This firm had access to equipment that the City did not have, had equipment that could be used in emergency situations and had staff trained in confined space entry. These services were used to supplement the City sewer forces and to complete necessary repairs in a timely manner. The overall impact was to reduce the number of claims against the City and improve the condition and operations of the City sewer system. The agreement has provisions for two one -year extensions upon mutual consent of the parties; the first extension was granted in July of 1997. We have received notification from the provider that they are willing to extend for a second year at the rates fixed in the 1996 agreement. Staff has met with other providers of this service and, after checking on prices, has been unable to find any provider willing to meet or beat the price we presently pay. In view of this, staff of both the Public Services Department and Development Services Department agrees that an extension of this contract is both desirable and prudent. Financial Impact: Funding for this contract extension is contained in the adopted budget under account 132 - 432 -5504 -7128 in an amount of $150,000.00. RESOLLTTION OF THE CITY OF SAN. BERNARDINO PROVIDING AUTHORIZATION TO EXECUTE SECOND AMENDMENT TO THE AGREEMENT FOR PROFESSIONAL SERVICES WITH NATIONAL PLANT SERVICES, INC. FOR SEWER CLEANING AND MAINTENANCE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERiNARDINO AS FOLLOWS: SECTION 1. THAT THE MAYOR is authorized to execute the second amendment to the professional services agreement with National Plant Services, Inc. for sewer cleaning and maintenance services. A contract amendment is entered into with said firm for the total amount not to exceed $150,000.00 but such amendment shall be effective only upon being fully executed by both parties. The Mayor is hereby authorized and directed to execute said contract amendment on behalf of the City; a copy of the contract amendment attached as Exhibit A and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no parry shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. RECITALS WHEREAS, the parties hereto entered into that certain Agreement dated July 1, 1996, relating to the provision of sewer maintenance services throughout the City; and WHEREAS, the Agreement provides that the term may be extended for two one -year extensions by mutual consent; and WHEREAS, the First Amendment was approved August 4, 1997, and WHEREAS, the parties desire now to amend said Agreement to extend the term of the Agreement for a period of one year, from December 7, 1998 to December 7, 1999. NOW. THEREFORE, the parties agree as follows: A. The Contract shall be extended for one year from December 7, 1998 to December 7, 1999, at no increase in the unit prices, and subject not to exceed amount of $150.000. B. Except as amended by the First and Second Amendments to Agreement and as amended herein, all other terms, specifications and conditions of the original agreement shall remain unchanged and in full force and effect.
