Municipal Code Section 14.08.240 and 14.08.250 Date: November 18, 1996 OnIGINAL Synopsis of Previous Council action: Resolution No. 96-363, "Resolution of the City of San Bernardino Stating the City's Intention to Renew the Grant of a Non-Exclusive Cable Franchise to TCI Cablevision of California, Inc." The Mayor and Common Counsel stated their intention to renew the cable franchise granted to TCI Cablevision of California, Inc, subject to the terms and conditions of The Cable Franchise Agreement between the City of San Bernardino and TCI Cablevision of California, Inc, Resolution No. 96-363 and Chapter 14.08 of the San Bernardino Municipal Code. Recommended motion: Staff recommends that the renewal of franchise be granted upon the terms and conditions as specified in the resolution of intention, Resolution No. 96-363. Aldstadt, Deputy City Attorney DATE: December 12, 1996 AGENDA ITEM: TCI Cablevision of California, Inc. is the current holder of a cable franchise within the City of San Bernardino. TCI has approximately 200 cable subscribers in the City of San Bernardino. The City and TCI Cablevision have been negotiating the renewal of TCI's cable franchise and have mutually agreed upon the terms of the renewal. In order to fulfill the requirements of San Bernardino Municipal Code Section 14.08.240, the Council was required to pass a resolution of intention to renew the grant of the franchise, which it did on December 2, 1996(Resolution No. 96-363). The resolution is required to state the proposed terms and conditions of the renewal and to set a time for public hearing,where "any persons having any interest therein or objection to the granting thereof may . . . appear before the Council and be heard . . . ." The resolution of intention set a time and place for public hearing for December 16, 1996 at 10:00 a.m. The clerk's office was also directed to place a notice of public hearing and that notice was published on December 10, 1996. Staff recommends that the Mayor open the public hearing and take all comments from those having any interest to the renewal or objecting to the renewal. After which, the Council will make the following determination: That the renewal of franchise be granted upon the terms and conditions as specified in the resolution of intention.
