AN ORDINANCE OF THE MAYOR AND CITY COUNCIL
OF THE CITY OF SAN BERNARDINO, CALIFORNIA
AMENDING SECTION 2.58.010 OF CHAPTER 2.58 OF
TITLE 2 OF THE SAN BERNARDINO MUNICIPAL CODE
RELATING TO MEETINGS
WHEREAS, Section 309 of the City Charter for the City of San Bernardino ("City')
authorizes the City Council to establish the time and place of its meetings; i nd
WHEREAS, on April 17, 2017, the Mayor and City Council adopted Ordinance No.
MC -1438 amending Chapter 2.58 of the San Bernardino Municipal Code to establish meeting
procedures; and
WHEREAS, now, the City Council desires to amend Section 2.58.010 of Chapter 2.58 of
the San Bernardino Municipal Code to change the time of City Council meetings.
THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by this
reference.
SECTION 2. Section 2.58.010 of Chapter 2.58 of the San Bernardino Municipal Code is
hereby amended in its entirety to read as follows:
"2.58.010 Mayor and City Council
A. Regular meetings of the Mayor and City Council of the City of San Bernardino shall be
held on the first and third Wednesdays of each month commencing at five -thirty p.m.
(5:30 p.m.) for Closed Session and at seven p.m. (7 p.m.) for Open Session at the City
Council Chambers, City Hall, 300 North "D" Street, San Bernardino, California, or such
other location within the City as may be properly noticed.
B. The City Council, as the elected body serving all of the residents of the City, shall
perform its duties and exercise its powers in a manner that serves the best interests of the
entire City, rather than any particular geographic area or special interest."
SECTION 3. Effective Date. This Ordinance shall take effect thirty (30) days after its
adoption.
SECTION 4. Severability. If any section, subsection, subdivision, paragraph, sentence,
clause or phrase of this ordinance, or any part thereof, is for any reason held to be
unconstitutional, such decision shall not affect the validity of the remaining portion of this
Ordinance or any part thereof. The City Council hereby declares that it would have passed each
section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the
fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase

be declared unconstitutional. If for any reason any portion of this ordinance is found to be
invalid by a court of competent jurisdiction, the balance of this ordinance shall not be affected.
SECTION 5. Certification. City Clerk of the City of San Bernardino shall certify to the
adoption of this Ordinance and cause publication to occur in a newspaper of general circulation
and published and circulated in the City in a manner permitted under section 36933 of the
Government Code of the State of California.
SECTION 6. CEQA. The City Council finds that this Ordinance is not subject to the
California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity
will not result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for
resulting in physical change to the environment, directly or indirectly.
