Synopsis of Previous Council action:
11/21/94 --- Authorization to proceed was given, and Plan No. 9209 was approved.
12/12/94 --- Notice of Exemption filed and a finding of consistency with the
General Plan was made.
Resolution of Trrtention No. 95-43 was adopted, which sets a

Recommended motion:
1 . That the hearing he closed and the Findings of Fact as set forth in the Staff
Report. from Roger G. Hardgrave, Director of Public: Works/City Fngineer as to
why that certain "L" shaped alley between Arrowhead Avenue and Pershing
Avenue and North of 29th Street,, is no longer necessary for street purposes,
he adopted.
2. Adopt Resolution. i

STAFF REPORT
Staff received a request from Tom Tissot, one of the adjoining property owner-, to
vacate that certain "L" shaped alley lying North of 29th Street between Arrowhead
Avenue and Pershing Avenue. The adjoining neighbors have had problems over the past
several years with the heavy, unauthorized use by transients, etc. , of the alley.
Authorization was given on 11/21/94, to proceed with the proposed vacation and Plan
No. 9209 was approved.
Utility companies and City departments were notified of the proposed vacation on
12/12/94, with a reply due 1-y 01/12/95. Building and Safety was concerned about
access to garages and carports. The neighbors will all share access to the alley once
it is vacated.
On 12/12/94, a Notice of Exemption was filed for the proposed vacation, and a finding
of consistency with the General Plan was made.
On 02/20/95, Resolution of Intention No. 95-43 was adopted, reserving easements for
public ii ilities over the entire area of the vacation. That resolution sets a public
hearing date of 03/20/95. On 03/01/95, the Resolution of Tnient:ion was published in a
local newspaper, Notices were posted in the area proposed for vacation, art(] all
property owners adjacent to the proposed vacation were notified of said hearing.
There appears to be no further necessity for that certain "1," shaped alley lying North
of 29th Street, between Arrowhead Avenue arid Pershing Avenue, either for present or
future street purposes. Staff recommends the vacation on the basis of the following
Findings of Fact:
1. The above alley has been determined by the Department of Public Works to be of no

further necessity to the general public:
a) Notice of Exemption was filed, and a finding of consistency with the General
Plan was made.
2. The adjoining property owners have requested the proceedings and the required
$1000.00 fee has been paid.
3. All of the concerned City Departments and Utility Companies were notified of the
proposal and all have had the opportunity to respond. The reservation of an
easement for Public utilities has been reserved over the entire area of the
proposed vacation, and the same has been provided for in t-he Resolution of Tnten-
tion.
Staff therefore recommends the execution of the Resolution Ordering Var-al.ion.
