HomeMy WebLinkAboutItem No. 15 - Rejecting Construction Bids for 201 E Street ADA Parking Page 1 Consent Calendar City of San Bernardino Request for Council Action Date: February 19, 2020 To: Honorable Mayor and City Council Members From: Teri Ledoux, City Manager By: Kris Jensen, Director of Public Works Subject: Rejecting Construction Bids for 201 E Street ADA Parking Expansion Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California, Adopt Resolution No. 2020-41 rejecting all bids for the 201 E Street ADA Parking Expansion Project and allow staff to revisit the required scope of work and research additional funding sources. Background The Public Works Department is responsible for maintaining the sidewalk and American Disability Act (ADA) access ramps throughout the City. A facilities assessment of the current condition of City facilities, including parking lots, was previously conducted. During the assessment, it was determined that a parking area serving visitors of 201 E Street requires updating of an existing ramp and pa rking space area to comply with Americans with Disabilities Act (ADA) requirements. Staff prepared bid specifications and conducted a competitive construction bid process. The resulting bid submissions far exceeded the initial engineer’s estimate and the available project funding. Staff is requesting that the City Council reject all bids, and allow staff to revisit the required scope of work and research additional funding sources. Discussion Project 13305 was advertised for public bidding on December 19, 2019, and December 24, 2019, in the San Bernardino County Sun Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily Transcript, Sub -Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction Bid Sourc e, Bid Ocean, the City’s web sites, and the San Bernardino Area Chamber of Commerce. Ten (10) sealed bids were received and opened on January 09, 2020, and the results are tabulated below: BIDDER CITY BASE BID ONYX Paving Company, Inc. Diamond Bar $725,150 The lowest apparent bidder was ONYX Paving Company, Inc. of Anaheim, California, with a bid of $342,350. The lowest bid is significantly above the Engineer’s overall estimate and the current funding allocation of $168,153 available for this project. Staff recommends that the City rejects all bids submitted for the subject project at this time, and allow staff to research other options for additional funding support and/or evaluate the possible revision of the scope of the project. Public Code Section 20166 states that the City Council has the authority to reject all bids. Staff is recommending that City Council reject all bids and allow staff the opportunity to reevaluate the project and funding sources, and re-advertise the Project at a future date. 2020-2025 Key Strategic Targets and Goals This project is consistent with Key Target No . 1: Financial Stability by creating a framework for spending decisions. Also, by rejecting all bids, staff will be allowed to further evaluate the project funding needs and scope and provide additional options for City Council consideration related to future spending related to this project. Fiscal Impact There is no fiscal impact associated this action. Conclusion It is recommended that the Mayor and City Council of the City of San Bernardino, California, Adopt Resolution No. 2020-41 rejecting all bids for the 201 E Street ADA Parking Expansion Project and allow staff to revisit the required scope of work and research additional funding sources. Attachments Attachment 1 Resolution Attachment 2 Bid Tabulation Attachment 3 Location Map Ward: 1 Synopsis of Previous Council Actions: 6630 Page 3 June 5, 2019 FY 2018/19 Budget Amendment to appropriate $1,000,000 from the General Fund Capital Improvement (CIP) Reserve June 19, 2019 Adopted Resolution No. 2019-168 approving Capital Improvement Program FY 2019/2020 Resolution No. 2020-41 RESOLUTION NO. 2020-41 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, REJECTING THE BIDS FOR 201 E STREET ADA PARKING EXPANSION PROJECT (“PROJECT”) WHEREAS, the City of San Bernardino owns, operates and is responsible for the maintenance of a parking lot at 201 E Street; and WHEREAS, the parking lot requires updating existing access ramps and parking provisions to comply with Americans with Disabilities Act (ADA) requirements; and WHEREAS, the general fund Capital Improvement Program (CIP) reserve for ADA Access to 201 Building was approved on June 5, 2019, by the Mayor and City Council in the amount of $500,000; and WHEREAS, $331,847 of this funding has been expended to bring restrooms and the entrance doors at the 201 E Street building into ADA compliance; and WHEREAS, the remaining project fund balance of $168,153 is available for 201 E Street ADA Parking Expansion Project; and WHEREAS, staff has administered a competitive bid process to secure a construction contract to perform the ADA parking expansion and received ten responsive bids on January 9, 2020; and WHEREAS, the lowest bid response, in the amount of $342,350, is significantly above the Engineer’s overall estimate and well exceeds the remaining funding available for this project. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Council rejects all bids received in response to the Project. SECTION 3. That the City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. Resolution No. 2020-41 SECTION 5. Effective Date. This Resolution shall become effective immediately.
