AGENDA ITEM: AN URGENCY ORDINANCE OF THE CITY OF SAN BERNARDINO
AMENDING SECTION 3.04.010.B.1 OF THE SAN BERNARDINO
MUNICIPAL CODE RELATING TO PURCHASING
Over recent years the City has faced a significant problem with the existence of dangerous,
abandoned buildings and structures. This has caused blight to seriously infect some areas of the
City to the extent that good, honest citizens have nearly lost hope in light of the gangs, drugs,
graffiti and crime that have seemingly taken over. One concentration of this condition is what has
been identified as the Arden/Guthrie area near the intersection of Arden and Highland. The City
has been aggressive in attacking this problem through redevelopment, code enforcement, and
increased police presence. We now find with this increased activity that we have additional orders
from the Board of Building Commissioners to demolish such buildings and structures, and it is
necessary to revise our thinking and practices to keep up with the growing workload. This
ordinance, on an urgency as well as an ongoing basis, would revise the procedures to clearly
remove the requirement for board ups and demolitions to be handled under the standard
purchasing procedures. It would allow the City officer to go out and take care of a problem that
exists as soon as possible, assuring that legal rights are protected. It would also remove matters
relating to litigation and investigations, all of which must often proceed on only hours notice and
usually in strict confidence, from the limitations of the Purchasing Ordinance.
