Description) Assessment Districts Finance: � Council Notes: Agenda Item No. V CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Confirmation of the 1998/99 Assessment Rolls for various Assessment Districts throughout the City. Background: Over the years,the City has formed assessment districts throughout the City to fund various types of improvements or maintenance. The majority of these are landscape maintenance assessments districts that were formed as a result of a petition from the developers of various tracts . The assessment districts provide a means of funding the maintenance of landscaping that was installed throughout these developments, as a condition of approval. The annual assessments include the contract costs for maintenance, water and energy, inspection and administration. The landscape maintenance districts are AD 951 (Zones 1 and 2), 952 (Zones 1, 2, 2A, and 3), 953, 956, 959, 968, 974, 975, 976, 981, 982, 982, 989, 991, 1001, 1002, 1004, 1016, 1017, 1019, 1020 and 1023. The 1998/99 Assessment Rolls for AD 1020 and 1023 were previously approved as part of the formation of these two new Districts and are not a part of this action. There are also 3 Assessment Districts for the maintenance of a sewer lift station. These districts are AD 962, 963 and 989 (which also includes landscape maintenance). Since all of these districts are for maintenance, the assessments are collected in perpetuity or termination of the District. Additionally,there are presently 2 assessment districts that were formed for construction. These districts are AD 973 and 1004, which are for traffic signal construction. AD 973 will terminate in 1999, and AD 1004 will terminate in 2002. With the passage of Proposition 218 in November of 1996, new procedures and requirements became necessary not only for the formation of assessments districts but also for the annual levies. However, certain types of districts are "exempt" from the procedural requirements of Proposition 218. The exemptions can be based on, but not limited to, a district being formed by 100% approval of the property owners at the time the district was formed. This is the case with a large portion of the districts since these were formed when they were still under one ownership. Exemptions are also allowed for districts that were formed for construction or maintenance of streets and street improvements, including traffic signals and landscaping within the street right of way. Districts that are non-exempt or any new or increased assessments require an assessment ballot procedure where the assessments must be approved by a majority of returned ballots. Assessments for Districts that are found to be exempt do not need to go through the property owner ballot approval process, unless there is an increase in the assessment amount. "Increase" is defined as an amount greater than any and all previous assessments, not necessarily just the previous year. Even in the case of an increase, if the methodology or the rate of assessment remains the same,the exemption may still apply, for example, if there is a change in land use or density. None of the Assessment Rolls presented here have increased over any prior year's assessment. Two districts, specifically AD 968 and AD 1012 do show an increase over the previous year, but have had higher assessment amounts approved and levied in prior years, thus,they still do not require property owner approval. As a courtesy to property owners, we will notify them in advance the property tax bills coming out. The increase for AD 968 over last year, is due to higher contract costs. The increase for AD 1012 over the previous year is due to the fact that no assessments were levied last year, due to a delay in the developer completing installation of the landscaping. The proposed assessment is, however, less than the first year's assessment of$11,060.00, which was levied to pre-fund maintenance and incidental costs. A summary of the assessments for each District are attached, along with maps indicating the location and boundaries of the various Districts. Financial Impact: The assessments pay the City's maintenance and or construction costs for the various Districts. If the assessments are not approved,the City will have to bear these costs, or discontinue maintenance, which could likely leave these areas in a blighted condition.
