Description) Finance: Council Notes: Agenda Item No. �� CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT BACKGROUND Rental Housing staff inspected the property on March 28, 1996 and issued a Notice and Order to the owner of record, Mr. T.J. Haga, on April 8, 1996 for numerous violations of the San Bernardino Municipal Code. A Notice of Pendency (NOP) was prepared the same day and eventually filed with the County Recorder on April 17, 1996. Concurrently to this action, and unbeknownst to the inspector, the property was being purchased through a tax sale and being transfered to a new owner, the appellant Mr. Muhammad Yunis. The appellant purchased the property from the County Tax Collector at public auction on March 5, 1996, but the Tax Deed was not recorded until April 9, 1996. Because of this delay in recording, the ownership information that staff received from the title company did not indicate the change of ownership. This matter was later set for hearing before the Board of Building Commissioners due to noncompliance. Again, the appellant was not notified of this action due to the inaccurate title report. The Board issued Order No. 3755 (Attachment B) and confirmed the costs incurred by the City (Attachment D). The appellant has since obtained a building permit to rehabilitate the structure and has commenced work. APPELLANT'S STATED GROUNDS OF APPEAL That the new owner was not provided legal notice of the abatement proceedings. ACTIONS SOUGHT BY APPELLANT FROM THE MAYOR AND COMMON COUNCIL 1. Revocation of BBC Order No. 3755 and the waiver of the incurred costs ($493.97) relative to BBC Order No. 3755. 2. Waive any liens and cancel any orders by the City of San Bernardino prior to the appellant's ownership. ANALYSIS The Notice of Pendency relating to the abatement action resulting in BBC Order No. 3755 was filed after the transfer of the property and recordation of the tax deed. The appellant was not legally served with notice of the abatement action. Therefore, due process of law has not been provided and the Order is legally defective. Further, the appellant asks that all prior liens and orders by the City be cancelled. Prior to the most recent action, the Code Enforcement Division had undertaken several abatements dating back to 1992. The appellant has not submitted any evidence questioning the validity of the prior orders, and therefore they should stand until all violations noted therein are cleared. The City Clerk's records indicate that 3 prior liens were paid off on April 17, 1996 (Attachments E, F, and G). The Clerk's records also indicate that $909.65 are still owed to the City for interest on the prior liens and for one unrecorded lien. Accrued interest is charged on liens in accordance SBMC 3.68.010. The costs are broken down as follows: $335.79 Interest - Doc. No. 92-363493 238.32 Interest - Doc. Your appeal must be submitted in writing to the City Clerk within 15 days of the Board's ruling. A fee of$75.00 must accompany your appeal. Your written appeal must include the case number, property location, the specific items appealed and grounds therefore, and the relief or action sought from the Mayor and Common Council. On July 9, 1996 the property owner of record was notified that violations of the San Bernardino Municipal Code exists on the property. The owner was requested to correct the violations within a specified time period. On August 15, 1996 a subsequent inspection revealed that the requested corrections were not completed. The outstanding violations include the following: OUTSTANDING VIOLATIONS 1. Lack of Required Landscaping and Unmaintained Landscaping. Landscape the front and side yards with shrubs, groundcover, decorative rock, redwood bark, and/or lawn. Maintain the landscaping by including a regular irrigation plan. Plant lawns on all barren dirt areas in front, rear, and side yard areas. (SBMC 15.24.040 Al & A2). 2. Weeds and Overgrown Vegetation. Maintain the landscaping with weed removal from the planters, perimeter and cross fencing, and yard areas. Mow and edge the lawn on a regular schedule. Prune all trees and shrubs in an orderly fashion. (SBMC 15.24.040 A3). 3. Accumulation of Trash and Debris in Yards. Remove the abnormal amount of trash and debris that has collected on the premises. (SBMC 15.24.040 A4). 4.* Dangerous Building-Attractive Nuisance. Abandoned and/or unsecured structure which constitutes an attractive nuisance to children, or a harbor for vagrants or criminal activity. The building must be secured. On a temporary basis, the building may be boarded to FHA standards. The owner must obtain all necessary permits and rehabilitate the structure, or demolish the same within 30 days. Failure to rehabilitate or demolish within 30 days may result in action by the City to abate the abandoned building as a public nuisance. (SBMC 15.28.010, UCADB 302.12 and 302.18). This structure has been boarded up for over 180 days. "Immediately" obtain all necessary permits for the rehabilitation of the structure and correct all violations prior to reoccupancy, but no later than 30 days, or obtain permits and demolish the structure within 30 days.
