HomeMy WebLinkAboutFine Arts Grant Funding Memo 12-07-07CITY OF SAN BERNARDINO CITY MANAGER'S OFFICE INTEROFFICE MEMORANDUM To: Esther Estrada, Council Member From: Lori Sassoon, Assistant City Manager Subject: Fine Arts and Civic and Promotional Costs Date: December 7, 2007 This memo is in response to your request during the Ways and Means Committee meeting on November 13, 2007, for information on the fine arts and civic and promotional expenditures. According to Chapter 15.57 of the City's Municipal Code, "A cultural development construction fee is imposed on the privilege of new commercial construction or reconstruction.... Such fee shall be equal to one-half of one percent of the construction cost." To account for the funds collected, the City's Municipal Code states, "The funds derived from this fee shall be deposited in a separate fund with identification as to the source, so that the Mayor and Common Council may consider appropriate expenditures in its annual budget for allocation to cultural development activities in the City. The funds shall be reviewed annually by the Mayor and Common Council." Each year, funds are transferred from the Cultural Development Fund to the General Fund for fine arts and civic promotion costs. The funds are expended each year through the General Government department, through the Arts & Cultural Affairs and Non - Departmental functions. Historically, funds have been spent on funding for arts, music, and cultural programs provided by local community organizations. The funds are spent as recommended by the Fine Arts Commission and approved by the Mayor and Common Council. Currently, the funding is used to assist community organizations and city departments with costs including, but not limited to, the 4th of July celebration, Black History Parade, YMCA Christmas Parade, Western Regional Little League and the San Bernardino Symphony. Summarized below are the transfers from the Cultural Development Fund to the General Fund. Attachment B summarizes the total expenditures from the General Government department through the Arts & Cultural Affairs and Non -Departmental functions, with respect to the Fine Arts Funding and Civic and Promotion accounts. Please note the total amounts expended may not be equal to the amounts transferred from the Cultural Development Fund to the General Fund. In six of the last ten years, the total expenditures exceed the cultural development fee revenue. As a result, the General Fund subsidized these expenditures. The Cultural Development Fund revenues are subject to the provisions of AB 1600 - Mitigation Fee Act. Generally, development impact fees are expended to fund expansion of the City's current facilities, construct new facilities and acquiring equipment to meet the growth needs of the City. The cultural development fee revenue falls under the provisions of AB1660. All expenditures from the fee revenue need to have reasonable relationships between nature of the fee and the type of expenditures. During the Ways and Means Committee meeting it was indicated that the Council might have taken action to set a policy concerning the dollar amount and uses of the funds from the cultural development fee revenue. The City Clerk's Office could not find any record of such a policy being adopted. I inquired with Jorge Carlos about any proposed recommendations from the Ways and Means Committee to Council in regards to the dollar amount and uses of the funds from the cultural development fee revenue. No record of such recommendation, requesting formal action from Council, could be located.
