Resolution of the Mayor and Common Council of the City of San Bernardino Authorizing
the Execution of Amendment Number Four to the Consultant Services Agreement with
Willdan Engineering for Plan Review, Inspection, Stormwater Management, Fire and
Life Safety Plan Review, Building Official, and Counter Services. (#4533)

Financial Impact:
The Department is requesting to increase the contract with Willdan Engineering by
$130,000.00
The Department would like to increase the contract using the following accounts: 772-
2306-192, 772-2306-193, and 001-180-5502. There are sufficient funds between these
accounts in the budget, no additional funds are being requested.
Motion: Adopt the Resolution.
Synopsis of Previous Council Action
September 2, 2014 Council adopted Resolution 2014-327 approving a
Consultant Services Agreement with Willdan Engineering
and CSG Consultants for Plan Review, Inspection,
Stormwater Management, Fire and Life Safety Plan Review,
Building Official, and Counter Services.
October 20, 2014 Council adopted Resolution 2014-366 approving an
amended Consultant Services Agreement with Willdan
Engineering for Plan Review, Inspection, Stormwater
Management, Fire and Life Safety Plan Review, Building
Official, and Counter Services (Amendment No. 1).
February 17, 2015 Council adopted Resolution 2015-28 approving an amended
Consultant Services Agreement with Willdan Engineering for
unreinforced masonry (URM) and building inspections
1 (Amendment No. 2).
March 21, 2016 Council adopted Resolution 2016-51 approving an amended
Consultant Services Agreement with Willdan Engineering for
Plan Review, Inspection, Stormwater Management, Fire and
Life Safety Plan Review, Building Official, and Counter
Services (Amendment No. 3).

On September 2, 2014, the Mayor and Council approved Resolution 2014-327
authorizing the execution of an agreement and issuance of a Service Agreement to
provide Plan Review, Inspection, Stormwater Management, Fire and Life Safety Plan
Review, Building Official, and Counter Services for an amount not to exceed $355,000.
Building plan review is processed entirely through Willdan Engineering. Over the past
several months the Department has had to rely more heavily on Willdan Engineering for
staffing services due to employee turnover, a lengthy recruiting process, and an
increase in development activity.
The recently adopted fiscal year 2016/2017 budget approved an additional
Development Services Technician. The added position will reduce Willdan contracting
cost for fiscal year 2016/2017.

SECTION 1. The City Manager is hereby authorized to execute Amendment Number �n

Four to the Agreement with Willdan Engineering, attached hereto as Exhibit "A" and

SECTION 2. The Director of Finance, or designee, is hereby authorized to

increase Purchase Order No. 2016-00000711 by the amount of$130,000.

SECTION 3. The authorization to execute the above-referenced agreement is 0

rescinded if the agreement is not executed and returned to the Office of the City Clerk within a

16 sixty(60) days following the effective date of this Resolution.

AMENDMENT NUMBER FOUR TO CONSULTANT SERVICES AGREEMENT WITH
WILLDAN ENGINEERING
THIS AMENDMENT NUMBER FOUR TO CONSULTANT SERVICES AGREEMENT
WITH WILLDAN ENGINEERING("Amendment")is made between Willdan Engineering
("Company")and the City of San Bernardino(The"City")on July 18,2016.
WHEREAS,the parties wish to amend the Consultant Services Agreement that was entered into
on October 20,2014("Agreement")to increase the total amount to cover the services requested for
Community Development Services;
NOW THEREFORE, in consideration of the foregoing and for other good and valuable
consideration the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as
follows:

1. This Amendment is made with respect to the following facts and purposes: o

a. On October 20,2014 the City and Company entered into an amended agreement C
