Description) Finance: Council Notes: Agenda Item No. iola,, I lgg6 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Determination of Public Convenience or Necessity No. El Tigre Market Mayor and Common Council Meeting of October 21, 1996 APPLICANT Ken Choi El Tigre, Inc. 1184 W. 2nd Street San Bernardino, CA 92410 REQUEST AND LOCATION The applicant is establishing the El Tigre Market, in the old La Plaza Market at 1184 W. 2nd Street, and requesting approval from the State Department of Alcoholic Beverage Control for a Type 20 liquor license. This license allows off-site sales of beer and wine. The grocery store is approximately 20,000 square feet, with approximately 780 square feet, or less than 1% of the store area, devoted to beer and wine sales. The grocery store will be a full service market, offering fresh meat, produce and dairy products, a bakery, and the usual assortment of pre-packaged foods. The applicant is proposing interior tenant improvements and will spruce-up the exterior of the building. The applicant was notified that the market is located in an area that has an over concentration of off-site liquor licenses, and that a determination of Public Convenience or Necessity, from the City, would be required. The application was filed with the Planning Division on August 15, 1996. ENVIRONMENTAL DETERMINATION Reuse of the existing building as a grocery store with beer and wine sales is exempt from the California Environmental Quality Act, Section 15301. POLICE DEPARTMENT RECOMMENDATION The Police Department has indicated that they will not oppose the ABC application. (Exhibit A). DETERNIINATION The applicant provided a letter supporting the request for a Type 20 liquor license. Staff feels that a determination of public convenience or necessity can be met based on the following: - The establishment of a grocery store in an existing building at 1184 W. 2nd Street will contribute substantially to revitalization of that general area. The site is across from the Metrolink Station, and the proposed upgrades to the market will complement this entry to the City. - The sale of beer and wine for off-site consumption is a service typically found at grocery stores. The percentage of physical retail space devoted to the sale of alcohol is minimal and is accessory to the other services and products provided. RECOMMENDATION Staff recommends that the Mayor and Common Council determine that the public convenience or necessity is served and direct the Planning Division to prepare a letter for the Department of Alcoholic Beverage Control for a Type 20 alcohol license at 1184 W. 2nd Street. EI Tigre, Inc operates full Service Hispanic supermarkets in Los Angeles and San Diego counties. We Dope that our San Bernardino location will exceed the success of our other markets. The Success of this location is dependent on meeting the nerds of the surrounding community. As you are aware. this part of Son Bernardino does not currently have a supermarket that offers a in store bakery, fresh meat and seafood department, service delicatessen, and full lines of fresh produce and groceries. Not only does E1 Tigre provide these services, we also offer check cashing and other financial services, as well as a in-store tortilla factory. Unlike most of the major chain stores, El Tigre customizes Ms product line to serve the community. The store will offer a comprehensive Hispanic grocery line with over 1200 items including products imported from El Salvador, Guatemala, Mexico and Costa Rica- Moreover, our association with Certified Grocers allows us to keep our prices very competitive with the large :supermarket chains. On average alcoholic beverage sales account for less that 7% of our total sales, however, alcoholic beverages are necessary to eompiete our product mix for the OCT-10-1996 07:56 909699E869 P.01 convenience of our customers. If we were unable to carry alcoholic beverages, a significant competitive disadvantage would result that may endanger the success of the entire market. We are excited about participating in the redevelopment taking place in San Bernardino. Our supermarket will add approximately 80 Jobs to the local economy as well as significant tax revenues. For the above reasons, we feel that public convenience will be served by the issuance of our beer and wine license. Thank you for your consideration.
