The Mayor and Common Council and Community Development Commission will recess to closed session for the following: a. to meet with its designated representatives regarding labor relations matters pursuant to Government Code Section 54957 . 6; b. to confer with the attorney regarding pending litigation pursuant to Government Code Section 54956. 9 (b) (1) , as there is significant exposure to litigation; C. based on existing facts and circumstances, set out below, the City Council is meeting only to decide whether a closed session is authorized pursuant to California Government Code Section 54956. 9 (b) (2) ; d. to confer with the attorney, regarding pending litigation pursuant to Government Code Section 54956. 9 (c) , so that Council/Commission may decide whether to initiate litigation; e. to consider personnel matters pursuant to Government Code Section 54957; f. to confer with the Chief of Police on matters posing a threat to the security of public buildings or a threat to the public' s right of access to public services or public facilities pursuant to Government Code Section 54957 ; 1 2/21/94 g. to give instruction to the City ' s/Commission' s negotiator on the purchase of property pursuant to Government Code Section 54956 . 8 . (Usually, any items received under this heading are referred to staff for further study, research, completion and/or future Council action. ) CONSENT CALENDAR MOTION: That the motions indicated by consent calendar items 5 through 20 be adopted, except for and 3 2/21/94 Q (Consent Calendar Continued) 5 . Waive further reading of resolutions and ordinances. MOTION: That further reading of all resolutions and ordinances on the regular, supplemental and Community Development Commission agendas, be waived. 6. Authorize acceptance of payment of insurance premium in lieu of rental fees for FDR Bowl by Junior University. (See Attached) MOTION: That the acceptance of payment of insurance premium by Junior University in lieu of rental fee for FDR Bowl, be authorized. 7 . Authorize acceptance of payment from City of Highland of a pro-rata share of Highland Little League' s lighting costs at Patton Park and the waiver of lighting costs through June 30, 1994 . (See Attached) Ward 7 MOTION: That the payment by the City of Highland of a pro- rata share of Highland Little League' s lighting costs at Patton Park be accepted, and that the remainder of fees be waived through June 30, 1994 . 8 . Approval of plans and authorization to advertise for bids-- installation of curbs and gutters on Waterman Avenue (East Side) from 6th Street to 9th Street. (See Attached) (Cost to City -- $180,000 from 1/2 Cent Sales Tax - Local Funds. ) Ward 2 MOTION: That the transfer of $40, 000, from Account No. #1 129-309-57737 , "Orange Show Road, from Arrowhead Avenue to Tippecanoe Avenue, " to Account No. 129- 309-57286, "Waterman Avenue, from 6th Street to 9th Street, " be approved; and MOTION: That the plans for installation of curbs and ` 12 gutters on Waterman Avenue (East Side) , from 6th Street to 9th Street, in accordance with Plan No. 9047 , be approved; and that the Director of Public Works/City Engineer be authorized to advertise for bids. 4 2/21/94 0 (Consent Calendar Continued) 9 . Claims and Payroll. (See Attached) NOTION: That the claims and payroll and authorization to issue warrants as listed on the memorandum dated February 14 , 1994 , from the Finance Director, be approved. 10. Personnel Actions. (See Attached) NOTION: That the personnel actions submitted by the Chief Examiner dated February 10, 1994 , in accordance with Civil Service Rules and Regulations and Personnel Policies adopted by the Mayor and Common Council, be approved and ratified. RESOLUTIONS NOTION: That said resolutions be adopted. City Clerk 11. Resolution of the City of San Bernardino amending Resolution 92-466 entitled in part "Resolution . . . amending Conflict of Interest Codes . . . " , by amending Appendices A and B to add, delete and change the titles of various positions within departments of the City which must file Conflict of Interest Statements. (See Attached) Finance 12 . Resolution of the Mayor and Common Council of the City of San Bernardino acknowledging the receipt and filing of the Annual Statement of Investment Policy for the Year 1994 . Resolution of the Mayor and Common Council of the City of San Bernardino approving the destruction of certain City records of the Parks, Recreation and Community Services Department. (See Attached) Personnel 14 . Authorize the selection of Personnel Concepts -- to conduct a Management/Confidential Compensation Study. (See Attached) (Cost to City -- $7,200 from General Fund. ) MOTIOM: Authorize the selection of Personnel Concepts for a Management/Confidential compensation study; and that said resolution be adopted. Resolution of the City of San Bernardino authorizing the execution of an agreement with Personnel Concepts for a Management/Confidential Compensation Study. Public Works/Engineering 15 . Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of an Indemnification and Hold Harmless Agreement with the Economic Development Administration, U.S. Department of Commerce, and Inland Valley Development Agency, relating to a grant for water, sewer and road realignment improvements. Resolution of the City of San Bernardino amending Resolution No. 655 entitled, in part, "A resolution . . . designating certain streets or portions thereof as through highways . . • " and authorizing the installation of a four-way stop at the intersection of Cajon Boulevard and Palm Avenue/Institution Road. (See Attached) (Cost to City-- $2,500 from General Fund. ) Ward 6 17 . Resolution of the City of San Bernardino amending Resolution No. 8234 entitled, in part, "A resolution . . . establishing parking time limitations upon certain designated streets or alleys, or portions thereof . ; " and authorizing the removal of the two-hour parking limitation on "F" Street, between Sixth Street and three hundred and twenty-five feet south of Sixth Street. Resolution of the City of San Bernardino amending Resolution No. 94-5 awarding a purchase order to Amrep Inc. for the furnishing and delivery of six (6) each, automated side loading refuse vehicle bodies, to be utilized by the Public Services Department in accordance with Bid Specification No. F-96-06 . Public hearing -- Quail Canyon Area Sewer Construction Assessment District No. 1011. MOTION: That the protests be overruled and the hearing be #1 closed, and find and determine that the public convenience and necessity require the proposed construction of a sewer main and appurtenant facilities in the Quail Canyon area. That the Special Assessment, Investigation and Limitation Act of 1931 shall not apply. (4/5ths vote required) and MOTION: That this item be continued to the Council #2 Meeting of March 7 , 1994 ; and that the Director of Public Works/City Engineer be directed to amend the Engineer ' s Report. (See Attached) MOTION: That the Mid Year Budget Report for FY 1993/94 , be received and filed. '3/7 25 . Request from County of San Bernardino Vector Control to increase City' s benefit assessment rate. (See Attached) MOTION: That the Mayor be authorized to issue letter to the County of San Bernardino Board of Supervisors approving the change in the City' s benefit assessment rate for single family dwellings from $1. 85 to $2 . 32 . 26. Adjournment. MOTION: That the meeting be adjourned to 6: 00 p.m. , Tuesday, February 22 , 1994 , for a joint meeting with the San Bernardino City Unified School District, Board of Education, to be held at the Board of Education Building, 777 North "F" Street, San Bernardino, California. 10 2/21/94 NOTICE: Any member of the public may address this meeting of the Mayor and Common Council on any item appearing on the agenda, by approaching the microphone in the Council Chambers when the item about which the member desires to speak is called, and by asking to be recognized. Any member of the public desiring to speak to the Mayor and Common Council concerning any matter not on the agenda but which is within the subject matter jurisdiction of the Mayor and Common Council, may address the body at the beginning of the meeting, during the period reserved for public comment, said total period for public comment shall not exceed forty- five (45) minutes, unless such time limit is extended by the Mayor and Common Council. A five minute limitation shall apply to each member of the public, unless such time limit is extended by the Mayor and Common Council. No member of the public shall be permitted to "share" his/her five minutes with any other member of the public. STORAGE SPACE LEASE - 201 NORTH "E" STREET (INLAND EMPIRE SYMPHONY) (Community Development Commission) MOTION: That the Community Development Commission authorize the Executive Director to draft and execute a lease and all other necessary documents with the Inland Empire Symphony for the utilization of approximately 3,600 square feet of the old "Thrifty Building" space, with said space to be utilized by the Symphony for storage purposes on the second,floor of the 201 building. 10. CENTRAL POLICE STATION CONSTRUCTION CONTRACTS/BIDDING (Community Development Commission MOTION: That the Community Development Commission authorize the execution of a Construction Management contract with Millie and Severson, Incorporated, for general contracting and construction management services in connection with the construction of the Central Police Station; further, that the Commission authorize advertisement for Trade Contractor bids for construction of the Station; further, that the Commission increase the Agency budget in an amount of$369,714 for construction management services; and, further, that the Commission direct staff to prepare financing documents for a Certificates of Participation issue to yield approximately $5,000,000 in construction funds, and a Tax Allocation Bond issue in an amount necessary to provide for completion of construction and furnishing of the Station.
