MC -1442 ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT 16- 01, DEVELOPMENT CODE AMENDMENT (ZONING MAP AMENDMENT) 16-01, AND SPECIFIC PLAN 16-01 TO CHANGE THE GENERAL PLAN LAND USE DESIGNATIONS AND ZONING DISTRICTS OF AN AREA CONTAINING APPROXIMATELY 41.6 ACRES TO THE RANCHO PALMA SPECIFIC PLAN WHEREAS, the current City of San Bernardino Development Code was initially implemented in 1991; and WHEREAS, the current City of San Bernardino General Plan was initially implemented in 2005; and WHEREAS, on February 15, 2017 the Planning Commission of the City of San Bernardino held a noticed public hearing to consider public testimony and the staff report, and adopted Resolution 2017-014 recommending the certification of the Final Environmental Impact Report and the approval of General Plan Amendment 16-01, Development Code Amendment (Zoning Map Amendment) 16-01, Specific Plan 16-01, Subdivision 16-02 (Tentative Parcel Map 19701) and Subdivision 16-03 (Tentative Tract Map 20006) to the Mayor and City Council; and WHEREAS, notice of the public hearing for the Mayor and City Council's consideration of the proposed Ordinance was published in The Sun newspaper on March 24, 2017. NOW THEREFORE, THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. The Mayor and City Council find that the above -stated Recitals are true and hereby adopt and incorporate them herein. SECTION 2. Findims of Fact — General Plan Amendment 16-01. Finding No. 1: The proposed amendment is internally consistent with the General Plan. Finding of Fact: The proposed amendment will allow a mixed use development that incorporates unique design elements, and creates a walkable neighborhood with commercial uses and open space to serve the 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Finding No. 2: Finding of Fact: Finding No. 3 Finding of Fact: residential portion of the development and the surrounding neighborhood, while also taking advantage of the sites proximity to Interstate 215, and the SBx Rapid Transit Bus Line. Adequate utility services will be provided for the development and sustainable design features will be incorporated which will encourage water and energy conservation, and reduce the developments overall impact on the surrounding environment. Therefore, the proposed amendment is internally consistent with the General Plan. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City. The proposed Rancho Palma Specific Plan would establish a land use and development framework to serve as a marketing tool for attracting developers to key sites and for boosting economic development. The Specific Plan is dedicated to creating a mixed use neighborhood that compliments the surrounding community by type and quality of development. The project provides additional shopping and commercial services to the area within walking distance to residents of Rancho Palma and the Verdemont Heights Community. Additionally, the Rancho Palma Specific Plan promotes water and energy conservation through sustainable development requirements for drought tolerant landscaping, guidelines for implementing renewable energy sources for utilities, and creating a walkable and convenient neighborhood with a mix of commercial, residential, and open spaces for families to gather. Therefore, the proposed Specific Plan will not be detrimental to the public interest, health, safety, convenience, or welfare of the City. The proposed amendment would maintain the appropriate balance of land uses within the City. The proposed amendment will allow a mixed use project that creatively balances the need for housing within the City and additional commercial retail uses in an area that is currently underserved, while also incorporating the expansion of an existing public park, the addition 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20''. 21 22 23 24 25 26 27 28 of two private parks for the residents of the development to enjoy, and a walking path connecting the residential neighborhood to the commercial center integrating the uses and adding convenience to the residents in the area and an appropriate balance of land uses to the project area. Finding No. 4 In the case of an amendment to the General Plan Land Use Map, the subject parcel(s) is physically suitable (including, but not limited to access, provisions of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested land use designation(s) and the anticipated land use development(s). Finding of Fact: The area surrounding the project site is substantially developed, so the site will have adequate access to utilities for the residential and commercial uses. The site is also framed by existing roadways and is in close proximity to various transportation routes and types, including Interstate 215 and the SBx Rapid Transit Bus Line. There are no existing physical constraints that would interfere with the development of the site for the proposed land uses. SECTION 3. Findings of Fact — Development Code Amendment (Zoning Man Amendment) 16-01: Finding No. 1: The proposed amendment is consistent with the General Plan. Finding of Fact: The proposed amendment will allow a mixed use development that incorporates unique design elements, and creates a walkable neighborhood with commercial uses and open space to serve the residential portion of the development and the surrounding neighborhood, while also taking advantage of the sites proximity to Interstate 215, and the SBx Rapid Transit Bus Line. Findings of Fact — Specific Plan 16-01: Finding No. 1: The proposed plan is consistent with the General Plan. Finding of Fact: The proposed Specific Plan provides a detailed explanation of the Specific Plan's relationship to the City's General Plan, including a comparison of goals, objectives and policies. The following discussion demonstrates how the Rancho Palma Specific Plan's goals are consistent with the General Plan Goals: ✓ Land Use Element o 2.1 Preserve and Enhance San Bernardino's Unique Neighborhoods. The Rancho Palma Land Use Plan is designed to be compatible with the surrounding residential and commercial uses within the Verdemont Heights Community. o 2.2 Promote Development that Integrates with and Minimizes Impacts on Surrounding Land Uses. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The residential uses proposed are separated from the adjacent existing residential uses by the Cable Creek Channel. o 2.3 Create and Enhance Dynamic, Recognizable Places for San Bernardino's Residents, Employees, and Visitors. The Specific Plan Design Guidelines provide for the creation of unique, quality residential and commercial development. o 2.4 Enhance the Quality of Life and Economic Vitality in San Bernardino by Strategic Infill of New Development and Revitalization of Existing Development. Rancho Palma is infill development of a previously disturbed site. o 2.5 Enhance the Aesthetic Quality of Land Uses and Structures in San Bernardino. The Specific Plan Design Guidelines provide for the creation of unique, quality residential and commercial development. ✓ Housing Element o 3.1 Facilitate the Development of a Variety of Types of Housing to Meet the Needs of All Income Levels in the City of San Bernardino. Rancho Palma provides for two residential lot sizes and corresponding living areas to meet the needs of a variety of income levels and residential lifestyles. ✓ Economic Development Element o 4.1 Encourage Economic Activity that Capitalizes upon the Transportation and Locational Strengths of San Bernardino. The commercial component of the Specific Plan takes advantage of the site's proximity to the interstate 215/Palm Avenue interchange. ✓ Community Design Element o 5.3 Recognize Unique Features in Individual Districts and Neighborhoods and Develop a Program to Create Unifying Design Themes to Identify Areas Throughout the City. The Specific Plan Design Guidelines provide for the creation of unique, quality residential and commercial development. o 5.4 Ensure Individual Projects are Well Designed and Maintained 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The Specific Plan Design Guidelines provide for the creation of unique, quality residential and commercial development and the residential homeowners association will be responsible for the maintenance of the private streets, parks, and gate houses. 0 5.5 Develop Attractive, Safe, and Comfortable Single Family Neighborhoods. The Specific Plan Design Guidelines provide for the creation of unique, quality residential development. o 5.7 Develop Attractive and Safe Commercial, Office, and Industrial Projects that are Creatively Designed and Intelligently Sited. The Specific Plan Design Guidelines provide for the creation of unique, quality commercial development. ✓ Circulation Element o 6.1 Provide a Well -Maintained Street System. The interior local roads will be maintained by the Rancho Palma homeowners association. ✓ Parks Recreational and Trails Element 0 8.1 Improve the Quality of Life in San Bernardino by Providing Adequate Parks and Recreation Facilities and Services to Meet the Needs of Our Residents. The Rancho Palma Specific Plan provides for a variety of private parks, as well as the expansion of the existing Ronald Reagan Park. 0 8.4 Provide Adequate Funding for Parkland and Trails Acquisition, Improvements, Maintenance, and Programs. The private parks will be improved by the developer and maintained by the homeowners association. The Ronald Reagan Park expansion parcel will be dedicated to the City of San Bernardino. ✓ Utilities Element o 9.1 Provide a System of Wastewater Collection and Treatment Facilities that will Adequately Convey and Treat wastewater Generated by Existing and Future Development in the City's Service Area. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The Rancho Palma Specific Plan provides for the creation of a wastewater system that will tie into existing facilities. 0 9.3 Provide Water Supply, Transmission, Distribution, Storage, and Treatment Facilities to Meet Present and Future Water Demands in a Timely and Cost Effective Manner. The Rancho Palma Specific Plan provides for the creation of a water system that will tie into existing facilities. 0 9.4 Provide Appropriate Storm Drain and Flood Control Facilities where Necessary. The Rancho Palma Specific Plan provides for the creation of a drainage system that will tie into existing facilities. 0 9.10 Ensure that the Costs of Infrastructure Improvements are Borne by those who Benefit. The infrastructure improvements required by the Rancho Palma Specific Plan will be financed by the builder. ✓ Safety Element o 10.5 Reduce Urban Run -Off from New and Existing Development. The Specific Plan Design Guidelines provide a variety of measures to reduce urban run-off, including a drainage basin and bio-swales. ✓ Ener v and Water Conservation Element o 13.1 Conserve Scarce Energy Resources. The Rancho Palma Specific Plan contains a chapter on Sustainable Guidelines to reduce energy and water use and conserve natural resources. ✓ Noise Element o 14.1 Ensure that Residents are Protected from Excessive Noise Through Careful Land Planning. Through site planning and construction techniques, Rancho Palma residents will be protected from excessive noise. Therefore, the proposed Specific Plan will not be detrimental to the public interest, health, safety, convenience, or welfare of the City. The subject properties are physically suitable for the requested land use designations and the anticipated land use developments. The proposed Rancho Palma Specific Plan allows up to 120 single family dwelling units located within two residential planning areas, and up to 98,000 square feet of commercial uses in one planning area. The residential areas are designed to provide a gated single family community with access to a variety of recreational opportunities, while the commercial planning area is designed to provide retail opportunities for local residents, as well as take advantage of the adjacent regional traffic along Interstate 215. The proposed project will integrate well into the surrounding neighborhood and Verdemont Heights Community, and will add needed commercial retailers to the area. The proposed plan shall ensure development of desirable character which will be compatible with existing and proposed development in the surrounding neighborhood. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Finding of Fact: The Rancho Palma Specific Plan has been created with the great consideration for the surrounding neighborhood, and several community outreach meetings were held over the last two years in preparation for the Specific Plan. In addition to adding needed commercial uses to an underserved area, future development of the Specific Plan area will create a medium density, walkable neighborhood with open spaces for children and families to enjoy, while maintaining high quality design for the residential, as well as commercial uses proposed. Finding No. 5: The proposed plan will contribute to a balance of land uses so that local residents may work and shop in the community in which they live. Finding of Fact: The following objectives have been established for the Rancho Palma Specific Plan and will aid decision makers in their review of the project and associated environmental impacts: ✓ Establish a mixed use community for the Verdemont Heights Community with a balance of land uses including commercial, single family housing, and recreation; ✓ Deliver an appropriately sized neighborhood commercial center that provides a mix of retail uses with employment growth and increased sales tax for San Bernardino; ✓ Provide new single family housing in the Verdemont Heights Community; ✓ Increase the Verdemont Heights Community's recreation opportunities by expanding the size and/or amenities of Ronald Reagan Park; ✓ Adopt appropriate standards and design guidelines to implement the development to insure compatibility to surrounding neighborhoods; ✓ Promote a sense of community and character by providing neighborhood signage and monumentation; ✓ Create a pedestrian environment with walkable parks and commercial uses; 1 2 3 4 5 6 7 8 9! 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ✓ Provide for a fiscally sound project that provides for ongoing maintenance and operation of neighborhood parks and project streets with the additional sales tax revenues from the commercial; ✓ Improve circulation in the Verdemont Heights Community with improvements of West Little League Drive and Magnolia Avenue adjacent to the project; ✓ Facilitate additional public parking with the improvement of West Little League Drive and Magnolia Avenue; ✓ Reduce the need for overnight parking of RV units on the street or driveways with the provision of an RV storage yard; and ✓ Promote a "Green" project with water and energy saving measures as defined by the Sustainable Guidelines. SECTION 5. Compliance with the California Environmental Quality Act. The Mayor and City Council having independently reviewed and analyzed the record before it, including the Final Environmental Impact Report and written and oral testimony, and having exercised their independent judgment, find that General Plan Amendment 16-01, Development Code Amendment (Zoning Map Amendment) 16-01, Specific Plan 16-01, Subdivision 16-02 (Tentative Parcel Map 19701), and Subdivision 16-03 (Tentative Tract Map 20006) will have no significant adverse effect on the environment with the adoption of the Mitigation Monitoring and Reporting Program; and find that the Final Environmental Impact Report, as accepted by the Planning Commission as to the effects of the proposed General Plan Amendment 16-01, Development Code Amendment (Zoning Map Amendment) 16-01, Specific Plan 16-01, Subdivision 16-02 (Tentative Parcel Map 19701), and Subdivision 16-03 (Tentative Tract Map 20006), has been completed in compliance with CEQA and is hereby certified and incorporated herein by reference. SECTION 6. General Plan Amendment 16-01, Development Code Amendment (Zoning Map Amendment) 16-01, and Specific Plan 16-01 changing the General Plan Land Use Designations and Zoning Districts of an area containing approximately 41.6 acres to the Rancho Palma Specific Plan, is hereby approved and incorporated herein by reference. SECTION 7. Notice of Determination: The Planning Division of the Community Development Department is hereby directed to file a Notice of Determination with the County 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Clerk of the County of San Bernardino and State Clearinghouse within five working days of final project approval certifying the City's compliance with the California Environmental Quality Act in certifying the Final EIR. SECTION 8. Severability: If any section, subsection, subdivision, sentence, or clause or phrase in this Resolution or any part thereof is for any reason held to be unconstitutional, invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Resolution or any part thereof.
