STAFF REPORT
Late last year, the Mayor and Common Council referred the issue of
public comments at Council meetings to the Legislative Review
Committee. Attached in the proposed amendment to Resolution No.
94-46, which regulates public comments. The City Attorney's office
drafted the proposed amendment and feels it meets the new
regulations of the Brown Act.
The proposed amendment does three things. First, it limits any
member of the public to three minutes per agenda item, and that
same member of the public is allocated a total time limit per
council meeting of fifteen (15) minutes. Second, an appellant or a
named party to an agenda item is not subject to the time
limitations on that particular item, but can be subject to
reasonable limitations determined by the Mayor and Council. Third,
the consent agenda will include a section of agenda items that have
been previously heard by a council committee, and members of the
public cannot remove any of these items from the consent agenda.
Since the public had the opportunity to address these issues at the
committee level, they no longer have the opportunity to address the
issue at the council meeting. The Mayor and councilmembers still
have the right to pull any item off the consent agenda. However,
once the Mayor or councilmenber has pulled an item off the consent
calendar, a member of the public is then able to comment on the
item.
RECOMMENDATION
Adopt resolution.

STAFF REPORT
At the January 9th Council meeting, the Mayor and Common Council
referred the issue of salaries for the Mayor and councilmembers to
the Legislative Review Committee. Originally, the issue was
brought forward by the City Attorney's office and recommended that
the Council adopt resolutions proposing amendments to the Charter
changing the annual salary of councilmembers to $24 , 000 and of the
Mayor to $93 ,400.
The Legislative Review Committee recommended the establishment of
a 15-member Blue Ribbon Commission to study the salary levels of
the Mayor and Council, and to report back to the Council with a
recommendation within 45 days the Commission's creation. The Blue
Ribbon Commission would be made up of the following appointments:
Mayor: 2 representatives (2 total)
Council: 1 representative per councilmember
(7 total)
City Bargaining Units: 1 representative per bargaining unit
(5 total)
Business: 1 representative for both the
Hispanic Chamber and the San
Bernardino Area Chamber (1
total)
RECOMMENDATION
Approve creation of Blue Ribbon Commission.

STAFF REPORT
In February, 1973, Section 40 of the City Charter was changed to eliminate the
necessity of going to the electorate every time the City wanted to sell a parcel
of City owned land. The change allowed the City to go to competitive bid for such
sales without having to put an item on ballot and stated that any parcel with a
value of less than $2,000 could be sold without the competitive bid process.
Since that time, the value of real property in the City has increased and the
restriction of $2,000 place upon non-bid sales of land has become unrealistic.
From time to time, the City has remnants of land which are saleable, but their
value exceeds $2,000. It is rare that any land in the City would sell for less
than $2,000. Many of these parcels are not buildable and only have value to an
adjacent property owner.
To allow the City more flexibility in dealing with real property sales, a
resolution was submitted for your action at the January 9, 1995 Council meeting.
The resolution proposed an amendment to the Charter to raise the $2,000
restriction to $25,000.
The item was referred to the Legislative Review Committee for review and
recommendation. The resolution was amended to eliminate any dollar restriction.
Instead, it allows the procedure for sales of real property to be set by the
Council by ordinance and limits the sale of any City owned property for not less
than the fair market value, as determined by the Council.
We recommend that the proposed Charter amendment be approved.
