Description) Assessment District No. 1019 Finance: -_� Council Notes: Continued to /�/0 y/9 /D al �1�6 (10-21-96) Agenda Item No. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT A petition was received by this office requesting the formation of an assessment district for the maintenance of landscaping in the Northpark and Mountain area. The landscaping to be maintained is located along portions of the South side of Northpark Boulevard, the East side of Mountain Drive, the North side of Hill Drive, the West side of "H" Street and certain landscape easements within Tract Mo. 14448.. This petition is the result of the Condition of Approval for Tract No. 14448, to establish a landscape maintenance district. The signatures on the petition have been checked and found to the owners of 100% of the area lying within the proposed assessment district that are liable to be assessed. It is anticipated that this assessment district will be exempt from the provisions of Proposition 218 if approved by the voters, since all assessment districts formed with 100% property owner petition, at the time the initial assessment is confirmed, are exempt. The developer has advised us that in the event any homes are sold (and closed) prior to the confirmation of the assessments, which is scheduled or November 4, 1996, he will obtain the new owner's signature on the petition, thus keeping the 100% petition in effect. The developer has deposited $4,000 to cover the cost of the proceedings. Any amounts remaining will be refunded to the developer at the end of the proceedings. An Engineer's Report was prepared, which sets forth the details of the proposed district, including the first years estimated cost and an assessment roll showing the amount to be assessed against each parcel. The estimated amount of all costs, including incidental and administrative costs is $18,647.44. This calculates to be about $190 per residential unit per year. A copy of the Engineer's Report is on file in the office of the City Clerk. All potential home buyers will be given a disclosure form by the developer indicating the assessment amount and the purpose of the district and copies will be kept on file in our office. On September 16, 1996, Resolution of Intention No. 96-283 was adopted, declaring the City's intention to form the district and also preliminarily approved the Engineer's Report and the Boundary Map of the district, and set a public meeting for October 21, 1996 and a public hearing for November 4, 1996. All owners of record, or their authorized agents, were given mailed notice of the meeting and hearing and the Resolution of Intention was published in the Sun newspaper. We recommend that the public meeting be closed and protests, if any, be continued to the public hearing on November 4, 1996.
