Description) Finance: Council Notes: Agenda Item No. AO CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Resolution of Intention---Vacation of a portion of Ennis Street between Amos Avenue and Lincoln Avenue. BACKGROUND: On 05-04-98, authorization was given to proceed with the proposed vacation and Plan No. 9791 was approved. All of the interested City Departments and Utility Companies were notified of the proposal 05-01-98, with a reply due by 05-21-98. The responses are attached for your information. A reservation of an easement for sanitary sewer and appurtenant facilities, an easement for water lines and appurtenant facilities and an easement for public utility purposes was requested, which will have to be reserved, as set forth in the attached Resolution of Intention. The Resolution of Intention, which sets a protest date of 07-20-98, has been attached hereto for your action also. Upon the approval of said Resolution, all adjacent property owners will be notified by mail of the hearing date. FINANCIAL IMPACT: None RECOMMENDATION: We recommend the resolution be approved. BERNARD CASTRO Real Property Specialist COPY 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS 3 INTENTION TO ORDER THE VACATION OF A PORTION OF ENNIS STREET 4 BETWEEN AMOS AVENUE AND LINCOLN AVENUE AND RESERVING EASEMENTS FOR SANITARY SEWER,WATERLINES AND PUBLIC UTILITIES. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 6 SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. That the Mayor and Common Council of the City of San Bernardino 8 hereby declares its intention to order the vacation of a portion of Ennis Street between Amos 9 Avenue and Lincoln Avenue, described as follows: 10 11 That portion of Ennis Street in the City of San Bernardino, County of San Bernardino, State of California, described as follows: 12 That portion of Ennis Street, as shown on the Map of Valley Truck Farms Tract 13 No. 1995, as per plat recorded in Book 29 of Maps, page 13, records of said 14 County, described as follows: 15 Beginning at the Northeast Corner of Lot 56 of said Tract No.1995, said point also being the intersection of the South line of said Ennis Street with the West line 16 of Burlington Northern and Santa Fe Railroad Right of Way, (formerly the A.T. & 17 S.F. Railroad); thence East, along the South line of said Ennis Street, to the East line of said Railroad Right of Way; thence Northwesterly, along said East line of 18 Railroad Right of Way to the of the North line of said Ennis Street; thence West along said North line of Ennis Street; to West line of said Railroad Right of Way; 19 thence Southeasterly, along the West line of said Railroad Right of Way, to the 20 point of beginning. 21 SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in 22 vacating the above described portion of said street, elects to proceed under and in accordance 23 with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law", 24 25 being Division 9, Part 3, of the Street and Highways Code of the State of California. 26 SECTION 3. That the hour of 10:00 a.m., on July 20, 1998, in the Council Chambers of 27 City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time and place when 28 and where all persons interested in or objecting to the proposed vacation may appear before the 06/08/98 1 RESOLUTION OF INTENTION ---VACATION OF A PORTION OF ENNIS STREET BETWEEN AMOS AVENUE AND LINCOLN AVENUE 1 said Mayor and Common Council and offer evidence in relation thereto, for further particulars as 2 to the proposed vacation, see that map marked "Plan No. 9791", approved on 05/04/98, attached 3 4 as Exhibit 'A'. 5 SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing 6 easements for public utility purposes belonging either to the City of San Bernardino or to any 7 public utility and there is hereby specifically reserved for the City of San Bernardino an 8 easement for sanitary sewer and appurtenance facilities over the entire area proposed to be 9 10 vacated, including the right to construct, maintain, operate, replace and renew said sewer or 11 appurtenances; and there is hereby specifically reserved for the City of San Bernardino 12 Municipal Water Department an easement for water utility purposes over the entire area 13 proposed to be vacated, including the right at any time, or from time to time, to construct, 14 maintain, operate, replace and renew one or more pipelines or appurtenances thereto for the 15 16 transportation of water and for the construction and maintenance of water wells and related 17 incidental purposes, including the right of ingress and egress thereto; and there is hereby 18 specifically reserved for Southern California Edison Company, an easement to construct, place, 19 operate, inspect, maintain, repair, replace and remove underground or overhead electrical 20 transmission and/or distribution structures consisting of wires, cables, conduits, manholes and 21 22 necessary fixtures and appurtenances and said easement shall include rights of ingress and 23 egress; and there is hereby specifically reserved for Comcast Cablevision an easement to 24 construct, place, operate, inspect, maintain, repair, and replace underground or overhead 25 structures consisting of wires, cables and necessary fixtures and appurtenances and said easement 26 shall include rights of ingress and egress. 27 28 06/08/98 2 RESOLUTION OF INTENTION ---VACATION OF A PORTION OF ENNIS STREET BETWEEN AMOS AVENUE AND LINCOLN AVENUE 1 SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to 2 cause Notices of Street vacation to be posted as required by said "Public Street, Highways and 3 4 Service Easements Vacation Law." 5 SECTION 6.
