Recommended motion:
That the City Clerk and City Engineer be authorized to proceed,
under Chapter 12 . 90 of the San Bernardino Municipal Code, with the
establishment of an assessment district for construction of re-
taining and perimeter walls , street lights , and street improve-
ments , in connection with the development of Tentative Tract No.
14715 .

CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Tentative Tract No. 14715 is a 59 -lot single family
subdivision, located between Kendall Drive and 48th Street, and
west of 4th Avenue.
A letter, dated 10--01-96 , has been received from Phillip
W. Walsh, President of Emblem Development Company, requesting
that the City establish an assessment district for construction
of certain public improvements. A copy of this letter is
attached for reference.
Funds to finance the estimated cost of $296 , 000 will be
provided bN7 the subdivider . and repaid through assessments on the
lots .
In the event that Proposition No. 218 is passed by the
voters on 11--05-96 , an election will need to be held on the
assessment district. This will not present a problem, since the
subdivision will own 1000 of the property.
We recommend that authorization be granted to proceed
with the formation of an assessment district.

Dear Mr. Hardgrave:
The purpose of this letter is to request the implementation
of section 1290 of the San Bernardino Municipal Code on a portion
of tentative tract 14715 . This tentative tract is composed
of 59 lots and is in three phases of 20 , 20 , and 19 lots .
The utilization of this section of the Municipal Code would
enable our firm to proceed with the development of the tract.
We would request an opportunity to meet with your department
to outline the areas we would, include is in the facility
district . The proposed assessments would be tied to each
individual lot in the tract.
Basically we would intend to include the retaining walls and
perimeter wall , street lights, Orange Grove Avenue outside our
tract boundary, and the improvements on 4th street and 48th
street . A preliminary cost breakdown of the overall costs of
the proposed assessment is attached.
We look forward to your assistance and information to proceed
with the necessary steps to implement this action.
