Recommendation a Conduct a Public Hearing on the proposed vacation of a portion of "I" Street South of Rialto Avenue and those portions of the east-west alleys and one north-south alley, between Rialto Avenue and 3rd Street. ° Adopt a Resolution of the Mayor and City Council of the City of San Bernardino, California, ordering the vacation of a portion of "I" Street South of Rialto Avenue and those portions of the east-west alleys and one north-south alley, between Rialto Avenue and 3rd Street, and the reservation of easements therein. a Summary of Report This report requests that the City Council Conduct a Public Hearing and order the o Vacation of the Public Right of Way with a reservation for sidewalk purposes which was not reserved in a previous Council Action. Since the vacation will not be recorded until CD after the sidewalk has been constructed and accepted by the City Engineer, there is an opportunity to revisit the vacation and reserve the easement, thus saving the cost of right-of-way acquisition. o a LU Background Streets And Highways Code (SHC) section 8312, gives a city legislative body the power o to vacate all or part of a street and sets forth the procedures by which the power to 0 vacate may be executed. The requested street vacation would be conducted under the General Vacation Procedures outlined in SHC sections 8320 through 8325. First, a legislative body may initiate proceedings either on its own initiative or upon a petition or request of an interested person or persons. The initiation of proceedings starts with a fixing the date, hour and place of the hearing, followed by publishing and posting of notices prior to the hearing. After the hearing, if the legislative body finds that the street E U M V Q Packet Pg. 495 17.a described in the notice of hearing or petition is unnecessary for present or prospective public use, the legislative body may adopt a resolution vacating the street. The street .� vacation is not complete until such time that is has been recorded with the County 0 Recorder's office. 0 Cn On February 18, 2014 the Mayor and City Council authorized the investigation of the iv proposed vacation of a portion of"I" Street South of Rialto Avenue and those portions of the east-west alleys and one north-south alley, between Rialto Avenue and 3rd Street Cn shown on Plan No. 13012 (Attachment 1). w 0 c On July 7, 2014 the Mayor and City Council adopted Resolution No. 2014-262 declaring .2 the City's intention to vacate a portion of "I" Street South of Rialto Avenue and those a portions of the east-west alleys and one north-south alley, between Rialto Avenue and 3rd Street, and reserving utility easements therein and setting a public hearing for 0 August 18, 2014. 0 On August 18, 2014 the Mayor and City Council opened the public hearing for the > vacation of a portion of"I" Street South of Rialto Avenue and those portions of the east- west alleys and one north-south alley, between Rialto Avenue and 3rd Street, and 0 0. reserving utility easements therein. The item was continued to the September 2"d a meeting and the public hearing remained open. On September 2, 2014 the Mayor and City Council, having received no new public 0 comments, closed the public hearing and adopted Resolution No. 2014-340, Resolution of the Mayor and Common Council of the City of San Bernardino Ordering the Vacation W of a Portion of "I" Street South of Rialto Avenue and Those Portions of the East-West = Alleys and One North-South Alley, Between Rialto Avenue and 3rd Street, and Reserving Utility Easements Therein. a One of the conditions of this vacation was that SANBAG construct, pursuant to an approved plan, the cul-de-sac and improvements at "I" Street south of Rialto Avenue. o These improvements were to be constructed before the recordation of the resolution approving the vacation. The plans called for the construction of a 10' wide concrete 00 path running along the west side of the railroad right of way, connecting the cul-de-sac U) on "I" Street to Rialto Ave. An easement was obtained from the property owner to allow the improvements to be installed on the private property at the Southwest corner of the 0 intersection of the Rialto Avenue and "I" Street right of ways. A portion of the 10' wide w concrete path occupies the portion of "I" Street to be vacated. No easement was W reserved for this facility. o On July 27, 2017 the Public Works Department received a letter (Attachment 2) from 0 the San Bernardino County Transportation Authority (SBCTA), formerly San Bernardino a Associated Governments (SANBAG) requesting that the City reopen the public hearing a for the vacation of a portion of "I" Street South of Rialto Avenue and those portions of the east-west alleys and one north-south alley, between Rialto Avenue and 3rd Street to a consider the reservation of an additional easement for public sidewalk and pedestrian purposes. Packet Pg. 496 17.a 0 .r m On September 6, 2017 the Mayor and City Council adopted Resolution 2017-173, declaring their intention to reopen the public hearing on October 4, 2017 and causing o the required posting and publication of notices to be made. 0 N On September 20, 2017 notice of the public hearing was posted along the portions of CD street/alley proposed to be vacated pursuant to SHC section 8323. r On September 15, 2017 and September 22, 2017 notice of the public hearing was co published in the San Bernardino Sun Newspaper pursuant to SHC section 8322. w 0 0 Discussion 0 0 The proceedings for the vacation of a portion of "I" Street South of Rialto Avenue and M those portions of the east-west alleys and one north-south alley, between Rialto Avenue o and 3rd Street remain open because Resolution No. 2014-340 has not been recorded o per Council direction that improvements be constructed before recordation of the vacation. This allows the Mayor and City Council to reopen the public hearing in order > to consider the reservation of the easement for public sidewalk and pedestrian purposes. 0 CL0 San Bernardino County Transportation Authority (SBCTA), formerly known as San a Bernardino Associated Governments (SANBAG), is currently working on the Downtown San Bernardino Passenger Rail Project (DSBPRP, also known as Redlands First Mile) o which expands mass transit options to commuters in San Bernardino and Redlands. 0) SANBAG requested the vacation of a portion of "I" Street, south of Rialto Avenue, pursuant to a safety policy to consider closing at-grade crossings when other crossings are nearby. The California Public Utilities Commission (CPUC) recommended the permanent closure of this portion of "I" Street, removing the crossing and providing the a highest level of crossing safety. U 7 In addition, SANBAG requested that portions of the east-west alleys and on north-south o alley, between Rialto Avenue and 3`d Street, be included in the street vacation. The 0. east-west alleys were previously vacated at the crossings (Main Street, Broadway a) Street, Wallace Subdivision alley), however the installation of additional tracks requires coco widening of the railroad right-of-way. ,. An Indemnity Agreement between SANBAG and the City was considered concurrently a with the previous order to vacate and approved with Resolution 2014-339 (Attachment 3) and executed. Per the Indemnity Agreement the City would take any and all action(s) U_ necessary and appropriate to vacate the streets/alleys as shown on Plan No. 13012 and 0 in return SANBAG would, to the maximum extent permitted by law, indemnify, defend o and hold the City free and harmless with regards to litigation arising from and filed within a one year of completion of the vacation of said streets/alleys. a Not considered at the previous public hearing was a reservation of easement for Public a sidewalk and Pedestrian Purposes. Without the reservation of an easement for Public Sidewalk and Pedestrian Purposes, once the Resolution ordering the vacation of the M a Packet Pg. 497 17.a street is recorded, the portion of 10' sidewalk that currently occupies the "I" Street right of way will then be located on private property and it will become necessary to purchase an easement from the property owner for the area the sidewalk occupies. Reserving an o easement for Public Sidewalk and Pedestrian Purposes within the order to vacate will allow these facilities the continuous right to be there after the street vacation takes y effect. d d L W After the public hearing the Mayor and City Council will consider a resolution which rescinds Resolution 2014-340 and orders the vacation of a portion of "I" Street South of Rialto Avenue and those portions of the east-west alleys and one north-south alley, between Rialto Avenue and 3rd Street and the reservation of easements therein. The c resolution does not change the substance of the original vacation and adopts the same a California Environmental Quality Act determination and uses the same descriptions and reservation of easements. The changes in the order to vacate are limited to a change o to the exhibit indexing and the inclusion of an easement for public sidewalk and o pedestrian purposes as Exhibit"U" and Exhibit "V". M Fiscal Impact If the reservation of easement for public sidewalk and pedestrian purposes is not made c then the easement will need to be acquired from the adjoining property owner at fair o market value. a a) Conclusion = Staff recommends that the Mayor and City Council adopt the Resolution rescinding ^' Resolution 2014-340 and ordering the vacation of a portion of "I" Street South of Rialto Avenue and those portions of the east-west alleys and one north-south alley, between = Rialto Avenue and 3rd Street, and the reservation of easements therein.
