On March 6, 1995, Agenda Item S3 -- Discuss and take possible
action relative to ambulance service - Council Member Pope-Ludlam -
- was on the Council Agenda. Included with that item was An
Ordinance relating to the setting of ambulance rates .
The motion approved by the City Council on March 6, 1995 was "That
the City Clerk be directed to call a meeting of the Franchise
Bureau as soon as possible after application for ambulance rate
increase has been submitted by Mr. Rice; and two weeks after the
Bureau' s meeting, bring the Bureau' s findings and recommendations
back to the Council for the purpose of considering a rate
increase . " .
A meeting of the Franchise Bureau was called for and neid on
Tuesday, March 14 , 1995, at which time the Bureau voted unanimously
to recommend to the Mayor and Common Council that the rate
structure proposed by Courtesy Services of San Bernardino, Inc . , be
adopted.
Pursuant to direction given at the March 6, 1995 meeting, staff was
preparing its report for submission to the Mayor and Council at the
April 3 , 1995 meeting; however, on Thursday, March 16 , 1995, the
City Clerk' s Office received a request from Councilwoman Pope-
Ludlam and a telephone call from the City Attorney' s Office
requesting that the item be agendized as a public hearing for
today' s meeting.
Attached is the staff report which was being submitted for the
April 3 , 1995 Council meeting; however, given that the matter is on
today' s Council Agenda, we are submitting it to you for your review
at this time .
I might add that at the time the City Attorney' s ULLlce caiiea to
request that we do everything possible to place this item on the

agenda as a public hearing, I expressed concern that the deadline
had already passed to place a legal ad in The Sun and also
expressed concern that I thought ten days notice of a public
hearing was required. I later learned that the City Attorney' s
office had, in fact, faxed the publication notice to The Sun. The
City Attorney' s office has indicated that ten days' notice is not
required in this case.
If you have any questions, please let me know. Lee Gagnon,
Secretary of the Bureau of Franchises, will be present when this
item comes up for consideration.

§ 66018. Hearing i
(a) Prior to adopting an ordinance, resolution, or other legislative enactment adopting a new fee
or approving an increase in an existing fee to which this section applies, a local agency shall hold a
public hearing, at which oral or written presentations can be made, as part of a regularly scheduled
meeting. Nouce of the time and place of the meeting, including a general explanation of the matter
to be considered, shall be published in accordance with Section 6062a.
(b) Any costs incurred by a local agency in conducting the hearing required pursuant to
subdivision (a) may be recovered as part of the fees which were the subject of the hearing.
(c) This section applies only to the adopting or increasing of fees to which a specific statutory
notice requirement, other than Section 54954.2, does not apply.
(d) As used in this section, "fees" do not iuClude rates or charges for water, sewer, or electrical
service.

for an increase in the rates for ambulance service. The Bureau of Franchises considered
the proposal and then unanimously recommended to the Mayor and Common Council that

The last increase granted by the CITY of SAN BERNARDINO was
on OCTOBER 16, 1989. The requested rates are the same as the
SAN BERNARDINO COUNTY Rates approved on October 15, 1993.
If the current rate request is granted by the CITY of SAN
BERNARDINO, Courtesy will immediately begin to accept Medicare
assignment for all program beneficiaries.
This will reduce the net ambulance costs to the senior citizen
population by $294.68 (average per call).

Dear Mr. Penman:
As you are well aware, this law firm's client, COURTESY
SERVICES OF SAN BERNARDINO, INC. ("COURTESY") is currently
involved in litigation with the CITY OF SAN BERNARDINO ("CITY")
and the COUNTY OF SAN BERNARDINO ( "COUNTY'') regarding certain
issues as to the authority, if any, of the CITY to regulate
and/or control ambulance services. That litigation is not yet
final so the rights and duties of the various parties remain in
dispute.
COURTESY does not agree or concede that the CITY has
any right to regulate or control the fees COURTESY may charge for
services, but CITY does so contend.
COURTESY has not modified the rates it charges within
the CITY since 1989 and must now act to modify those rates to
conform to current costs.
Simply in an effort to reach settlement of this issue,
COURTESY has prepared an information summary for CITY showing
various fee data which it is willing to submit to CITY for its
review. Such submittal is not, however, to be deemed in any way
to be an acknowledgment, concession, or admission that the CITY

has any such control. Instead, the submittal is being made
simply as part of COURTESY's on-going efforts toward partial or
complete settlement of the litigation and is thus protected by
the provisions of Evidence Code 9 1152.

Ambulance Service of San Bernardino
Since 1948
Courtesy Services of San Bernardino, Inc. is requesting an
adjustment to its current rates. If approved, this rate increase
would generate $963 ,000 in additional revenue.
This additional revenue would allow us to address four areas
of critical concern to this company.
First, it will allow us to address the concerns of our senior
citizen population by enabling us to accept Medicare assignment for
ambulance service. What this means to the Medicare patient is that
Medicare will pay for their ambulance service directly and they
will be billed only for the deductible (if applicable) and the 20%
co-payment. If there is a supplemental insurance, that will of
course be billed for them. If there is no supplemental coverage,
and the patient is unable to pay the remaining balance, they will
be able to sign a Hardship Declaration Form and the balance will be
written off. This will reduce out of pocket costs to the Medicare
patient by an average of $294 .00 per call. By accepting Medicare
assignment, the projected revenue will be reduced by $259,802.
The second area we need to address is our employees. They
have had a salary freeze for the past few years and we feel some
adjustments to wages are necessary. This will cost $10,000 per
month or $120,000 per year.

Thirdly, resources in the field need to be increased. Three
years ago we had to layoff two crews (two paramedics and two
E.M.T. 's) . Since that time our responses have increased from
28,245 in 1989-1990 to a projected total of 31,080 for 1994-1995.
That is an increase of 2,835 calls. In order to continue to
provide quality service to our customers and to be competitive in
today's HMO environments, we feel we need to replace those two
crews and add two more, for a total of four crews. Salary and
benefits are approximately $65,000 for each two man crew. Four
crews would represent additional costs of $260,000 per year.
Lastly, after addressing our senior citizens, our employees
and our customers we will be left with a net income of $323 ,239
with which to address our capital needs. Prior to the lawsuit with
the City in 1991 , Courtesy had a Capital Replacement Program in
place. Our schedule called for the replacement of three ambulances
per year at a cost of $55,000 each. Also scheduled for replacement
each year was paramedic equipment at a cost of $23 ,000 per set. To
resume this replacement schedule would cost $234,000 per year.

The last ambulance rate increase was granted by
Resolution No. 89-406 on October 16, 1989 . On July 9 , 1991 the
Bureau of Franchises unanimously approved an ambulance rate
increase for Courtesy Service of San Bernardino. The rate increase
was then put on Council Agenda of August 19, 1991 and continued to
September 3 , 1991.
On August 27 , 1991 a continuance was requested by Steve
Rice to October 7 , 1991. At Council meeting of September 3 , 1991
the rate increase matter was tabled.

RE: Notice for Public Hearing
There is scheduled on the Agenda of the Mayor and Council for
Monday, March 20, a public hearing to consider and approve the
recommendation of the Bureau of Franchises that Courtesy Ambulance
be granted a rate increase. This public hearing is required by San
Bernardino Municipal Code §5.76.500 which provides as follows:
"The rates which shall be changed the public by
medical transportation carriers shall be such as are
prescribed in the carrier' s permit, and shall not exceed
the maximum rates set forth in the schedule for such
charges fixed by resolution adopted by the Mayor and
Common Council . All rate changes subsequently adopted
shall be adopted only after a duly noticed public hearing
is held relating thereto. "
There is nothing in the ordinance which specifies what the
notice period must be for such a public hearing. There are a
series of sections in the Government Code beginning with 56060 that
outline various publication requirements which can be easily cited
and referenced by other statutes. However, these sections are not
incorporated into the San Bernardino Municipal Code and therefore
do not apply. This is also not a tax or assessment that requires
the notice and hearing required by the Brown Act hearing
provisions. Additionally, we have found no statute or ordinance
that sets - any standard notice period for a public hearing to
approve ambulance rates. Therefore publication on Sunday for a
hearing on Monday is legally acceptable.
