Grubbs, Project Manager, Public Works v L Subject: Street Widening Project - 40th Street from Johnson Street to LO Electric Avenue. 00 Recommendation > Adopt the Resolution of the Mayor and City Council of the City of San Bernardino Authorizing the Execution of an Agreement for Professional Engineering Services with Engineering Resources of Southern California, Inc. to Provide Environmental and Civil w Engineering Design Services for the Widening of 40th Street from Johnson Street to 0 Electric Avenue. 0 L Background = 40th Street between Kendall Drive and Harrison Street is designated as a Major Arterial roadway. The segment between Johnson Street and Electric Avenue has not been fully o widened, and the intent of this project is to complete the widening of 40th Street to n provide four through traffic lanes from Kendall Drive all the way to Harrison Street. 0 4 0 This project consists of the widening of 40th Street between Johnson Street and Electric 2 Avenue to provide a total of two through lanes in each direction and a two-way left-turn Cn lane. See Attached Location Map. The project will include right-of-way acquisition, undergrounding overhead utility lines, pavement widening, pavement rehabilitation, curb L & gutter, sidewalk, street lights, ADA accessible ramps, drainage improvements, signing and striping and modification of the traffic signal at 40th Street and Electric Avenue. 0 L Discussion Can June 16, 2016, staff issued a Request for Proposals (RFP) for environmental and civil engineering design services for the widening of 40th Street from Johnson Street to Electric Avenue (CIP Project No. SSO4-014). 0 L RFP's were sent to fourteen engineering consulting firms in the Southern California area v, that had previously indicated interest in this type of work. The RFP was also posted on the City's "Request for Bids"website. A total of eight proposals were received on August E 4, 2016. The eight proposals were reviewed by a panel of staff members using the U City's standard rating system and it was determined that four of the proposals best met the requirements of the RFP. These proposals were submitted by the following firms: Q Packet Pg. 317 5.M.a Firm Location Fee ' $124,074 including 4 1. Civil Source, Inc. Irvine Potholes Engineering Resources $178,555 including 5 2` of Southern California, Inc, San Bernardino potholes $242,865 including 5 ° 1 Willdan San Bernardino Potholes U $272,658 including 30 a 4. KOA Corporation Ontario Potholes The above four firms were interviewed by staff and it was determined that the proposal and presentation by Engineering Resources of Southern California, Inc. (ERSC) best meets the requirement of the RFP''. ERSC has extensive experience and has completed many local projects in the San Bernardino area. Therefore, staff recommends that the City Council adopt the attached Resolution authorizing the City LO • co Manager to execute an agreement for this work with ERSC, Inc. for the not-to-exceed fee of $178,555 including 5 potholes. The pothole will consist of digging, prior to construction, to precisely locate underground utilities and identify conflicts. Environmental clearance and design are expected to be completed in late 2017. Right- ¢ of-way needs will be identified during the design phase of the work and that will enable the City to proceed with right-of-way acquisition. Approved plans will allow Southern a) California Edison to proceed with undergrounding of overhead utility lines in o accordance with the requirements of Underground Utility District No. 20 along 4f}t" Street between Kendall Drive and Palm Drive. Undergrounding of overheads and r construction are expected to be completed in 2022. 0 Fiscal Impact Funding for this project in the amount of $878,900 is budgeted in Account No. 264-160- 7160*5504. o Conclusion Staff recommends that the Mayor and City Council adopt the Resolution authorizing the n City Manager to execute an Agreement for Professional Engineering Services with o Engineering Resources of Southern California, Inc. to provide Environmental and Civil Engineering Design Services for the Widening of 40th Street from Johnson Street to ° Electric Avenue (SSO4-014). 0 o. Warranty. Consultant warrants that it shall perform the services required by this Agreement in compliance with all applicable Federal and California employment laws including, but not limited to, those laws related to minimum hours and wages; occupational health and safety; fair employment and employment practices; workers' compensation insurance and safety in employment; and all other Federal, State and local laws and > ordinances applicable to the services required under this Agreement. Non-discrimination. In performing this Agreement, Consultant shall not N engage in, nor permit its agents to engage in, discrimination in employment of persons s because of their race, religion, color, national origin, ancestry, age, physical handicap, medical condition, marital status, sexual gender or sexual orientation, or any other category c protected by law, except as permitted pursuant to Section 12940 of the Government Code. r Violation of this provision may result in the imposition of penalties referred to in Labor Code, Section 1735. v� s 1.5 Non-Exclusive Agreement. Consultant acknowledges that City may enter into agreements with other Consultants for services similar to the services that are subject to this ,o Agreement or may have its own employees perform services similar to those services contemplated by this Agreement. o a 1.6. Delegation and Assignment. This is a personal service contract, and the duties c set forth herein shall not be delegated or assigned to any person or entity without the prior written consent of City. y w a� 1.7. Business License: The Consultant shall obtain and maintain a valid City r Business Registration Certificate during the term of this Agreement. 00 1.8. Duty of Loyalty/Conflict of Interest: The Consultant understands and agrees that as the City's representative the Consultant shall maintain a fiduciary duty and a duty of d loyalty to the City in performing Consultant's obligations under this Agreement. Consultant, in performing its obligations under this Agreement, is governed by California's conflict of interest laws, Government Code Section 87100 et seq., and Title 2, California Code of Q Regulations Section 18700 et seq. Q 1.8.1 Prior to performing any services to City under this Agreement, w Consultant shall provide the City Engineer a written list of the Assessor Parcel Numbers and general location or address of any and all real property located in the City of San Bernardino in which Consultant has any ownership interest, or which is the location of any pending E project that is a source of income for Consultant. COMPENSATION AND BILLING a 2.1. Compensation. Over the term of this Agreement, Consultant shall be paid for such services the not-to-exceed amount of $173,805.00 plus $4,750 for five potholes at $950.00 each in accordance with the Fee Proposal from Consultant dated August 4, 2016, o attached and incorporated herein as Attachment"2". w L r 2.2. Additional Services. Consultant shall not receive compensation for any services provided outside the scope of services specified in this Agreement unless the City or N its Project Manager for this Project, prior to Consultant performing the additional services, s approves such additional services in writing. It is specifically understood that oral requests n and/or approvals of such additional services or additional compensation shall be barred and o are unenforceable. a� a� 2.3. Method of Billing. Consultant may submit invoices to City's Project Manager for approval on a progress basis, but no more often than monthly. Said invoice shall be based on the total of all Consultant's services which have been completed to City's sole °v satisfaction. City shall pay Consultant's invoice within forty-five (45) days from the date o City receives said invoice. Each invoice shall describe in detail, the services performed and the associated time for completion. Any additional services approved and performed o pursuant to this Agreement shall be designated as "Additional Services" and shall identify a the number of the authorized change order, where applicable, on all invoices. 'c a� 2.4. Records and Audits. Records of Consultant's services relating to this Agreement shall be maintained in accordance with generally recognized accounting principles and shall be made available to City or its Project Manager and/or audit at mutually convenient times for a period of three (3)years from the Effective Date. r 00 3.0. TIME OF PERFORMANCE c 3.1. Commencement and Completion of Work. The obligation to perform the professional and contracting services to be performed pursuant to this Agreement shall commence within five (5) days from the Effective Date of this Agreement. Said services Q shall be performed in strict compliance with the Project Schedule approved by the City's a Project Manager. Failure to commence work in a timely manner and/or diligently pursue r2 work to completion may be grounds for termination of this Agreement. w r 3.2. Excusable Delays. Neither party shall be responsible for delays or lack of performance resulting from acts beyond the reasonable control of the party or parties. TERM AND TERMINATION 4.1. Term. This Agreement shall commence on the date approved by the City Manager and continue until the Environmental and Civil Engineering Design Services for the Widening of 40th Street from Johnson Street to Electric Avenue (SSO4-014) are completed or June 30, 2018 whichever is sooner, unless previously terminated as provided herein or as Q U otherwise agreed to in writing by the parties. U N 4.2. Notice of Termination. The City reserves and has the right and privilege of o canceling, suspending or abandoning the execution of all or any part of the work contemplated by this Agreement, with or without cause, at any time, by providing written notice to Consultant. The termination of this Agreement shall be deemed effective upon receipt of the notice of termination. In the event of such termination, Consultant shall N immediately stop rendering services under this Agreement unless directed otherwise by the s City. E O 4.3. Compensation. In the event of termination, City shall pay Consultant for 4 reasonable costs incurred and professional and contracting services satisfactorily performed v up to and including the date of City's written notice of termination. Compensation for work can in progress shall be prorated as to the percentage of work completed as of the effective date of termination in accordance with the fees set forth herein. In ascertaining the professional and contracting services actually rendered hereunder up to the effective date of termination .° of this Agreement, consideration shall be given to both completed work and work in progress, to complete and incomplete drawings, and to other documents pertaining to the o services contemplated herein whether delivered to the City or in the possession of the a� Consultant. .E 4.4 Documents. In the event of termination of this Agreement, all documents prepared by Consultant in its performance of this Agreement including, but not limited to, finished or unfinished design, development and construction documents, data studies, drawings, maps and reports, shall be delivered to the City within ten (10) days of delivery of LO termination notice to Consultant, at no cost to City. Any use of uncompleted documents without specific written authorization from Consultant shall be at City's sole risk and without liability or legal expense to Consultant. E 5.0. INSURANCE L Q 5.1. Minimum Scope and Limits of Insurance. The comprehensive general liability insurance policy shall o contain or be endorsed to contain the following provisions: Y a� a� L (a) Additional insureds: "The City of San Bernardino and its elected and vn appointed boards, officers, agents, and employees are additional insureds with respect to this subject project and contract with City." °v L 4- (b) Notice: "Said policy shall not terminate, nor shall it be cancelled, nor the coverage reduced,until thirty(30) days after written notice is given o to City." c (c) Other insurance: "Any other insurance maintained by the City of San Bernardino shall be excess and not contributing with the insurance provided by this policy." L Y 5.3. Certificates of Insurance. Consultant shall provide to City certificates of `n LO insurance showing the insurance coverages and required endorsements described above, in a form and content approved by City,prior to performing any services under this Agreement. !T_ 5.4. Non-limiting. Nothing in this Section shall be construed as limiting in any E way, the indemnification provision contained in this Agreement, or the extent to which Consultant may be held responsible for payments of damages to persons or property. Q Q Y 6.0. GENERAL PROVISIONS 72 X 6.1. Entire Agreement. This Agreement constitutes the entire Agreement between ``� the parties with respect to any matter referenced herein and supersedes any and all other prior writings and oral negotiations. This Agreement may be modified only in writing, and signed by the parties in interest at the time of such modification. The terms of this Agreement shall w prevail over any inconsistent provision in any other contract document appurtenant hereto, a including exhibits to this Agreement. Consultant's Project Manager shall attend and assist in all coordination meetings called by City. c 6.4. Notices. Any notices, documents, correspondence or other communications concerning this Agreement or the work hereunder may be provided by personal delivery, (n facsimile or mail and shall be addressed as set forth below. Attorneys' Fees. In the event that litigation is brought by any party in connection with this Agreement, the prevailing party shall be entitled to recover from the L opposing party all costs and expenses, including reasonable attorneys' fees, incurred by the Q prevailing party in the exercise of any of its rights or remedies hereunder or the enforcement Q of any of the terms, conditions, or provisions hereof. The costs, salary and expenses of the City Attorney and members of his office in enforcing this contract on behalf of the City shall w be considered as "attorneys' fees"for the purposes of this paragraph. r a� 6.6. Governing Law. This Agreement shall be governed by and construed under E the laws of the State of California without giving effect to that body of laws pertaining to conflict of laws. In the event of any legal action to enforce or interpret this Agreement, the a parties hereto agree that the sole and exclusive venue shall be the Superior Court for the State of California located in San Bernardino County, California. Assignment. Consultant shall not voluntarily or by operation of law assign, , transfer, sublet or encumber all or any part of Consultant's interest in this Agreement without City's prior written consent. Any attempted assignment, transfer, subletting or encumbrance shall be void and shall constitute a breach of this Agreement and cause for termination of this Agreement. Regardless of City's consent, no subletting or assignment shall release Q Consultant of Consultant's obligation to perform all other obligations to be performed by Consultant hereunder for the term of this Agreement. a w 0 6.8 Indemnification and Hold Harmless. The proposed improvement of widening of Fortieth Street to four lanes in this reach will complete the F_ last link to arterial standards from Kendall Avenue to Valencia Avenue. Applicable City Standard for this project, that of a major highway, indicates a right-of-way of 100 feet with 72 feet curb-to- 0 curb.It has,however,been indicated that the City is willing to narrow the widening if it can be done without compromising pedestrian and vehicle safety to reduce right-of-way take requirements.No 0 bike lanes are proposed,however. a. , Expansion of the roadway to four lanes in this stretch will require widening of the pavement, of (D course, construction of curb and gutter, significant modifications or removal of some property- owner-constructed facilities, possibly including structure(s), replacement of driveway approaches and portions of driveways at some locations, and relocation of utility facilities. Particular utility Cn impact will be on the north side of Fortieth Street,just to the west of Electric Avenue in which there LO are observed to be significant overhead utility lines as well as underground facilities. v Homeowner/property owner facilities in this area are very close to the existing pavement including fencing, significant trees, and structures. However, a narrower width of right-of-way take could o obviate some of the impact. In any case, significant coordination and communication with the o property owners and residents will be valuable. a r Additionally, due to the significant facilities involved and utility relocations,phasing of the project o may be required to allow for initial demolition and relocation before initiating actual widening in c construction. U The second significant aspect of the project is the reconfiguring and signal modifications for the intersection of Fortieth Street at Electric Avenue. Stated objective is to provide four through-lanes E at Fortieth Street and left-turn pockets on all four legs at the intersection.Existing signals will need to be relocated/replaced.Construction is to include interconnection and remote access capability,and a accommodation made of other existing facilities such as the existing catch basin at the northeast corner, a hydrant at the northwest corner, and curb ramp on the southeast. Several are already in place in the improved reaches, but two are mounted on SCE power poles. Coordination with SCE is required to verify feed point/location for signals and streetlights. a� Required scope addition, by addendum, is an evaluation of the existing pavement and a proposed repair/rehabilitation strategies. a� w Existing Conditions o a� Fortieth Street from Johnson Street to Electric Avenue is of variable width improved to X36 feet, Cn Lorraine Drive to the west end of the church parcel and from Newmark to Johnson Street.No such o improvements exist on the south side,however. C 0 The City right-of-way for Fortieth Street in this reach is also variable, constrained to 20 feet each side of centerline from Electric Avenue westerly to Newmark and 40 to 50 feet each side from Newmark to Johnson Street. Obviously,placement of the City's major highway section throughout would require extensive right-of-way acquisition and,therefore, significant impacts upon property co owner improvements or culture. 0 d' Summarizing existing and possible future right-of-way is that shown on Figure 1 on the following c 12 page. Evident are the existing right-of-way incursions into current or desired street improvement a� prizm. o L a. Underground and overhead utility lines are parallel with and in close proximity to the north edge of c paving just west of Electric Avenue. There are also several instances of overhead utility crossings of Fortieth Street. Relocation of the facilities will be required in some manner to accommodate the proposed widening. L Drainage pattern at the project site is from west to east,congregating at the intersection with Electric co Drive.Additional runoff reaching the intersection,from the north,is captured by the two catch basins V- on or near the northeast corner.Perhaps much of the drainage reaching the street from the west flows southerly on Electric Avenue. The two catch basins on the northeast corner appear likely to deliver y to a storm drain easterly in Fortieth Street. 0 a 0 L a. Other utilities noted in the street include sewer as well as water pipelines which will be little N impacted aside from grade adjustments of manhole and valve covers.However,hydrants in several instances would need to be relocated and water service/meters and other utility boxes are also likely N to require relocation. o U It is further observed that all hard-wire-type utilities are underground east of Electric Avenue,which would be possibly be an objective to the west for this project, also. Curb returns and handicap ramps will be installed at Newmark Avenue, Severance Avenue,and Lorraine Drive and also on Electric Avenue on the street corners where they don't exist currently. An ,o upgraded bus stop would be constructed on the south side with ADA access and bus pad in accordance with Omnitrans Standards. Contractor will be required to maintain a safe stop zone for o passenger drop-off and pick-up throughout construction of the upgrade. °' rn c Eleven-foot median centerline, located at street centerline at Newmark will transition to 5.5 feet north of street centerline at Electric Avenue to provide more widening room to the south. Striping design/modifications will extend to Mountain View Avenue. 4) L It is noted that even with the minimal street width developed for this preliminary concept,it may be In necessary to acquire one or more residential structures on the north side just to the west of Electric 00 Avenue. 7i 0 Electric Avenue intersection will need to be reworked,taking out the existing westbound right-turn o lane,removing the island,and making signal modifications and striping,including the maintenance a. of left turn lanes at all four legs and ADA curb ramps at three corners where none exist. c Also likely to be included in this area are new catch basins just to the west of Electric Avenue on N both north and south sides to intercept drainage from the west.Installation/replacement of streetlights �c is also required in this reach. r Utility Relocations Field review indicates conflicts with two types of utilities,overhead and buried Bard-wire systems, Q that is, electric, telephone, cable, and water facilities. Hard-wire facilities exist on the north side adjacent to the pavement approximately 250 feet underground from Electric Avenue westerly and E then overhead. These facilities will need to be relocated for the proposed widening. Also,hydrant a 4 Packet Pg.340 i relocations will be necessary in at least two locations,on the northeast corner of Electric Avenue and Fortieth Street, and on the southeast corner of Fortieth Street and Severance Avenue. d c Also included in the project is rehabilitation of the pavement.Well worn,it is particularly distressed Q at the intersection of Fortieth Street and Electric Avenue. Proposed treatment method will be determined by the geotechnical subconsultant,with removal and replacement likely in areas followed by an overlay,with slurry seal a possibility in the less worn reaches. W 0 Services and Expertise Required L Completion of project documents to facilitate bidding and construction of the widening of Fortieth o Street will require the following disciplines and expertise: 0 n ► Field survey, aerial photography, and mapping. The foregoing is a synopsis of the anticipated services to be required for the project as a minimum. _ C. SCOPE OF SER VICES d Survey, engineering, and environmental services to be conducted to complete the design of the Cn project will include as a minimum the following tasks: 0 Ir- 00 1. Initial effort will be the scheduling and conduct of the kick-off meeting with City staff. Agenda will include introduction of team members, and with other affected 0 agencies-utility companies/City departments and Omnitrans,other affected agency 0 representatives.Review will be made of project features and City objectives,review a of proposed tasks and schedule,utility impacts, and perhaps a site visit. A detailed and thorough review is also proposed of the conceptual preliminary plan contained o herein with a larger scale version.This hopefully will largely define the project to be w designed. 0 Minutes of this and all subsequent scheduled meetings will be prepared specifying d subjects addressed, decisions made, and action items/responsibility. E U RS Project Manager will consult with the City on a monthly frequency, and likely more Q often,to maintain communication and coordinate inquiries,submittals,and meetings. d E 2. Obtain available record drawings from the City for all facilities. r d 5 Packet Pg.341 3. Conduct topographic survey and mapping by aerial and field crews. Survey effort will involve research of available survey records to establish control required,will involve cross-sectioning at 25-foot intervals to 60 feet from centerline for unimproved areas, extended to the east and west of the project limits, profiling of driveways, and additional survey at areas for which aerial photography will not be sufficient; for example,where the ground is not visible or items too small to detect w such as utility boxes and water meters. With this information, base sheets will be o prepared at a scale of 1" = 20' to provide better clarity for the congested areas of street widening and necessary for the Fortieth Street and Electric Avenue intersection reconfiguration and traffic signal design. Separate signal/intersection base sheet will r_ be prepared, also at a scale of 1" = 20'. Base sheets of the street plans will then be used for streetlight design. 4. Prepare a first notification letter to the utility companies for City's signature and o mailing to obtain available record drawings. Once information is received,it will be d added to the base plans. U) 5. Subsequently, as found necessary, underground utilities found to be possibly CD conflicting will be potholed and located by the survey crew. We have estimated that o up to five may be required, likely in and just west of the Fortieth Street/Electric Avenue intersection. 0- 'o a 6. Prepare a master right-of-way map of the project area for identifying areas of right- of-way acquisition that may be required. 7. Update and refine the conceptual preliminary street widening design and plan of proposed improvements,contained inthis proposal,sufficientto identify impact upon ; adjacent private properties and the intersection.Conceptual plan will be useful as the N project definition required by our environmental consultant, that is, the Area of V_ Potential Effect. 8. Prepare and complete all required environmental studies and environmental a documents required for clearance under the California Environmental Quality Act 0 CL (CEQA). As set forth in the City's RFP, it is anticipated that the environmental y document will be no higher than a Mitigated Negative Declaration. Efforts will include project set-up or preparation including obtaining a No-Fee Permit from the City,field reconnaissance, and notification of Dig-Alert. _ This will be followed by a field investigation and exploration borings to 20 feet to a ascertain asphalt thickness and aggregate base,if any,obtain subsurface information, and undisturbed samples.Final phase will be laboratory testing of materials,followed by engineering analysis and report preparation,presenting recommended pavement w structural section, and subgrade preparation. Also to be provided by Converse will o be evaluation of the existing pavement and repair/rehabilitation methods and traffic signal poles foundation, and trench excavation and backfill recommendations. Converse proposal is provided at Appendix D. o 10. Prepare preliminary and then final hydrology and hydraulic calculations and report for means of managing storm water runoff from the site. Beginning with extensive efforts in front of the Riverside Superior Court, Mr.Dodson provided expert witness testimony and guidance to the court for land use development within the City of Indian Wells. Mr.Dodson was qualified as a"land use o expert"with the Fourth District Court of Appeals. For more than one year,Mr.Dodson was successful in �+ serving as the land use expert for development within the City of Indian Wells. Based on our U discussions, the City has concluded that an environmental determination o needs to be prepared in order to comply with CEQA for this project. To a` rn complete the environmental document and determination for this project in a timely manner, TDA proposes to implement the following scope of work. i I. SCOPE OF WORK co Task 1: Prepare the Project Description co Immediately upon delivery of the 30% design plans, TDA will confer with 7T- ERSC and City Staff to review all of the information developed to date. Once N a good understanding the project exists, TDA will prepare a project c description, focusing on the project's construction, design and operation. a` M TDA will prepare the project description with sufficient detail that it can be y used to identify all physical changes to the environment that can result from Y implementing the proposed project. This is a critical step in the process of N preparing a CEQA document because it establishes the framework for o forecasting the potential adverse environmental impacts that can result from U T implementing the project. The project description will identify all proposed } construction activities and future operational characteristics of the project E that will be implemented. Based on review of the information provided to n date, I expect that the project should be considered for Mitigated Negative o Declaration (MND) as the appropriate CEQA environmental determination. I believe that the project needs to be evaluated for air quality/greenhouse gases, noise (shift in noise closer to sensitive receptors) and possible o historical resource values if any structures must be acquired and demolished. TDA will confer with the City to determine whether a traffic study or memo will be needed for this project. Because this is a street Cn expansion to be consistent with the City's General Plan, we do not see it as generating substantial traffic. Thus, for the purposes of this proposal, I have not included a traffic study/memo fee. I will also oversee these technical studies. a� 0 Once the Initial Study (IS) document is completed, it will be possible to a` verify whether a MND is the appropriate environmental determination. As = noted above, for purposes of this proposal it is assumed that a MND will be the appropriate CEQA environmental determination. w TDA will finalize the IS for the project in a timely manner (discussed below) N and submit a draft document for review by the City and ERSC prior to distribution. TDA will utilize the data from the project description and the T- regional data base to finalize the IS that will describe all potential impacts from implementing the proposed project. The impact forecast will be site specific, fully substantiated and mitigation measures will be identified, as 0 CL appropriate, for the environmental issues. The completed draft IS/MND is a the deliverable for this project. The City, of course, makes the final determination regarding the content of the IS/MND for publication and distribution for review and comment. y 0 Task 3• Print and Distribute the IS/MND U • T W TDA will meet with the City to collect all comments on the draft IS/MND. These comments will be responded to and a proposed MND and substantiating IS for public distribution will be compiled and printed for distribution. TDA will supply the City with up to 30 copies of the document a (electronic) for distribution. I do not believe it will be necessary to distribute to the State Clearinghouse since there are no State responsible or trustee E agencies. If more copies are required, they will be delivered to the City o a Packet Pg. 375 a based on actual publication costs. At the end of this task, the proposed IS/MND will be distributed for 20-day public review and comment period. . > Task 4• Prepare Responses to Comments and the Final IS/MND w Following completion of the public review period (note that TDA will meet with the you or the City upon request to discuss any comment letter that arrives before the end of the review period), TDA will meet with the City and n applicant to review proposed responses to all comments received on the o document. Once general agreement on the content of responses is obtained, C they will be prepared and a draft set of responses to comments will be delivered to the City for final review and comment. We anticipate allocating E 20 hours of effort to this task, including one meeting with the City. The ,° responses to comments will be completed within two weeks of the close of the public comment period, barring the need to develop original data. If major new issues are raised that were previously not addressed in the IS/MND and that the City concludes must be addressed in the final package, TDA will perform additional analyses based on mutual agreement on the ° scope of work and a modified fee. a 'o The end product of this effort will be a final IS/MND decision-making a package available for adoption by the City. Copies of the final package will be provided to the City and copies will be provided to any party commenting on the proposed MND. TDA will assist with the distribution of these documents. These responses to comments will be prepared as a combined document be for distribution. II. SCHEDULE co TDA will meet the City's schedule assuming that it is realistic. The delivery i of the Initial Study to the City for internal review will require about 45-60 a days after the 30% engineering drawings are completed. TDA will need the 0 30% engineered plans for review. Following release of the document comes . the 20 day public review and two week turnaround on responses to comments. Assuming the 30% plans are available in October, this would place the approval of the project before the City decision-makers in late o December 2016 or early January 2017. This is my best guess regarding 9 schedule based on the information available at this time. d As a cautionary note, if other factors beyond TDA's control dictate delays in the schedule, TDA will make adjustments in accordance with directions from the City. The purpose of the borings will be to: • Measure existing asphalt concrete and aggregate base thickness (if any). • Obtain subsurface information at the site. • Obtain undisturbed and bulk samples of the various soil types for laboratory testing. We plan to drill 5 borings, between 5 and 20 feet below existing ground surface. The deeper borings will be placed near the proposed traffic signal and at the storm drain facility. Soils will be continuously logged and classified by the geologist/engineer in the field by visual c examination in accordance with the Unified Soil Classification System. c L Relatively undisturbed ring samples will be collected at 2 and 5 feet bgs and every 5 feet thereafter in the 20 feet deep boring. The relatively undisturbed rings samples will be a obtained using a Modified California Sampler (2.4 inches inside diameter and 3.0 inches N outside diameter) lined with thin-walled sample rings. The sampler will be driven into the o } bottom of the borehole with successive drops of a 140-pound hammer falling 30 inches. The number of successive drops of the driving weight ("blows") required for one foot of [ penetration will be shown on the boring summary sheet in the "blow/6-inch" column. The soil will be retained in brass rings (2.4 inches in diameter and one inch in height). The central portion of the sample will be retained and carefully sealed in waterproof plastic r containers for shipment to the laboratory.
