Description) Finance: Council Notes: Agenda Item No. 31 /0 �al � Igq (, Res 96- CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: GENERAL PLAN AMENDMENT NO. 96-10 MAYOR AND COMMON COUNCIL MEETING OF OCTOBER 21, 1996 OWNER/APPLICANT: CITY OF SAN BERNARDINO REQUEST/LOCATION The applicant is requesting a change in the general plan land use designation of four parcels of land from CG-1, Commercial General, to PF, Public Facilities to accomodate the expansion of a city cemetery (Pioneer Cemetery). The site is located on the northwest corner of 7th Street and Waterman Avenue (Refer to Exhibit 1, General Plan Land Use & Location Map). KEY ISSUES * The proposed amendment would make the northwest corner of Pioneer Cemetery consistent with the intended cemetery use to accommodate the land use activities found within cemeteries. * The proposed amendment would not create a new public facility but, rather, expand the service of an existing public facility. * The proposed amendment is internally consistent with the General Plan. The proposal meets the General Plan's goal to "permit the continuation and expansion of existing public facilities (police, fire, social service, cemeteries, governmental administrative, and other) in areas designated as "Public Facilities" (PF) and new development in any zone (I 1.1 and I 1.18)" (General Plan Policy 1.37.13). The Planning Commission Staff Report prepared for the September 17, 1996 Planning Commission meeting provides the detailed background and analysis of this project (Refer to Exhibit 3). General Plan Amendment No. 96-10 Mayor and Common Council Meeting October 21, 1996 Page 2 of 2 COMMENTS RECEIVED No comments have been received as of the date of this staff report. ENVIRONMENTAL DETERMINATION This project is exempt from CEQA as a general rule [Section 15601(b)(3)]. Staff completed an Environmental Impact Checklist and all items were marked "No". PLANNING COMMISSION RECOMMENDATION At their September 17, 1996 meeting, the Planning Commission voted to recommend the approval of General Plan Amendment No. 96-10 to the Mayor and Common Council. The vote was unanimous: 5 ayes (Gonzalez, Hamilton, Quiel, Stone, Trasher), 0 nayes, 0 abstentions, and 5 absent (Enciso, Lockett, Schuiling, Strimpel, Traver). STAFF RECOMMENDATION Staff recommends that the Mayor and Common Council: 1. Adopt the Resolution to approve General Plan Amendment No. 96-10 to change the general plan land use designation of four parcels of land totaling 1.5 acres located on the northwest corner of 7th Street and Waterman Avenue from CG-1, Commercial General, to PF, Public Facilities, to accommodate the expansion of Pioneer Cemetery based on the Findings of Fact contained in the Resolution (Exhibit 4). The site is located on the northwest comer of 7th Street and Waterman Avenue (Refer to Attachment A, Location Map). CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) STATUS This project is not subject to CEQA pursuant to Section 15061(b)(3). Staff completed an Environmental Impact Checklist and all items were marked "no". No development is proposed at this time. DEVELOPMENT CODE AND GENERAL PLAN CONFORMANCE The site meets the general standards of the Development Code for public facilities within the PF land use district. The proposal does not result in the creation of individual parcels zoned in contrast to the surrounding land uses (i.e. "spot zoning"). The requested land use designation, PF, exists west of the site where the major portion of the cemetery is located. As stated in the General Plan it is the City's policy to "permit the continuation and expansion of existing public facilities (police, fire, social service, cemeteries, governmental administrative, and other) in areas designated as "Public Facilities" (PF) and new development in any zone (I 1.1 and 11.18)" (General Plan Policy 1.37.13). As such, this proposal is in conformance with the City of San Bernardino Development Code and General Plan. BACKGROUND General Plan Amendment No. 96-10 was reviewed by the Development Review Committee (DRC) on September 5, 1996. The project was cleared to the Planning Commission with a recommendation for approval. ANALYSIS Site and Area Characteristics The site is an extension of Pioneer Cemetery which has not been used for burial purposes. It consists of four parcels totaling approximately 1.5 acreas. The parcels are level and form a rectangular area which is fully landscaped. Adjacent to the property on the north is a coin- operated carwash. Other commercial uses consisting of used car sales, tire sales, and auto parts sales exist to the east across Waterman Avenue. A single-family home is also located along General Plan Amendment No. 96-10 Agenda Item: 2 Hearing Date: September 17, 1996 Page 2 of 3 Waterman Avenue to the east within the CG-1, Commercial General, land use district and a vacant parcel of land is located south of the site. The main portion of the cemetery is adjacent to the site on the west. EXISTING LAND USE DESIGNATION The CG-1, Commercial General, land use designation is intended for the continued use, enhancement, and new development of retail, personal service, entertainment, office and related commercial uses along major transportation corridors. Cemetery land uses are not allowed in this land use district. PROPOSED LAND USE DESIGNATION The PF, Public Facilities, land use designation is intended for the continuation of existing and development of new schools, government administrative, police, fire, libraries, social service, and other public facilities such as cemeteries. The majority of Pioneer Cemetery falls within this land use designation with the exception of the subject site. Therefore, the General Plan amendment is necessary to accommodate the cemetery land use expansion on the site. CONLNIENTS RECEIVED No comments have been received as of the date of this staff report. CONCLUSION General Plan Amendment No. 96-10 is consistent with the City of San Bernardino General Plan and is in accordance with all applicable Development Code Standards. Furthermore, the proposal is not subject to CEQA based on Section 15061(b)(3). RECOiVLMENDATION Staff recommends that the Planning Commission recommend to the Mayor and City Council: 1. Approval of General Plan Amendment No. 96-10 based on the Findings of Fact (Attachment Q. The proposed amendment is internally consistent with the General Plan. The proposal meets the General Plan's goal to "permit the continuation and expansion of existing public facilities(police, fire, social service, cemeteries, governmental administrative, and other) in areas designated as "Public Facilities" (PF) and new development in any zone (I 1.1 and I 1.18)" (General Plan Policy 1.37.13). 2. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that the proposed land use designation is in accordance with the existing land use adjacent on the west. The addition of burial plots on the site will not encroach onto other property or affect the circulation of the immediate area. 3. The proposed amendment would maintain the appropriate balance of land uses within the City. The amendment would not create a new public facility but, rather, would expand the service of an existing public facility. 4. The subject site is physically suitable for the requested PF land use designation. The site is presently designated as a commercial district. No structures exist on the site. Any actual on-site improvements would be reviewed at the time of their proposal and conditions implemented when the proposal is approved.
