Speaker slips must be turned in to the City Clerk. You may email your request to speak to publiccomments@sbcity.org prior to 4 p.m. Each request will cover one speaker. Those who wish to speak must submit their own request to be called on by the Mayor. o There is a 3-minute-per-person time limit for all comments, excluding public or quasi-judicial hearings. o Written comment on any item may also be submitted to the City Clerk to be included in the meeting record. Waive Full Reading of Resolutions and Ordinances Recommendation: Waive full reading of Resolutions and Ordinances on the agenda dated November 21, 2018. 5. City Council Approval of Commercial and Payroll Checks Recommendation: Approve the commercial and payroll checks for October 2018. 6. Agreement with Western Allied Corporation for Feldheym Central Library HVAC Upgrade Recommendation: Adopt Resolution No. 2018-300 of the Mayor and City Council of the City of San Bernardino, California, approving the award of a design-build contract with Western Allied Corporation in the amount of $569,200 for Feldheym Central Library HVAC Upgrade; authorizing the City Manager to execute the construction contingency in the amount of $56,800; and authorizing the City Manager or designee to expend the contingency fund, if necessary, to complete the project. 7. Issuance of a Purchase Order to Transwest Truck Center for the purchase of one (1) 2019 PB B-4 Patch Truck unit, Mounted on a 2019 F750 Gas Chassis Recommendation: Adopt Resolution No. 2018-302 of the Mayor and City Council of the City of San Bernardino, California, authorizing the Director of Finance to issue a purchase order to Transwest Truck Center in an amount not to exceed $210,400 for the purchase of one (1) new 2019 PB B-4 Patch Truck unit mounted on a 2019 F-750 Chassis. Issuance of a Purchase Order to Fairview Ford Sales for the purchase of six (6) 2019 Ford F Series Super Duty F -350 4X2 with Crew Cab 6.75 Box Trucks Recommendation: Adopt Resolution No. 2018-303 of the Mayor and City Council of the City of San Bernardino, California, authorizing the Director of Finance to issue a purchase order to Fairview Ford Sales in an amount not to exceed $180,184 to purchase six (6) new 2019 Super Duty Ford F-350 SRW (W3A) XL 2 WE Crew Cab 6.75 box trucks. 9. Issuance of a Purchase Order to Fairview Ford Sales for the purchase of two (2) 2019 Ford F Series Super Duty F-150 4WD with Super Crew Cab 6.75 Box Trucks Recommendation: Adopt Resolution No. 2018-304 of the Mayor and City Council of the City of San Bernardino, California, authorizing the Director of Finance to issue a purchase order to Fairview Ford Sales, Inc. in an amount not to exceed $54,900 for the purchase of two (2) new 2019 Super Duty Ford F-150 (x1E) XL 4WD Super Cab 6.75 Box trucks. 10. Award of Construction Contract for Mountain Avenue and 40th Street Improvements to Hillcrest Contracting Inc. Recommendation: Adopt Resolution No. 2018-305 of the Mayor and City Council of the City of San Bernardino, California, approving the award of a Construction Contract with Hillcrest Contracting, Inc. in the amount of $917,088 for Mountain Avenue and 40th Street Improvements; authorizing the City Manager to execute the construction contingency in the amount of $92,000; and authorizing the City Manager or designee to expend the contingency fund, if necessary, to complete the project. 11. October 2018 City Board, Commission, and Citizen Advisory Committee Approved Minutes Recommendation: Receive and file the minutes from the City board, commission, and citizen advisory committee meetings approved in October 2018. Amend the Professional Services Agreement with Jones & Mayer to provide legal counsel to the Personnel Commission in association disciplinary appeal hearings Recommendation: Authorize the City Manager to execute an amendment to the Professional Services Agreement between Jones & Mayer and the City of San Bernardino (Resolution No. 2018-16) to provide legal counsel to the Personnel Commission in association with disciplinary appeal hearings increasing the expenditure limit to $50,000. 13. Agreement with Micon Construction, Inc. for Splash Parks Improvements Recommendation: Adopt Resolution No. 2018-306 of the Mayor and City Council of the City of San Bernardino, California, approving the award of a design-build contract with Micon Construction, Inc. in the amount of $832,907 for Splash Parks Improvements; authorizing the City Manager to execute the construction contingency in the amount of $83,093; and authorizing the City Manager or designee to expend the contingency fund, if necessary, to complete the project. 14. Change of Ownership of Wilson Towing, LLC Recommendation: Adopt Resolution No. 2018-307 of the Mayor and City Council of the City of San Bernardino, California, approving the change of ownership of Wilson Towing, LLC, in order to continue participation in the San Bernardino Police Department tow rotation. 15. Authorization for the Upgrade of Internet Service from Spectrum, Inc. for a 60 month term not to exceed $232,200 Recommendation: Authorize the City Manager or her designee to execute documents and issue a purchase order for the upgrade of Internet Service from Spectrum , Inc. for a 60 month term not to exceed $232,200. 16. Authorization for the Purchase of Communication Services from AT&T Not to Exceed $140,000 Recommendation: Authorize the City Manager or her designee to issue a purchase order for the purchase of communication services from AT&T not to exceed $140,000. Authorization for the Purchase of Communication Services from TPX for MPLS Data Transport and PRI Services in the Amount Not to Exceed $340,000 Recommendation: Authorize the City Manager or her designee to issue a purchase order for the purchase of communication services from TPX for MPLS Data Transport and PRI Services in an amount not to exceed $340,000. 18. Read By Title Only, Waive Further Reading, and Adopt Ordinance No. MC - 1509 Establishing Procedures for Filling City Council and Mayoral Vacancies Recommendation: Read By Title Only, Waive Further Reading, and Adopt Ordinance No. MC-1509 of the Mayor and City Council of the City of San Bernardino, California, adding Chapter 2.03 to Title 2 of the San Bernardino Municipal Code, establishing procedures for filling City Council and Mayor vacancies. STAFF REPORTS 19. Fiscal Year 2017/18 Yearend Financial Update, 10-Year Financial Plan, City Attorney’s Office Service Delivery Changes, and Adoption of a General Fund Reserve Policy Recommendation: 1. Receive and file reports on the financial operating results for FY 2017/18, the 10-Year Financial Plan, and an update on the fiscal impacts of the changes in service delivery related to the City Attorney’s Office; and 2. Adopt Resolution No. 2018-308 of the Mayor and City Council of the City of San Bernardino, California, establishing a General Fund Reserve Policy. 20. Prisoner/Detainee Transportation and Jail Operations Services Recommendation: Review and discuss the options related to reducing the amount of time spent by patrol officers transporting persons, addressing the booking/admission processes, and authorize the City Manager to issue a Request for Proposals for prisoner/detainee transportation and jail operations services. JP Morgan Chase AdvancingCities Challenge Recommendation: Review and discuss the JP Morgan Chase AdvancingCities Challenge and application for funding and authorize the City Manager to execute on behalf of the City, correspondence supporting the application by the Making Hope Happen Foundation representing the San Bernardino AdvancingCities Collaborative. 22. ADJOURNMENT The next joint regular meeting of the Mayor and City Council and the Mayor and City Council Acting as the Successor Agency to the Redevelopment Agency will be held on Wednesday, December 5, 2018 in the Council Chamber located at 201 North “E” Street, San Bernardino, California 92401. Florence Avenue, Santa Fe Springs, California 90670 is a competent experienced consulting engineering firm and has provided the most advantageous and best proposal to provide design-build services for Felheym Central Library HVAC Upgrade; and BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Manager or his designee is hereby authorized and directed to award a design-build contract to Allied Western Corporation, in the amount of $569,200. SECTION 3. The City Manager or designee is hereby authorized and directed to execute said contingency not to exceed $56,800 on behalf of the City. SECTION 4. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 5. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. Background San Bernardino City Charter, Section 307(b) states , “The method of filling [Council or Mayor] vacancies shall be as prescribed by ordinance.” In light of the upcoming election, where it is possible that City Council seats will be vacated, the a doption of an ordinance specifying how vacancies can be filled is necessary and appropriate. On October 17, 2018, the City Council considered various options to address the filling of vacancies. The City Council directed staff to bring back an ordinance consistent with the former City Charter. Discussion Article II, Sections 14-A and Article IV, Section 51 of the former City Charter, which was adopted by voters on November 2, 2004, provided the procedures for the filling of vacancies on the City Council and in the office of Mayor. Section 14-A provided that City Council vacancies must be filled by election, on a date to be determined by the Mayor and City Council and in a manner provided by general law. Section 51 provided that a vacancy of the Mayor’s office would be filled through appointment by a majority vote of the City Council. PURPOSE To 1) provide a framework for the allocation of available General Fund resources to various categories of budget reserves and 2) provide guidelines under which these reserves may be utilized for operating or capital purposes with approval by the Mayor and City Council. II. BACKGROUND Maintenance of sufficient budget reserves is a central component of sound financial management practices. Reserves are designed to set aside funding today for future liabilities, capital projects and capital purchases; assist in maintaining stable service levels in times of declining revenues and/or unanticipated operating expenditures; and facilitate the continuation of services in the event of natural disasters or fiscal emergencies. The City of San Bernardino annually adopts an operating budget that allocates resources to City departments for the provision of services to the public. To determine the amount of funds available for appropriation, City management develops a revenue projection and notes the available reserve balance from the prior fiscal year. Proposed expenditures are then matched against these available resources. If proposed expenditures exceed projected revenue, utilization of available reserves may be used to meet the proposed level of spending thus decreasing the available reserve. When projected revenue exceeds proposed expenditures, the surplus increases the opening balance of available reserves if the budget is not amended to use these surplus funds. The City also has known capital needs that include facilities, equipment, vehicle, and infrastructure replacement. This policy’s goal is to ensure that sufficient resources exist to address these anticipated needs, as well as unanticipated needs that may arise on an infrequent basis. 19.f Packet Pg. 590 Attachment: FN.Yearend Finanical Update.General Fund Reserve. Attachment 1 to Resolution (5833 : Fiscal Year 2017/18 Yearend Financial III. POLICY 1. General Fund Operating Reserve: It shall be the policy of the City of San Bernardino to maintain a General Fund operating reserve equal to 25% of General Fund budget appropriations. This reserve is to be further broken down as follows: A. An Emergency Reserve of 15% - This reserve account is established for the purpose of addressing any extremely unusual and infrequent occurrences, such as a major natural disaster or a major unforeseen legal settlement or judgment. Utilization of the Emergency Reserve may only occur after the declaration of an emergency by a majority of the City Council. Following the resolution of the emergency, staff must present a plan to the Mayor and City Council to return the Emergency Reserve to the 15% minimum level as quickly as is practicable given the unique circumstances and requirements of each emergency. B. An Economic Contingency Reserve of 10% - This reserve account is established for the purpose of providing a mechanism to allow for a measured and thoughtful reduction in expenditures during times of economic downturn. Utilization of the Economic Contingency Reserve requires approval by a majority of the City Council. When it is determined that the economic downturn has ended and the City’s financial condition is improving, staff is required to present a plan to the Mayor and City Council to return the economic contingency reserve to the 10% minimum level over a period of no more than five years. If the General Fund operating reserve exceeds 30% of General Fund budget appropriations, staff is required to present a plan to the Mayor and City Council to utilize excess funds consistent with its adopted Goals and Objectives to a point that the balance is again consistent with the policy. Uses could include accelerating funding into the special reserves noted below in this policy; capital projects, vehicle, or equipment purchases not originally planned for the current fiscal year; early repayment of outstanding debt obligations; or other expenditures of a one-time nature. Attachment 1 to Resolution (5833 : Fiscal Year 2017/18 Yearend Financial following budget cycle sufficient to restore the reserve balance to the 25% minimum balance required by this policy. 2. General Fund Special Reserves: It shall be the policy of the City of San Bernardino to establish General Fund special reserves to provide funding for future anticipated liabilities and capital needs. These reserves shall be segregated into the following four accounts: A. Risk Management Reserve – This reserve account is established to fund anticipated liabilities associated with general liability and workers’ compensation claims against the City. Its balance will be initially determined, and thereafter adjusted, based on the balance of available reserve funds after meeting the General Fund Operating Reserve requirement and then giving consideration to both the outstanding balance of claims as well as to the anticipated timing of claim payments. B. City Facilities Reserve – This reserve account is established to fund the cost of replacing city buildings and park facilities. Its balance will be initially determined, and thereafter adjusted, based on the balance of available reserve funds after meeting the General Fund Operating Reserve requirement and then giving consideration to the facilities needs analysis maintained by the Public Works department. C. Vehicles and Equipment Reserve – This reserve account is established to fund the cost of replacing General Fund-funded city vehicles and major equipment (including technology equipment). Its balance will be initially determined, and thereafter adjusted, based on the balance of available reserve funds after meeting the General Fund Operating Reserve requirement and then giving consideration to the vehicle and equipment assessment needs analyses maintained by the Fleet division and the Information Technology department. D. Infrastructure Reserve – This reserve account is established to provide additional funding for the cost of replacing city infrastructure such as roads, sidewalks, and storm drains. These funds are to supplement dedicated non-General Fund revenue streams and competitive grants that also fund these types of projects. These funds may also provide for the match requirement on a grant when other resources are not available. The goal for General Fund special reserves is to fund at a level sufficient to address anticipated requirements over a projected period of 30 years, subject to availability of funds and prioritization of funding between the four categories of special reserves by the Mayor and City Council. As a part of each annual budget presented to the Mayor and City Council, staff will update the balances for the four categories of special reserves and any anticipated utilization or additions to the General Fund special reserves. PROCEDURES At the conclusion of each fiscal year and at each fiscal year’s mid-year budget update, the General Fund reserve levels shall be reviewed by staff and detailed to the Mayor and City Council.
