STAFF REPORT
SUBJECT:
Award of Contract to Doug Martin Contracting Company Inc. for Pavement Rehabilitation by
Slurry Seal Method between 9th Street and Baseline, and from "E" Street to Waterman Avenue
per Plan No. 9757.
BACKGROUND:
Each year an allocation is made in the 126 Gas Tax Fund and the 129 1/2-cent Sales Tax Fund
for the rehabilitation of various streets within the community. In a joint effort, the Department
of Public Works and the Department of Public Services review and recommend streets for
rehabilitation. Factors considered are traffic volumes, condition of street, method to be used,
service life of pavement, improvements to be realized with the rehabilitation method and
available funding. Slurry seal is considered the most cost effective process for the street being
considered in this project.
The project will consist of grinding those cracks in the street that cause a bump or rough ride,
sealing the cracks with an appropriate sealer, cleaning the street and then applying a slurry seal
that is a pavement restorative and weather seal. Proper slurry seal restores the street and
provides an additional 15 years of service life to the pavement. Slurry seal with all preparation
presently costs approximately $1.12 per square yard. Full reconstruction of the pavement
(building a new street) costs $45.00 per square yard.
Bids for this project were opened at 2:00 p.m. on Tuesday March 17, 1998. A total of two bids
were received and ranged from a low of$136,278 to a high of$163,400. The low bid is 27%
below the Engineer's Estimate of $173,300. The estimated project cost based on the low bid
is as follows:

Subtotal $150,278
Contingencies (15%) $ 22,522
TOTAL $172,800
FINANCIAL IMPACT:
Funding for the cost of the rehabilitation of pavement at various locations is in the Gas Tax
Construction Fund under Account No. 126-369-5504-7097 which has an approximate balance
of$113,000 from the original amount of $500,000, and in the 1/2-Cent Sales Tax Fund under
Account No. 129-367-5504-1521 with an approximate balance of$612,000 in carryover funding
from the last allocation.
RECOMMENDATION:
Staff recommends adoption of the resolution

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY O
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. DOUG MARTIN CONTRACTING COMPANY, INC. is the lowest
7 responsible bidder for: PAVEMENT REHABILITATION BY SLURRY SEA
8 METHOD BETWEEN 9TH STREET AND BASELINE, AND FROM "E" STREET T
9 WATERMAN AVENUE per Plan No. 9757 A contract is awarded
10 accordingly to said bidder in a total amount of $136, 278, however
11 such award shall be effective only upon being fully executed by
12 both parties. All other bids, therefore, are hereby rejected. The
13 Mayor is hereby authorized to execute said contract on behalf of
14 the City; a copy of the contract is on file in the office of the
15 City Clerk and incorporated herein by reference as fully as thoug
16 set forth at length.
17 SECTION 2 . This contract and any amendment or modification
18 thereto shall not take effect or become operative until full
19 signed and executed by the parties, and no party shall be obligate
20 hereunder until the time of such full execution. No oral
21 agreements, amendments, modifications or waivers are intended o
22 authorized and shall not be implied from any act or course o
23 conduct of any party.
24 SECTION 3 . This resolution is rescinded if the parties to th
25 contract fail to execute it within sixty (60) days of the passag
26 of this resolution.

bound contracts to be filed with Res . No. 98-91, awarding a
contract to Doug Martin Ccontracting Company, Inc . for pavement
rehabilitation by slurry seal method between 9th Street and
Baseline, and from "E" Street to Waterman Avenue.
Please obtain signatures on all documents and return one (1) fully
executed original bound contract to the City Clerk' s office for
filing with said resolution. Said contracts have been executed by
the Mayor and City Attorney.
Please be advised that said resolution was adopted on April 6 ,
1998 , and will be rescinded if parties fail to execute said
documents within sixty (60) days of the passage of this resolution.
The documents must be executed no later than Friday, June 5, 1998 .
