Law Enforcement Week - May 9-15, 2021 Mayor Valdivia proclaimed the week of May 9-15th as National Law Enforcement Week, recognized Police Chief Eric McBride and the officers who serve the community. 3. Presentation from SBVMWD - Heather Dyer, CEO General Manager - Water Conservation Program District Director Gil Botello, of the San Bernardino Valley Municipal Water District (SBVMWD), thanked Mayor Valdivia for his participation in the National Water Conservation in April to raise awareness. Mr. Botello introduced Ms. Dyer, CEO General Manager of SBVMWD, and she provided a presentation to the Mayor and City Council. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA Azar, San Bernardino, spoke in opposition of Item #19. He would like a walking trail for residents built in the sub-division. Paul Sanborn, San Bernardino, stated that the 6th Ward needs an additional fire station to serve the community, and Council Member Calvin should make sure that happens. Lorena Suarez, spoke in Spanish against Council Member Shorett’s comments about Council Meetings being English-speaking only. San Bernardino has a high Spanish- speaking population. She also requested that the Mayor speak more to the community. Iliana Massengill, San Bernardino, spoke regarding the street vendors in San Bernardino. She is sick of the street vendors being dirty, leaving trash, and parking illegally. She does not want to see street vendors anymore. She stated that she has been discriminated against for not being able to speak Spanish. Treasure Ortiz, San Bernardino, condemned Council Member Sanchez’s comments at the last meeting and stated that there are no “black” and “brown” neighborhoods in San Bernardino. She also questioned why the Mayor and Council Members haven’t given an update on the Carousel Mall development. She requested that Council Members listen to public comments and take action. Maneli Iskander, San Bernardino, is against MT&H Food Market obtaining a liquor license, because there are too many businesses selling liquor in the neighborhood and it is not benefitting the public. She would like Council Members to prevent the market from obtaining the liquor license. Leticia Garcia, San Bernardino, states that elected officials need to be held accountable for their actions. She also stated that Council Member Shorett owes the community an apology for stating that Council Meetings should be in English only, and he should resign. Robert Porter, San Bernardino, questioned why there were so many anonymous public comments during the last meeting. He believes that someone hired a public relations firm to make comments in favor of a certain item. He questioned where the money came from to pay those people. Tony, San Bernardino, spoke about Council Member Figueroa’s voting record and what he stands for. He also questioned why Council Member Sanchez voted a particular way regarding the OxBow project. He claims that the Mayor blindsided the Council Members, staff, and the public when he vetoed the Oxbow decision. Linda Collier, San Bernardino, is concerned that the City is looking like trash and there are homeless people everywhere. Trash and food is being dumped in the streets. She wants to know what Mayor and Council is doing to clean up the city. Harry Hatch, San Bernardino, wants the Oxbow project issue to be put back on the City Council Meeting calendar. Keith, San Bernardino, thinks the Mayor should step down and resign. He also thinks Council Member Shorett should resign for making racist comments. He suggested that Council Member Sanchez make up his mind about issues. He commended the rest of the Council Members for doing a good job. Jacqueline, San Bernardino, spoke against Council Member Shorett’s comments about Council Meetings being English-speaking only. She believes that those comments were racist towards Spanish speakers. Hardy Brown, San Bernardino, called to pay tribute to San Bernardino Asians and Pacific Islanders in Honor of Asian-American History Month. He stated that it is important to recognize their contributions to our community. Paula Plunk, San Bernardino, stated that Council Members should be offering assistance and care to citizens of the City. She believes City Manager Mr. Field has a lack of integrity and honor. She states City Staff is unprepared at meetings. She feels that the gun buy-back program was a failure. Victor, San Bernardino, spoke against MT&H Food Market’s application for a liquor license. He believes there are already too many businesses in the area selling liquor and it contributes to the homeless problem. APPOINTMENTS 4. Water Board Re-Appointment Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California, approve the re-appointment of Wayne Hendrix to the Water Board with a six-year term of office ending May 10, 2027. 5. Animal Control Commission Appointment (Ward 5) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California, approve the appointment of Mr. Alejandro E. Faz to the Animal Control Commission representing Ward 5. Mr. Faz will replace Jeffrey Frank with the term ending December 2024. Council Staff has verified that appointee is a registered voter within the City. RESULT: APPROVED THE APPOINTMENTS OF MR. WAYNE HENDRIX, AND MR. ALEJANDRO E. Mayor Valdivia opened the Public Hearing at 8:30 p.m. Mayor Valdivia inquired and Community and Economic Development Director Michael Huntley Confirmed that the appellant had submitted a request to continue the public hearing to the next regularly scheduled meeting. City Clerk Genoveva Rocha announced that the pre-recorded comments submitted for the public hearing would be played at the next meeting. Accessory Dwelling Units Ordinance - Second Reading Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California, adopt Ordinance No. MC-1559 adopting Development Code Amendment 21-01 amending Title 19 (Development Code) of the City of San Bernardino Municipal Code to establish standards for Accessory Dwelling Units. 10. Approval of Commercial and Payroll Disbursements (All Wards) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California approve the commercial and payroll disbursements for April 2021. 11. Amendment to AALRR Legal Service Agreements (All Wards) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California adopt Resolution No. 2021-103: 1. Approving the first amendment to the legal services agreement with Atkinson, Andelson, Loya, Ruud & Romo for representation in the San Bernardino Superior Court Case No. CIV DS 2013562; 2. Approving the first amendment to the legal services agreement with Atkinson, Andelson, Loya, Ruud & Romo for representation in the San Bernardino Superior Court Case No. CIV DS 2012538; 3. Designation of Fifteen Zero Emission Vehicle Parking Stalls at Santa Fe Depot (Ward 1) Recommendation Adopt Resolution No. 2021-104 of the Mayor and City Council of the City of San Bernardino, California, authorizing the designation of fifteen parking stalls in the Santa Fe Depot East Parking Lot for the exclusive purpose of fueling and parking of Zero-Emission Vehicles (ZEV) in accordance with California Vehicle Code Section 22511. 13. Irrevocable Agreement to Annexation No. 2021-363 (Ward 6) Recommendation Adopt Resolution No. 2021-105 of the Mayor and City Council of the City of San Bernardino, California, approving the application to the Local Agency Formation Commission to provide City sewer services to a property within unincorporated territory located at 18980 Cajon Blvd (APN 0265-272-11) and authorizing the City Manager to execute an Irrevocable Agreement to Annex. 14. Construction Contract Award - Various Signal Lights Upgrade (Wards 1,4,6,7) Adopt Resolution No. 2021-106 of the Mayor and City Council of the City of San Bernardino, California: 1. Approving the award of a construction contract agreement with Comet Electric, Inc., in the amount of $1,054,960 to provide the construction of traffic signal upgrades; 2. Authorizing the project construction, construction contingencies, and inspection costs in the total amount of $1,190,960 for Construction of Traffic Signal Upgrades (“Project”); and 3. Authorizing the Director of Finance to reallocate $175,443.27 from the Highland Interconnect Project (Account number 263-160-8679*5504) to fund the project construction, construction contingencies, and inspections; and 4. Authorizing the City Manager or designee to expend the contingency fund, if necessary, to complete the project. 15. Cooperative Funding Agreement with the City of Redlands - Alabama Street Rehabilitation (Ward 1) Recommendation Adopt Resolution No. 2021-107 of the Mayor and City Council of the City of San Bernardino, California: 1. Approving a Cooperative Funding Agreement with the City of Redlands for the Alabama Street Rehabilitation Project (“Project”); and 2. Authorizing the Director of Finance to amend the FY 2020/21 Capital Improvement Plan (CIP) to include the Alabama Street Rehabilitation Project (“Project”) and establish a project budget in an amount not to exceed $26,833.13 in Measure I Fund No. 129. Vernon Storm Drain (Ward 6) Recommendation Adopt Resolution No. 2021-108 of the Mayor and City Council of the City of San Bernardino, California, approving the award of a Design Services Agreement with Onward Engineering in the amount of $144,927 for Design Services for the Mt. Vernon Storm Drain Project (SD20-003). 17. Updating Assessment Engineer's Reports-Previously Formed Landscape and Lighting Maintenance Districts (All Wards) Recommendation Adopt Resolution No. 2021-109 of the Mayor and City Council of the City of San Bernardino, California, initiating proceedings to levy and collect assessments for FY 2021/22 in Assessment Districts pursuant to the Constitution and the City Charter, appointing the Engineer of Record and ordering preparation of Engineer's Report. 18. Stop Sign Installation at the Intersection of 28TH Street and Arrowhead Avenue (Ward 7) Recommendation Adopt Resolution No. 2021-110 of the Mayor and City Council of the City of San Bernardino, California, amending Resolution No. 655 entitled, in part, “A Resolution… designating certain streets or portions thereof as through highways…” and authorizing the establishment of an all-way stop control at the intersection of 28th Street and Arrowhead Avenue (4-way). 19. Approve Final Tract Map No. 20145 (Ward 4) Recommendation Adopt Resolution No. 2021-111 of the Mayor and City Council of the City of San Bernardino, California: 1. Approving Final Map for Tract No. 20145 (Subdivision 18-08) involving the subdivision of a project site containing approximately 5.98 acres into 16 single- family residential lots located on the northerly side of Belmont Avenue between Magnolia Avenue and Escena Street; 2. Accepting the public dedications as set forth on said map; and 3. Authorizing execution of the standard form of agreement for the subdivision improvements. 20. Construction Contract Award –5TH Street Senior Center Outside Dining Cover (Ward 1) Recommendation Adopt Resolution No. 2021-112 of the Mayor and City Council of the City of San Bernardino, California: 1. Authorizing the Director of Finance to amend the FY 2020/21 Capital Improvement Plan (CIP) to include the 5th Street Senior Center Outside Dining Cover (“Project”); Regular Meeting Agenda May 5, 2021 Mayor and City Council of the City of San Bernardino Page 11 Printed 5/11/2021 2. Authorizing construction, construction contingencies and inspections costs in the total Project amount of $118,723; 3. Approving the award of a Construction Contract with Micon Construction, Inc. in the amount of $94,023 to construct the Project; and 4. Authorizing the City Manager or designee to expend the contingency fund, if necessary, to complete the Project. ITEMS TO BE CONSIDERED FOR FUTURE MEETINGS 21. Carousel Mall Demolition Cost Update and Financing Forecast- Mayor John Valdivia City Manager Rob Field explained that there had been a request to prepare this item for a future meeting. He and Finance Director Barbara Whitehorn were ready to prepare the forecast and that it would consist of an estimate of the cost and a repayment plan. Council Member Calvin asked Mr. Field if the demolition was included with the downtown redevelopment program why the City would have to consider this item. Mr. Field informed that negotiations involving the demolition had not been concluded. This item would be a backup plan to proceed with demolition if the City was unable to successfully conclude negotiations with the selected development team. Mayor Valdivia explained that this would be a report with statistics, and it was a commitment that Mr. Field had made on January 20, 2021, to come back to present at the request of the Mayor and City Council. Council Member Shorett expressed he did not see a need for this item to come back and, if necessary, could be discussed later. There was no consensus from the City Council to direct staff to bring this item back at a future meeting. City Manager Rob Field informed staff would be providing an update on the progress of the negotiation process with Renaissance/ICO at the next meeting. 22. Consider Options for Reprogramming Unused Funding Appropriated for the Gun Buy Back Program to Support Other Safety and Homeless Service Outreach Programs - Council Member Kimberly Calvin Council Member Calvin informed that National Night Out was soon approaching. She informed that community members, builders, and neighborhood associations would be working a booth to help pass out lights. She advised that there was $20,000 left over that could be used to purchase porch lights. The community had come together with the police department and neighborhood associations to figure out a plan on how to light up San Bernardino on National Night Out and for the homeless program. MOTION BY COUNCIL MEMBER REYNOSO, SECOND BY COUNCILMEMBER ALEXANDER, CARRIED 7-0, to bring the request back at a future meeting. ITEMS TO BE REFERRED TO COMMITTEE Council Member Calvin advised she had attended a meeting with the San Bernardino County Office of Homeless Services. She informed that they discussed a strategic plan on how the county will solve homelessness in the county and stated the City needed to be involved or hold a workshop. Council Member Alexander requested that staff bring back a code amendment to increase the public notification for public hearings from 500 feet to 1000 feet to notify homeowners and residents. Mayor Pro-Tem stated she had requested that the City have a homelessness task force similar to the City of Victorville and requested a report; she also requested a report on the police department's success citing residents for illegal fireworks. Council Member Alexander inquired who the point of contact is for clean up after an auto accident. Police Chief McBride informed that the area commander could be contacted. They would then inquire which tow companies had reported to the scene of a traffic collision and follow up with the companies to clean up debris. REPORTS ON CONFERENCES/MEETINGS ATTENDED ADJOURNMENT The meeting of the Mayor and City Council was adjourned at 8:54 p.m. on Wednesday, May 5, 2021. The Mayor and City Council and the Mayor and City Council Acting as the Successor Agency to the Redevelopment Agency will adjourn to a Special Meeting on Thursday, May 13, 2021, via tele-conference.
