Synopsis of Previous Commission/Council /Committee Action(s):
On March 18, 1997, the Community Development Commission adopted Resolution No.
5507 titled: "Resolution .... Amending Resolution No. 4220 (As Amended by Resolution
Nos. 4852, 5048, 5057, 5356, 5389 and 5424) Entitled, in part, `Resolution ... Adopting a
Conflict of Interest Code ...', by amending Appendix A to add, delete and change the titles
of various positions within the Economic Development Agency of the City of San
Bernardino which must file Conflict of Interest Statements"

STAFF REPORT
On September 29, 1998, the City Clerk sent notice to the Community Development Commission
that the Economic Development Agency's Conflict of Interest Code would need to be amended
and that such amendments must be submitted to the Commission by December 28, 1998.
We submitted the proposed changes noting title changes and positions that have been added or
deleted as a result of the Agency's recent reorganization. These changes have been reviewed by
Sr. Assistant City Attorney Huston Carlyle and City Clerk Rachel G. Clark and they have prepared
the necessary amendments as reflected in Appendix A of the attached Resolution.

THE COMMUNITY DEVELOPMENT COMMISSION ACTING ON BEHALF OF
8 THE ECONOMIC DEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO
DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:

10 SECTION 1. Appendix A of Community Development
11 Commission Resolution No. 4420, as amended by Resolution Nos.
12 4852, 5048, 5057, 5356, 5389, 5424 and 5507, is further amended
13 by deleting therefrom Appendix A and by substituting therefor
14 a revised Appendix A as attached hereto and incorporated herein
15 by reference.
16 SECTION 2. The findings and determinations herein
17 shall be final and conclusive. This resolution shall take
18 effect upon the date of its adoption.

Consultants
Consultants to the Economic Development Agency are included in
the list of designated employees and shall disclose pursuant to
the broadest disclosure category in the code subject to the
following limitation:
The Chairman of the Commission may determine in writing
that a particular consultant, although a "designated
position ", is hired to perform a range of duties that are
limited in scope and thus is not required to fully comply
with the disclosure requirements described in this
section. Such written determination shall include a
description of the consultant's duties and, based upon
that description, a statement of the extent of disclosure
requirements. The Chairman's determination is a public
record and shall be retained for public inspection in the
same manner and location as this Conflict of Interest
Code.
