SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Award of Contract Removal of Underground Fuel Storage Tanks at Fire Station #1 Plan--No. 9840. BACKGROUND: This project consists of removal of 2-10,000 gallon underground fuel storage tanks at Fire Station Number 1; all similar tanks must be removed before a December 22, 1998 deadline. A contract has been awarded for the construction of a new fueling station at the City yards which will serve the needs for the Fire Department. The tanks, pumps, and cover will be removed and the area restored with a paving section. Both CDBG funding ($35,000) and Risk Management funding ($70,000) have been allocated. Separate short form contracts have already been awarded for removal of tanks at Stations 5 & 6, as well as City Hall, with the total amount of the contracts at $28,000 to date. This leaves a balance of$77,000 for this project. Bids were received and opened at 2:00 pm on August 25, 1998. A total of 5 bids were received and ranged from $25,348 to $47,375. The low bid is 52% below the Engineer's Estimate of $53,000. Listed below are the estimated costs based on the low bid contract price: Contract $25,348 Engineering and Inspection $ 6,000 Subtotal $31,348 Contingencies (15%) $ 5,652 TOTAL PROJECT COST $37,000 FINANCIAL IMPACT: Total funding allocated in FY 1997-98 for the removal of underground storage tanks was $105,000 ($70,000 from the Liability Fund and $35,000 in CDBG funding.) $28,000 of the $105,000 in funding has already been committed for contracts relating to removal of tanks at Fire Stations #5, #6, and City Hall. This leaves a balance of$77,000 for this project, of which only $37,000 is required for completion. SAFETY-KLEEN (CA), INC. is the lowest responsible bidder for: 8 REMOVAL OF UNDERGROUND STORAGE TANKS AT FIRE STATION NO. 1 per Plan 9 No. 9840. A contract is awarded accordingly to said bidder in a total amount of$25,348 but 10 such award shall be effective only upon the contract being fully executed by both parties; all 11 12 other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to 13 execute said contract on behalf of the City; a copy of the contract is on file in the office of the • 14 City Clerk and incorporated herein by reference as fully as though set forth at length. 15 SECTION 2. This contract and any amendment or modifications thereto shall not take 16 effect or become operative until fully signed and executed by the parties and no party shall be 17 obligated hereunder until the time of such full execution. No oral agreements, amendments, 18 19 modifications or waivers are intended or authorized and shall not be implied from any act or 20 course of conduct of any party. 21 SECTION 3.
