We are a high-tech and licensed cannabis Corporation with production and retail facilities throughout California. Ohana is a vertically integrated operation with a leadership team that has over 30 years of successful business, government, technology, and retail experience building state of the art operational models that are based on 10 years of cannabis industry research and experience. Thank you for ensuring that cannabis delivery is included in the ordinance that is under consideration for approval. Proper legalization, including delivery, will clearly set the stage to fight underground and illegal activities that are costing lives, public safety, and tax revenue the city needs for regulating this evolving industry. This letter is about Consent Calendar Item creating "Maximum Number and Type of Authorized Commercial Cannabis Businesses Permitted." While we don't object to establishing a maximum number of permits for storefronts due to community visibility, we respectfully urge you to reconsider your position about limiting delivery, wholesale, distribution, and testing for the following reasons: 1. Delivery, wholesale, and distribution do not allow public access, are discreet, and in general will prevent illegal and hidden operations from going into residential "back bedrooms" or "garages" due to lack of a legalization path. This will undoubtedly increase enforcement efforts that take away cannabis tax revenue, not to mention the public safety issues associated with illegal operations in residential areas; 2. Limit on testing will create major bottlenecks in the supply channel as was the case in Nevada. This will subject the San Bernardino communities to untested and harmful cannabis. In addition, limiting the entire permit base to 12 without specifying the permit types will create a supply channel imbalance since most operators will opt to apply for storefronts. Sacramento, Fast Bay, Long Beach, San Bernardino, San Diego Business HQ: 1020 12`h Street, Second Floor, Sacramento, CA 95814 If the city chooses to go in this direction 12 permits maximum, we respectfully request the Council direct staff to modify the permit types to "Vertical Integration" giving the prevailing permittees the choice to implement facilities that would give them control of the wholesale and retail operational capacity to prevent an inevitable supply channel imbalance that may cripple the city's legalization effort. Such approach is in line with the State's licensing approach for both Micro and General Cannabis operations. Furthermore, we strongly believe testing should be excluded from the maximum because such operations are like a traditional laboratory without much products onsite. In general, a testing facility with 450 to 600 active customers at any point in time is only holding one to two pounds cannabis samples that are needed for testing, well below the state limits for even personal use!
