STAFF REPORT
SUBJECT:
Award Contract to Malton Construction for construction of handicapped access ramps citywide
per Plan No. 9863.
BACKGROUND:
The City has planned to install as many handicapped access ramps as funding allows in each
year. Accordingly, in the current budget the City has allocated $100,000 from Gas Tax and 1/2-
Cent Sales Tax funds, as well as CDBG funds, to construct disabled access ramps citywide. The
locations are in accordance with the adopted transition plan, that is, they serve public buildings,
places of public accommodation, and requests from the public in a specific order. Two
additional contracts have already been awarded using CDBG funding sources.
Bids for the construction were received and opened at 2:00 p.m. on Tuesday, November 3,
1998. There were a total of 6 bids ranging from $50,100 to $96,543. The low bid was 40
percent below the Engineer's Estimate of $82,550; however, the low bidder has submitted a
letter to the City saying he made a clerical error in the bid and that he is not able to enter into
a contract with the City. The second low bid is $73,550 and it is 11 percent below the
Engineer's Estimate. It represents a fair and reasonable bid and the contractor has worked for
the City on disabled ramps in one of the recent contracts.
Listed below is the estimated project cost based on the low bid for construction:
Construction Contract $73,550
Engineering and Inspection $6,200
Subtotal $79,750
Contingencies (15 %) $11,950
TOTAL $91,700
FINANCIAL IMPACT:
Funding for the project is contained in Account Nos. 126 - 369 -5504 ($50,000) and 129- 367 -5504-
7122 ($50,000).
RECOMMENDATION:
Approve Resolution awarding a contract to Malton Construction for construction of handicapped
access ramps citywide per Plan No. 9863.

RESOLUTION OF THE CITY OF SAM BERiNARDINO AWARDING A
CONTRACT TO MALTON CONSTRUCTION FOR CONSTRUCTION OF
HANDICAPPED ACCESS RAMPS - CITYWIDE - PER PLAIN NO. 9863.
BE IT RESOLVED BY THE NIAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. MALTON CONSTRUCTION is the lowest responsible bidder for
CONSTRUCTION OF HANDICAPPED ACCESS RAMPS - CITYWIDE - PER PLAN
NO.9863. A contract is awarded accordingly to said bidder in a total amount of $73,»0.00
but such award shall be effective only upon being fully executed by both parties. All other
bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute
said contract on behalf of the City; a copy of the contract is on file in the office of the City
Clerk and incorporated herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or j
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of the passage of the resolution.
