Vernon Ave. Synopsis of Previous Council action: 08-21-95 --- Authorization to proceed was given and Plan No. 9340 was approved. 02-06-96 1 --- Notice of Exemption filed and a finding of consistency with the General Plan was made. 07-01-96 --- Resolution of Intention No. 96-202 was adopted, which set a public hearing date of 08-5-96 for the proposed vacation of a portion of Third Street lying between Viaduct Blvd. and Mt. Vernon Avenue, per attached Plan No. 9340. Recommended motion: 1. That the hearing be closed and the Findings of Fact as set forth in the Staff Report from Roger G. Hardgrave, Director of Public Works/City Engineer as to why the portion of Third Street, lying West of Viaduct Blvd. and East of Mt. Description) Street Vacation filing fees Finance: Council Notes: 7 5-0262 08-05-96 Agenda Item No. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Staff received a request from San Bernardino Associated Governments, who represents the owner of property adjoining portions of the north and south sides of Third Street, lying between Viaduct Blvd. and Mt. Vernon Avenue, to vacate the portion of Third Street lying East of Mt. Vernon Avenue and West of Viaduct Boulevard. The other adjoining property on the north side of Third Street is owned by the Atchison, Topeka, and Santa Fe Railway Company and is currently being used for railroad purposes. The Atchison, Topeka, and Santa Fe Railway Company is agreeable to the proposed vacation. Authorization to proceed with the proposed vacation was given on 08-21-95, and Plan No. 9340 was approved. All of the affected Utility companies and City departments were notified of the proposed vacation on 09-1.1-95, with a reply due by 09-30-95. The City of San Bernardino Municipal Water Department was the only utility company to request the reservation of an easement for their existing facilities. They have requested that an easement be reserved over the entire portion of the area being vacated. On 02-06-96, a Notice of Exemption was filed relative to the proposed vacation, and a finding of consistency with the General Plan was made. On 07-01-96, Resolution of Intention No. 96-202 was adopted, reserving an easement for water purposes over the entire area being vacated. That resolution sets a public hearing date of 08-05-96. On 07-11-96, the Resolution of Intention was published in the local Sun Newspaper, and Notices were posted in the area proposed for vacation, and all adjoining property owners to the portion of the street being vacated were given mailed notification of said public hearing on 07-11-96. There appears to be no further necessity for the portion of Third Street lying between Viaduct Boulevard and Mt. Vernon Avenue, either for present or future public street purposes. Staff recommends the vacation on the basis of the following Findings of Fact: 1. The above portion of Third Street has been determined by the Department of Public Works to be of no further necessity to the general public: a) Notice of Exemption was filed, and a finding of consistency with the General Plan was made. 2. The adjoining property owners have requested the proceedings and the required $1000.00 fee has been paid. 3. All of the concerned City Departments and Utility Companies were notified of the proposal and all have had the opportunity to respond. The reservation of an easement for water purposes has been reserved over the entire area of the proposed vacation, and the same has been provided for in the Resolution of Intention.
