Alanis, Director Ryan Aschenbrenner, Acting Real Property Specialist > Subject: Plan No. 13102 -- Proposed Street Vacation of a Portion of Genevieve Street— Authorization to Proceed -� N O Recommendation 0 Staff recommends that the Mayor and City Council authorize city staff to proceed with A- the investigation of the request to vacate a portion of Genevieve Street for Plan No. CO 13102. w Background ID Streets And Highways Code, Section 8312, division 9, Part 3, gives a city legislative n body the power to vacate all or part of a street. A petition to vacate a portion of Genevieve Street was received on 12/1/2016. The owner of parcel abutting the proposed street vacation signed the petition requesting the o street be vacated by the City and submitted Plan No. 13102 which is attached (Attachment 1). 0 L 0 CL Discussion O If authorization is given to proceed, an investigation and analysis will begin and all City o departments, County Fire, utilities and affected property owners will be mailed a notice 0 CU of the proposal and provided an opportunity to comment on any conflicts and/or potential issues or concerns. All services, with the exception of fire, will be performed in > house. L VJ The petitioner has paid $1,000, which represents the first half of the non-refundable N street vacation processing fee. The second half will be due after the investigative 0 proceedings are completed and prior to presenting to the matter to the Mayor and City n Council. Costs incurred with this action will be offset by the non-refundable petitioner paid processing fee of $2,000. To date, Q $1,000 of this fee has been paid to the City. o 0 Conclusion Staff recommends that authorization to proceed with the investigation and analysis for > the proposed street vacation be granted for Plan No. 13102.
