Synopsis of Previous Commission/Council/Committee Action(s):
On October 21, 1996,the Mayor and Common Council adopted the Community Development Citizen Advisory
Committee's recommendations for the reallocation of 1995/1996 fiscal year funds,which created new or added funding
to FY 1996/1997 projects,and authorized the Mayor to submit these projects as part of the amended Second Year
Action Plan Component of the Consolidated Plan to the U.S.Department of Housing and Urban Development.

First Amendments - FY96/97 CDBG Proiects 96-223
Background
The Mayor and Common Council authorized the funding of project 96-223 on October 21, 1997,
through the reallocation process for FYI 995/1996 funding. The project was put out to bid in
May 1998, but the acceptable bids were higher than the approved budget. The funding need is as
follows:

Recommendation
It is appropriate for the Mayor and Common Council to approve the first amendments to the
Agreement for the Children's Center of California State University, San Bernardino.

6 CHILDREN'S CENTER OF CALIFORNIA STATE UNIVERSITY,

8 Be it resolved by the Mayor and Common Council of the City of San Bernardino as follows:

10 SECTION 1
1 t (a) The Mayor of the City of San Bernardino is hereby authorized and directed to
12 execute, on behalf of the City, an amendment to the agreement for Community Development
13 Block Grant funding with the Children's Center of California State University, San Bernardino,
14
which amendment is attached hereto as Exhibit"I", and is incorporated herein by reference as
15 though fully set forth at length. The Amendment provides for the granting of additional
16 Community Development Block Grant funds in the amount of Sixteen Thousand Dollars
17
($16,000).

(a) The authorization to execute the above referenced amendment is rescinded if the
21
parties to the agreement shall fail to execute it within sixty(60) days of the passage of the
22
Resolution.

FIRST AMENDMENT TO THE
COMMUNITY DEVELOPMENT BLOCK GRANT AGREEMENT
CAPITAL IMPROVEMENTS/REHABILITATION
THIS FIRST AMENDMENT to Agreement 96-223 referred to as("Amendment"), is made and
entered into this 15`h day of June , 1998 by and between the City of San Bernardino, a municipal
corporation, referred to as("City"),and The Children's Center, California State University, San
Bernardino, a non-profit community service organization, referred to as("Subrecipient"). City
and Subrecipient agree as follows:
WITNESSETH
Community Development Block Grant
WHEREAS, City and Subrecipient have previously entered into agreement 96-223 dated
April 1, 1997, referred to as("Agreement");and
WHEREAS, City and Subrecipient desire to amend agreement to include the Playground
Renovation Project ;and
WHEREAS, City desires to increase the amount Community Development Block Grant
funding in the amount of Sixteen Thousand Dollars($16,000)to allow Subrecipient to complete
the project.
Now,therefore, in consideration of the mutual covenants herein set forth and the mutual
benefits to be derived therefrom,the parties agree to modify the original agreement as follows:
1. Change the first sentence in Section 2 Payments
City shall reimburse Subrecipient for allowable costs incurred under the scope of this
Amendment and applicable Federal regulations,which have not been paid for or reimbursement
will be made at least on a monthly basis, with the total of all such reimbursements not to exceed
$65,000.
