Synopsis of Previous Council action:
Periodically, resolutions have been presented to the Mayor and Common Council for
authorization to impose liens on certain parcels of property on which costs have
accrued by the City's abatement of public nuisances.
Recommended motion:
That said resolution be adopted; and that the City Clerk be directed to
administratively remove any properties from Exhibit 'A' which have been
paid.

RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COST OF
3 ABATEMENTS AND IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY
4 LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF THE
ABATEMENT OF PUBLIC NUISANCES. (Building Abatements)
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
6 BERNARDINO AS FOLLOWS:
7 SECTION 1. The City of San Bernardino, pursuant to its authority under San
8 Bernardino Municipal Code Chapter 1 .28 and other laws, did lawfully cause public nuisance
9
abatements on the real property described in Exhibit "A", attached hereto and incorporated
10
11 herein by reference as though fully set forth. The last known owners of record as to each such
12 Parcel are also specified in Exhibit "A".
13 Due notice was given to the person or persons having an interest in said property and a
14 hearing was held by the Board of Building Commissioners to hear protest and to assess the cost
15 of said abatement on said property. The Board of Building Commissioners has entered its order
16
determining the cost to be reasonable and proper and imposing a lien upon the land involved.
17
Notice of the right to appeal to the Mayor and Common Council has been issued to all affected
18
19 property holders. The Board of Building Commissioners now requests that the Mayor and
20 Common Council confirm the imposition of the liens.
21 SECTION 2. The matter having now come before the Mayor and Common
22 Council for confirmation of the imposition of the liens imposed, the following costs are found
23
to have been duly incurred by the City pursuant to the proceedings under said

4 provisions of the San Bernardino Municipal Code and the final statements of costs on file with
5
the City Clerk are hereby confirmed and adopted as special assessments against the properties
6
7 listed in Exhibit "A" hereto.
8 SECTION 3. If said sum is not fully paid to the City Clerk, City Hall, San
9 Bernardino within five (5) days after mailing a notice to the person or persons having an interest
10 in said property informing said person or persons of the adoption of this resolution as to any
11 such individual parcel, then said sum shall be and become a lien on said property pursuant to
12
said Municipal Code provisions and applicable laws and shall be collected as a special
13
assessment thereon.

15 SECTION 4. In the event said sum is not paid as hereinabove provided, the City
16 Clerk is hereby directed to file a certified copy of this resolution with the Auditor of the County
17 of San Bernardino, State of California, directing that sum be entered as lien charges against said
18 property as it appears on the current assessment rolls, to be collected as the same and in the
19
same manner, subject to the same penalties and interest upon delinquencies, as the general taxes
20
for the City of San Bernardino are collected. The City Clerk shall present for recording
21
22 appropriate notices of the imposition of these liens with the County Recorder.
