Conference with legal counsel - anticipated litigation - initiation of litigation - pursuant to Government Code Section 54956.9(d)(4). D. Closed Session - personnel - pursuant to Government Code Section 54957(b). E. Closed session with Chief of Police on matters posing a threat to the security of public buildings or threat to the public's right of access to public services or public facilities - pursuant to Government Code Section 54957(a). F. Conference with labor negotiator - pursuant to Government Code Section 54957.6. G. Conference with real property negotiator - pursuant to Government Code Section 54956.8. Pledge of Allegiance The Pledge of Allegiance was led by Council Member Valdivia. 2. Staff Reports 2A. City Attorney Authorize the City Manager, as Successor Agency Executive Director, to Execute an Amendment to Lease of Real Property Located at 296 E. 3 d Street from the City of San Bernardino to the United States of America, To: (1) Extend Term of Lease through May 14, 2052 and (2) Substitute the California Army National Guard for the United States of America as Lessee. Public Comments: Scott Olson, San Bernardino Motion: Authorize the City Manager to execute, on behalf of the City and on behalf of the Successor Agency, if necessary, a further version of the lease amendment provided that there have been no material changes that would affect the interest of the City or the Successor Agency based on advice of counsel to the City Manager. City Manager RES. 2016-128 — Resolution of the Mayor and Common Council of the City of San Bernardino Approving and Adopting the City of San Bernardino's Final Budget for Fiscal Year 2016-17 and Establishing the City's Appropriation Limit as Required by Article XIII B of the California State Constitution (Continued from June 20, 2016). Public Comments: Scott Olson, San Bernardino Robert Porter, San Bernardino Jim Smith, San Bernardino Motion: Adopt the Resolution. RESULT: ADOPTED [UNANIMOUS] MOVER: John Valdivia, Council Member, Ward 3 SECONDER: James Mulvihill, Council Member, Ward 7 AYES: Marquez, Barrios, Valdivia, Shorett, Nickel, Richard, Mulvihill 3. Public Comments for Items not on Agenda Scott Olson, San Bernardino, spoke about the funds given for Charter education. He said the Charter would sell itself. He spoke about the fire department, charges for service, and PERS rates. Robert Porter, San Bernardino, spoke against the use of $150,000 for Charter education and said it could be better spent. Darren Espiritu, San Bernardino, said he supported the Quality of Life clean up and said he was proud of the collaboration between the departments and announced a July 9 Perris Hill Park clean up. 4.
