Synopsis of Previous Council Action: None Background: The City of San Bernardino Municipal Water Department (Department) was contacted by Shartsis Friese LLP on behalf of their client 5959 Palm Avenue Investors LLC, a Delaware Limited Liability Company (Developer). The Developer requested that all Grantor's reserved easement rights in that certain deed from the Muscoy Water Company to Inland Properties, Inc. be released. The easement that was reserved for Muscoy Water Company and recorded on July 21, 1948 in Book 2265; page 120 Official Records of San Bernardino County (see attached Exhibit B) was provided to the Department for review. The easement is located on two parcels identified as APN's 0266-041-82 and 0266-041-83, near the northeast corner of Palm Avenue and Industrial Parkway. The Department previously received all rights to Muscoy Water Company through acquisition of the San Bernardino Water Utilities Corporation. The Department, acting by and through the Board of Water Commissioners, acquired the San Bernardino Water Utilities Corporation through a Final Order of Condemnation Case No. 214933 on December 1982. The Department currently owns and operates water pipelines in both Palm Avenue and Industrial Parkway with frontage along the referenced parcels; therefore the easement is no longer required. The Developer has provided staff with an executed easement document for acceptance and recordation once this item is approved. The attached resolution authorizes the Mayor to execute the quitclaim to the Developer. The developer will be responsible to pay for all recording fees, if any. Guerrero SUBJECT: APPROVAL TO QUITCLAIM AN EXISTING EASEMENT LOCATED NORTHWEST OF THE CORNER OF PALM AVENUE AND INDUS- TRIAL PARKWAY DATE: February 4,2016 COPIES: Greg Gage (w/o attach),Sydney Morrison (w/attach), Sally Duran (w/attach) BACKGROUND: The San Bernardino Municipal Water Department (Department) was contacted by Shartsis Friese LLP on behalf of their client 5959 Palm Avenue Investors LLC, a Delaware Limited Liability Company (Developer). The Developer requested that all Grantor's reserved easement rights in that certain deed from the Muscoy Water Company to Inland Properties, Inc. be released. The easement that was reserved for Muscoy Water Company and recorded on July 21, 1948 in Book 2265; page 120 Official Records of San Bernardino County (see attached Exhibit B) was provided to the Department for review. The easement is located on two (2) parcels identified as APN's 0266-041-82 and 0266-041-083,near the northeast corner of Palm Avenue and Industrial Parkway. The Department previously received all rights to Muscoy Water Company through acquisition of the San Bernardino Water Utilities Corporation. The Department, acting by and through the Board of Water Commissioners, acquired the San Bernardino Water Utilities Corporation through a Final Order of Condemnation Case No. 214933 on December 1982. The Department currently owns and operates water pipelines in both Palm Avenue and Industrial Parkway with frontage along the referenced parcels;therefore the easement is no longer required. Engineering staff has reviewed the Quitclaim Deed document submitted and found it to be acceptable for recordation. If the Developer's request to quitclaim the easement is approved by the Board of Water Commissioners, the Department will submit the quitclaim document to the Development Services Department for consideration by the Mayor and Common Council.
