Synopsis of Previous Council Action:
09/18/89—Resolution No. 89-378 was adopted, to vacate Main Street and Broadway Street Grade
Crossings.
02/07/94—Resolution No. 94-25 was adopted to amend Section 5 of Resolution No. 89-378 to refer
to the new grade crossing on Orange Show Road, with conditions.

Recommended Motion:
1. That the Acting Director of Public Works and the City Clerk be authorized to proceed with the proposed
vacation of a portion of Ennis Street between Amos Avenue and Lincoln Avenue.
And
2. That Plan No. 9791, showing the proposed vacation of a portion of Ennis Street between Amos Avenue
and Lincoln Avenue, be approved.

SUBJECT:
Authorization to Proceed& Approval of Plan---Vacation of a portion of Ennis Street between Amos Avenue and
Lincoln Avenue
BACKGROUND:
The extension of Orange Show Road, between Arrowhead Avenue and Tippecanoe Avenue, will require
construction of a new grade crossing at the Burlington Northern and Santa Fe Railway Company tracks. The
existing minor grade crossing on Ennis Street will have to be vacated as part of the project for extension of Orange
Show Road.
The new grade crossing will be safer than the existing since flashing lights and automatic guardrails will protect it.
An application was submitted to the Public Utilities Commission for an order to authorize construction of the new
grade crossing, contingent upon closing the existing grade crossing on Ennis Street.
Santa Fe Railway Company filed a protest on the new crossing. Negotiations were conducted with Santa Fe in an
attempt to convince them to withdraw their protest. After extensive negotiations, Santa Fe Railway agreed to
withdraw their protest if some of their demands were taken into account. Santa Fe Railway's major concern was
to permanently close grade crossings at Ennis Street, Main Street, and Broadway Street. On December 6, 1993 all
parties pertaining to the Railroad Crossing for Orange Show Road signed a Memorandum of Understanding
Agreement regarding these demands. The Mayor and Council adopted Resolution No. 94-25 on 2/7/94, to amend
Section 5 of Resolution No. 89-378 and comply with the Memorandum of Understanding regarding the new grade
crossing on Orange Show Road in lieu of the "F" Street crossing.
On January 27, 1998 an Agreement was executed between the City of San Bernardino and Burlington Northern
and Santa Fe Railway Company regarding the vacation for Ennis grade crossing and other contingencies.
The Mayor and Council had previously adopted Resolution No. 89-378 on 9/18/89, to order the vacation of
Broadway Street and Main Street Grade Crossings. Section 5 of this resolution states that it will not be in effect
until issuance of an order by the Public Utilities Commission for the new grade crossing on"F" Street, as a part of
the Central City South Project. These crossing vacations were continued requests for Orange Show Road as "F"
Street has been dropped. The Central City South Project has been abandoned; it was replaced with the Stampede
Stadium project. The vacation of Main Street and Broadway Street have previously been approved and were
determined non-essential crossing.

None
RECOMMENDATION:
We recommend the authorization to approve Plan No. 9791 and that the Acting Director of Public Works and the
City Clerk be authorized to proceed with the proposed vacation.
