The amendment would also add Section 19.04.030(2) to add specific development standards under which a vocational trade school could be established in an RU district, and revise Table 04.03 to make those standards applicable in the RU district. The amendment would apply to properties City-wide in the RU-1 and RU-2 land use districts. The applicant also requests the approval of a Conditional Use Permit to establish a vocational/trade school at the site of an existing church located on the northwest corner of 10th Street and "G" Street, in the RU-2 land use designation. The school would offer vocational courses in the health field. Courses would include medical assistant, phlebotomy/lab assistant, pharmacy technician, radiology (limited - no x-ray/radiology equipment would be on-site at the church), echocardiograph technician, home health care and veterinary assistant. G.E.D. classes and English as a Second Language (E.S.L.) classes would also be offered. The vocational/trade school would occupy the classrooms formerly utilized by an elementary and secondary school (K through 12) associated with the church. Classes would be held Monday through Friday in two sessions, 8:00 a.m. to 1:00 p.m. and 5:00 p.m. to 10:00 p.m. Each session would accommodate up to 80 students. KEY POINTS: There are several key points which have been identified as follows: Development Code Amendment No. 94-05 o Table 04.01 in Section 19.24.020, does not permit vocational/trade schools in any residential land use district. The proposed amendment would revise this table to allow vocational/trade schools in the RU district, subject to the approval of a Conditional Use Permit. o Subsection T would be added to section 19.04.030(2) to establish specific standards under which a vocational/trade school could be established. This subsection would require that: Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06 Mayor and Common Council Meeting January 23, 1995 Page 2 (1) The vocational/trade schools in the RU district be established only at the existing facilities of churches, hospitals or other not for profit organizations fronting on a major or secondary arterial roadway. (2) That the vocational/trade school curriculum be restricted to only those courses compatible with adjoining neighborhoods -- no courses in automotive repair, welding, construction, woodworking, or industrial manufacturing would be allowed due to their incompatibility with residential uses. (3) All courses are to be held indoors only, completely enclosed within the confines of a building. (4) Vehicular access would be restricted to the frontage along the major or secondary arterial. (5) The facility would meet the off-street parking requirements contained in Chapter 19.24 of the Development Code. • Table 04.03 would be also be amended, adding item T to make the Standard contained in the new Section 19.04.030(2)(7) applicable in the RU District. • The amendment is consistent with General Plan Goal IA and 1G(J). (1) Providing for the development of sufficient land uses to serve educational and social needs of existing residents and population growth is one of the goals of General Plan Goal 1A. The amendment will allow the establishment of vocational/trade schools to serve the social needs of residents by creating opportunities for them to receive needed training and job skills necessary to secure jobs and maintain self-reliance. (2) Locating human services and jobs in proximity to residents is one of the goals of General Plan Goal 1GO). The amendment will allow vocational/trade schools to locate at existing churches and institutional facilities within existing residential neighborhoods nearby those residents in most need of access to training and job skills. Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06 Mayor and Common Council Meeting January 23, 1995 Page 3 Conditional Use Permit No. 94-06 o The conditional use permit cannot be approved unless Development Code Amendment No. 94-05 is approved and implemented. O The proposed vocational/trade school meets all the criteria that would be established under Development Code Amendment No. 94-05 and would be compatible with the surrounding residential neighborhood. O The proposed vocational/trade school includes health curriculum that generates hazardous waste in the form of syringes, needles, and blood by-products. Project conditions of approval have been added to ensure proper inventory, control and disposal of generated hazardous medical waste. O The school would target a student population from groups of people who are undereducated/underemployed, single parents receiving aid for dependent children who are possible candidates for the Gain Program, and older workers in need of retraining. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) STATUS An Initial Study was prepared by staff for both Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06. The Initial Study was presented to the Environmental Review Committee (ERC) on October 13, 1994. A Negative Declaration was proposed. The Initial Study was made available for public review and comment from October 20, 1994 until November 9, 1994. No comments were received. On November 10, 1994, the DRC/ERC cleared the project on to Planning Commission with a recommended Negative Declaration. OPTIONS AVAILABLE TO THE MAYOR AND COMMON COUNCIL: The Mayor and Common Council May: 1. Approve Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06 as requested by the applicant; or 2. Deny both Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06. Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06 Mayor and Common Council Meeting January 23, 1995 Page 4 PLANNING COMMISSION RECOMMENDATION: The Planning Commission reviewed both Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06 at the December 13, 1994 meeting and unanimously recommended that the Mayor and Common Council adopt the proposed Negative Declaration and approve Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06 based upon the Findings of Fact and Conditions of Approval. Planning Commissioners present were Affaitati, Cole, Gonzales, Kipp, Melendez, Strimpel, Thrasher, and Traver. RECOMMENDATION: It is recommended that the Mayor and Common Council: 1. Adopt the Negative Declaration; 2. Adopt the ordinance (Exhibit 3) which amends Development Code Section 19.24.020, Table 04.01 PERMITTED, DEVELOPMENT PERMITTED, AND CONDITIONALLY PERMITTED USES, adding Section 19.04.030(2)(7),and revises Table 04.03 by adding an item T, to make those standards applicable in the RU district. The amendment would apply to properties City-wide in the RU-1 and RU-2 land use districts, and; 3. SMALL LOT SUBDIVISION STANDARDS Standards for small lot subdivisions are located in Subsection N. (Planned Residential Development Standards) of this chapter. T. VOCATIONAL/TRADE SCHOOLS Vocational/trade schools are subject to a Conditional Use Permit and shall comply with the following standards: 1. Vocational/trade schools shall be permitted only at the facilities of an existing church, hospital or other not for profit organization fronting a major or secondary arterial. 2. The vocational/trade school curriculum may include GED courses, business, office and secretarial skill courses, dental or medical assistant courses, or other courses determined by the Director of Planning and Building Services to be compatible with the adjacent neighborhood. No courses in automotive repair, welding, construction, woodworking, or industrial manufacturing shall be taught due to their incompatibility with surrounding residential uses. 3. All curriculum activities shall be conducted entirely within an enclosed structure. 4. Off-street parking shall comply with the standards contained in Chapter 19.24 of this Development Code. 5. In addition to the required on-site parking, on-street parking may be permitted along the major or secondary arterial only. 6. Vehicular access to the vocational/trade school shall be restricted to the frontage along the major or secondary arterial. 19.04.040 APPLICABLE REGULATIONS All uses shall be subject to the applicable regulations of this Development Code, including, but not limited to, Ariticle IV, Administrative provisions. One of the intents of Goal lA is to provide for the development of sufficient land uses to serve educational and social needs of existing residents and population growth. The proposed amendment will further implement this goal by allowing the establishment of vocational/trade schools to serve the social needs of residents by creating opportunities for them to receive needed training and job skills necessary to obtain jobs and maintain self-reliance. Development Code Amendment Table 04.01 in Section 19.24.020, does not permit vocational/trade schools in any residential land use district. The proposed amendment would revise this section to allow vocational/trade schools in the RU district, subject to the approval of a Conditional Use Permit. Section 19.04.030(2)would also be amended,adding a subsection T establishing specific standards under which a vocational/trade school could be established. Subsection T would require that vocational/trade schools in an RU district only be permitted at the facilities of existing churches, hospitals or other non-profit organizations fronting along a major or secondary arterial. The subsection further specifies the types of courses allowed and specifies that courses must be held indoors to minimize impacts on the surrounding neighborhood. The subsection also specifies that vehicular access be restricted to the frontage along the major or secondary arterial. Table 04.03 would also be amended adding item T to make the standards applicable in the RU district. The proposed amendment has been included as Attachment B. The lined-out items are changes that have occurred since the Initial Study was prepared. ANALYSIS-CONDITIONAL USE PERMIT Proposal The applicant proposes to establish a vocational/trade school at the site of an existing church under the provisions of proposed Development Code Amendment No. 94-05. The school would offer vocational courses in the health field; medical assistant, phlebotomy/lab assistant, pharmacy technician, radiology (limited - no radiology equipment would be on-site at the church), ( Development Code Amendment No. 94-05 Conditional Use Permit No. 94-06 Agenda #4 Hearing Date: 12-13-94 Page 3 echocardiograph technician, home health care, and veterinary assistant. G.E.D. classes and English as a Second Language (E.S.L.) classes would also be offered. The school would offer day classes Monday through Friday from 8:00 a.m. to 1:00 p.m. for up to eighty students and evening classes from 5:00 p.m. to 10:00 p.m. for up to eighty students. Church activities would be limited to Saturday and Sunday only. The school would target a student population primarily from groups that consist of people in need who are undereducated/unemployed, single parents receiving aid for dependent children who are possible candidates for the Gain Program, and older workers in need of retraining. Permitted Use Under Development Code Amendment No. 94-05, the proposed vocational/trade school would be a permitted use, subject to the approval of a Conditional Use Permit. Site and Area Characteristics The 1.09 acre site is irregularly-shaped and located on the west side of"G" Street, between 10th Street and 11th Street in the RU-2, Residential Urban land use district. The site has frontage along two secondary arterial streets, "G" Street and 10th Street. The site "wraps around" a single-family residence located on the west side of"G" Street, 48 feet south of 11th Street. The site is presently developed with two church buildings constructed in the 1950's and 1960's under CDP No. 50, CDP No. 89 and CDP No. 398. The square footage of the buildings total 33,181 square feet. The two-story building nearest the corner of 10th Street and "G" Street contains several classrooms that were formerly used to house an elementary and secondary school (K through 12) by the First Baptist Church who previously occupied the site. The proposed vocational/trade school would occupy the classrooms formerly associated with the school. Church parking is located on a 0.94 acre parcel across from the church on the south side of 10th Street, between "G" Street and Crescent Street, in the RM, Residential Medium land use designation. The vocational/trade school would also use this parking lot. Surrounding land uses include a mixture of older single-family homes, two single-family homes on one lot, duplexes and apartments. Compatibility The proposed vocational/trade school will be compatible with the surrounding residential land uses. Vehicular access has been restricted to 10th Street which is identified by the General Plan as a secondary arterial street. All classes will be held within the existing classrooms contained Development Code Amendment No. 94-05 Conditional Use Permit No. 94-06 Agenda #4 Hearing Date: 12-13-94 Page 4 within the church building. Development Code and General Plan Consistency The proposal is in Compliance with the Development Code and is consistent with the General Plan as shown in Attachment Medical Waste The proposed vocational/trade school includes health curriculum that generates hazardous waste in the form of syringes, needles, and blood by-products. For the purposes of classification, laboratory waste and blood by-product waste is termed "bio-hazardous waste", while waste in the form of hypodermic needles, syringes, needles with attached tubing, etc. are termed "sharps waste". The applicant has indicated that the vocational program will generate less than 600 pounds of bio-hazardous waste and sharps waste per month. This classifies the proposed school as a "small quantity generator" under the San Bernardino County Department of Environmental Health Services (DEHS) guidelines. The applicant has also indicated that the waste will be handled and disposed of by a company licensed to dispose of such waste. However, until the company picks up the waste, a potential exists for the used needles and syringes to fall into the hands of drug users if not properly inventoried and kept secure. To ensure that there are no significant hazards as a result of the bio-hazardous and sharps waste, project conditions of approval have been added to ensure proper inventory and control of biohazardouse and sharps waste. Landscaping All landscaping is existing. The landscaping adjacent to the parking lot at the southwest corner of 10th Street and "G" is in poor repair. Project conditions of approval have been added requiring this area to be relandscaped and irrigated to ensure its viability. Parking The project meets the parking requirements specified by the Development Code. With 80 students per session (80 day/80 night), 54 parking spaces are required. The existing parking area contains 136 standard parking spaces. The Development Code requires 3 handicapped parking spaces whereas only 2 have been provided. The project has been conditioned to maintain a minimum of 3 off-street handicap parking spaces. The existing parking lot and surrounding wall structure are in extreme disrepair; the parking area r� Development Code Amendment No. 94-05 t Conditional Use Permit No. 94-06 Agenda #4 Hearing Date: 12-13-94 Page 5 is in need of resurfacing and restriping, and the wall is damaged in some areas. Project conditions of approval have been added requiring the resurfacing/restriping of the parking area and repair of the surrounding block walls. DEVELOPMENT REVIEW COMMITTEE On November 10, 1994, the Development Review Committee (DRC) reviewed Development Code Amendment No. 94-05 and Conditional Use Permit No. 94-06 and cleared them on to hearing by the Planning Commission. CONCLUSION Development Code Amendment No. 94-05 The proposed amendment will permit vocational/trade schools in the RU, Residential Urban land use district, City-wide, subject to the approval of a Conditional Use Permit. The amendment establishes specific standards for the establishment of vocational trade schools within the RU district to ensure compatibility with surrounding residential land uses. The amendment is consistent with the General Plan in that it further implements General Plan Goals lA and 1GO). Conditional Use Permit No. 94-06 With the approval, adoption and implementation of Development Code Amendment No. 94-05, the proposed vocational trade school will be permitted use in the RU-2 land use district subject to the approval of a Conditional Use Permit. The vocational/school will meet all Development Code Standards established by Development Code Amendment No. 94-05. An Initial Study for the proposal has been prepared and a Negative Declaration proposed. All impacts have been addressed through the Initial Study and project Conditions of Approval and Standard Requirements. RECOMMENDATION Staff recommends that the Planning Commission recommend that the Mayor and Common Council: 1. Adopt the proposed Negative Declaration; 2. The proposed amendment is consistent with the General Plan in that the amendment further implements the General Plan Goals 1A and 1GO). The amendment accomplishes this by by permitting the establishment of vocational/trade schools to serve the social needs of residents, creating opportunities for them to receive needed job skills, obtain jobs and maintain self-reliance. It also allows vocational/trade schools to locate at existing churches and institutional facilities within existing residential neighborhoods near those most need in need of access job training. 2. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City, in that the amendment will allow vocational/trade schools in the existing facilities of churches, hospitals, or other non-profit organizations subject to specific land use standards and the approval of a Conditional Use Permit in the RU-2, Residential Urban land use designation. ATTACHMENT E-2 CONDITIONAL USE PERMIT FINDINGS OF FACT Note: These Findings are made with the assumption that Development Code Amendment No. 94-05 is approved, adopted and implemented. 1. The proposed vocational/trade school is a conditionally permitted within, and would not impair the integrity and character of the subject land use district an complies with all of the applicable provisions of the Development Code, including compliance with Section 19.04.030(2)(7). 2. The proposed use is consistent with the General Plan, in that it is a permitted use in the RU-2, Residential Urban land use district. 3. The proposed vocational/trade school is in compliance with the requirements of the California Environmental Quality Act and Section 19.20.030(6)of the Development Code in that and Initial Study was prepared and a Negative Declaration is proposed. 4. There will be no potentially significant negative impacts upon environmental quality and natural resources that could not be properly mitigated and monitored, in that an Initial Study has been prepared for Conditional Use Permit No. 94-06, and a Negative Declaration has been proposed. The subject site is physically suitable the proposed vocational/trade school, in that the school will occupy and utilize facilities presently existing on the site, 7. There are adequate provisions for public access, water, water, sanitation, and public utilities and services to ensure that the proposed use would not be detrimental to public health and safety, in that the no all agencies responsible for providing those services have reviewed the project and none have indicated any inability to provide the necessary services. It contains an evaluation of potential adverse impacts that can occur if the proposed amendment to allow vocational/trade schools in the RU district is approved and a vocational/trade school is established at the existing church at 1024 N. "G" Street. The California Environmental Quality Act (CEQA) requires the preparation of an Initial Study when a proposal must obtain discretionary approval from a governmental agency and is not exempt from CEQA. The purpose of the Initial Study is to determine whether or not a proposal, not exempt from CEQA, qualifies for a Negative Declaration or whether or not an Environmental Impact Report (EIR) must be prepared. PROJECT DESCRIPTION Development Code Amendment No. 94-05 Development Code Amendment No. 94-05 is a request to amend the Development Code to allow vocational/trade schools in the RU, Residential Urban land use district. Specifically the proposal would amend Development Code Section 19.24.020 , Table 04.01 PERMITTED, DEVELOPMENT PERMITTED, AND CONDITIONALLY PERMITTED USES, to allow vocational/trade schools as a conditionally permitted use in the RU district. The amendment would also add a subsection T to Section 19.04.030(2), LAND USE SPECIFIC STANDARDS, to establish the specific development standards under which a vocational/trade school could be established in an RU district and Table 04.03 to make those standards applicable in the RU district. Conditional Use Permit No. 94-05 Conditional Use Permit No. 94-06 is an application to establish a vocational/trade school at the site of an existing church. The vocational/trade school would offer the following vocational courses in the health field; medical assistant, phlebotomy/lab assistant, pharmacy technician, radiology (limited-no radiology equipment would be on-site at the church), echocardiograph technician, home health care, and veterinary assistant. G.E.D. classes and English as a Second Language (E.S.L) classes would also be offered. The vocational/trade school would offer day classes Monday through Friday from 8:00 a.m. to 1:00 p.m. for up to eighty (80) students, and evening classes from 5:00 p.m. to 10:00 p.m. for up to eighty students. The school would target a student population primarily from groups that consist of people in need who are undereducated/unemployed, single parents receiving aid for dependent children who are possible candidates for the Gain Program, and older workers in need of retraining. Church activities would occur on Saturday and Sunday only. 2. SITE AND AREA CHARACTERISTICS Development Code Amendment No. 94-05 The Development Code Amendment would apply to all properties that: • are within the City of San Bernardino's jurisdictional limits; • are located within the RU-1 and RU-2 land use districts; City of San Bernardino Environmental Impact Checklist Page 4 O are existing established facilities of churches or other non-profit organizations; and O have frontage on a major or secondary arterial. There are currently 33 appropriately zoned areas throughout the City that have the potential to meet these criteria. These areas comprise approximately 2,135.8 acres (3.3 square miles) of the City or approximately 6% of the total area within the City. Conditional Use Permit No. 94-06 The 1.09 acre site is irregular in shape, and is located on the west side of "G" Street, between 10th Street and 11th Street in the RU-2, Residential Urban land use district. The site has frontage on two secondary arterials, "G" Street and 10th Street. The site "wraps around" a single family residence located on the west side of "G" Street, approximately 48 feet south of 11th Street. The site is developed with two church buildings totalling 33,181 square feet. The two story building located nearest to the corner of 10th Street and "G" Street contains several classrooms that were formerly used as an elementary and secondary school (K through 12) by the First Baptist Church who previously occupied the site. The proposed vocational trade school i would occupy the classrooms formerly associated with the school. Church parking is located on the 0.94 acre parcel across from the church on the south side of 10th Street, between "G" Street and Crescent Street, in the RM, Residential Medium Iand use designation. The vocational/trade school would also use this parking lot. Surrounding land uses include a mixture of single-family homes, two single-family homes on one lot, duplexes and apartments. 3. ENVIRONMENTAL SETTING Development Code Amendment No. 94-05 The amendment would be applicable only to those projects meeting the criteria listed under Section 2, above. The environmental setting will be dependent on the individual project location as determined by any future conditional use permit applications. Conditional use permit applications meeting the conditions established by this amendment and environmental issues are such that they will be addressed with each individual application submittal. Conditional Use Permit No. 94-06 The site is located in an area identified by the General Plan as being potentially susceptible to liquefaction, and as being located in the Urban Archaeological District. j' City of San Bernardino Environmental Impact Checklist Page 5 4. SUMMARY Development Code Amendment No. 94-05 applies to the existing facilities of churches and non-profit organizations in the RU zoning designation. As such, the proposals will not result in any new development. In those areas where potential impacts may occur (air emissions, tree removal, man-made hazards, and traffic) proposals under the amendment would be subject to review under CEQA and may be conditioned to reduce or eliminate impacts as necessary. Conditional Use Permit No. 94-06 includes a health training curriculum that will generate, store and dispose of hazardous bio waste in the form of syringes, needles and blood by-products. The project will be conditioned to prepare a Medical Waste Management Plan, and to maintain proper containment and storage requirements consistent with state law and County Department of Environmental Health Services (DEHS) requirements. Conditional Use Permit No. 94-06 The church is located within an area identified in the General Plan as having a high to medium high potential for liquefaction. However, the building that will be used for the vocational/trade school is existing. The proposal does not involve any new construction. Potential impacts are not significant. 2. Air Resources Development Code Amendment No. 94-05 a-b. Development Code Amendment No. 94-05 could result in the establishment of vocational/trade schools in existing facilities with curriculum courses that could have the potential to impact air emissions or create objectionable odors. Individual projects proposed under the amendment would be subject to review under the provisions of CEQA and conditioned to as necessary to prevent significant impacts, once submitted. C. Some of the areas designated RU that would be affected by the proposed amendment are located within the high wind area as identified in the General Plan. However, proposals under the amendment are dependent upon existing development, and will have no significant environmental effects. 3. Water Resources Development Permit No. 94-05 Since all potential sites affected by the proposed amendment are already developed, there will be no significant change in absorption rates, drainage patterns, or the rate and amount of surface runoff due to impermeable surfaces. Likewise, the amendment would not change the course or flow of flood waters or the quality or quantity of groundwater. City of San Bernardino Environmental Impact Checklist Page 18 4. Biological Resources Development Code Amendment No. 94-05 a-d. Since all areas to which Development Code Amendment No. 94-05 is applicable have been developed, the amendment will not result in new development in the Biological Resources Management Overlay, even though the sites may be located within the overlay. As a result, the amendment will not result in any change in the number of any unique, rare or endangered plants, animals or their habitats. The amendment does not include the removal of any trees of any size. If, however, a proposal under the amendment included any proposal for the removal of any tree it would be subject to review under the provisions of CEQA and conditioned to as necessary to prevent significant impacts, once submitted. S. Noise Development Code Amendment No. 94-05 a-b. The amendment requires all curriculum activities to be conducted entirely within an enclosed structure to minimize any impacts to noise sensitive land uses. Potential impacts are not significant. Land Use Development Code Amendment No. 94-05 a-c. The amendment does not propose any change in land use as designated in the General Plan. Since the proposed amendment applies only to those properties already developed with a church or other non- profit facilities, it will not result in any new development within the Airport District or Foothill Fire Zones. 7. Man-Made Hazards Development Code Amendment No. 94-05 a-c. Vocational/trade schools with curriculum involving the use, storage, transport or disposal of hazardous or toxic materials could be proposed under the amendment. Such a proposal could result in the inadvertent release of hazardous substances associated with such a curriculum and/or the potential exposure of people to health/safety hazards. However, individual projects proposed under the amendment would be subject to review under the provisions of CEQA and conditioned as necessary to prevent significant impacts, once submitted. Conditional Use Permit No. 94-06 The proposed vocational/trade school includes health curriculum that generates hazardous waste in the form of syringes, needles, and blood by-products. For the purposes of classification, laboratory waste and blood by product waste is termed "bio-hazardous waste", while waste in the form of hypodermic needles, syringes, needles with attached tubing, etc. are termed "sharps waste". The applicant has indicated that the vocational program will generate less than 600 pounds of bio-hazardous ,. City of San Bernardino Environmental Impact Checklist Page 19 waste and sharps waste per month. This classifies the proposed school as a "small quantity generator" under the San Bernardino County Department of Environmental Health Services (DEHS) guidelines. The applicant has also indicated that the waste will be handled and disposed of by a company licensed to dispose of such waste. However, until the company picks up the waste, a potential exists for the used needles and syringes to fall into the hands of drug users if not properly inventoried and kept secure. To ensure that there are no significant hazards as a result of the bio-hazardous and sharps waste, the project will be conditioned as follows: Hazardous Waste Management Plan 1. The applicant shall contact DEHS with regard to setting up the vocational schools on-site medical waste management program. Although the school is not required to register with DEHS as a medical waste generator, the school shall prepare a Medical Waste Management Plan and maintain the document on-site for review by DEHS personnel or inspector. Containment Requirements for Medical Waste 2. Medical waste shall be contained and stored separately from other waste at the point of origin. 3. Bio-hazardous waste shall be contained in red bio-hazardous bags. The bags must meet certain testing requirements and be labeled "Bio-hazardous Waste" or have the international biohazard symbol and the word "Biohazard." Sharps waste shall be contained in rigid, puncture-resistant, leak-resistant containers, and labeled "Sharps Waste", or "Biohazard" with the international biohazard symbol. 5. Red biohazard bags shall be securely tied and placed in rigid containers for storage, handling* and transport. 6. Sharps containers may be placed in red bio-hazard bags. 7. Once bio-hazardous waste is placed into a red biohazard bag, it shall not be removed from the bag until treatment is completed. Storage Requirements for Medical Waste 8. Bio-hazardous waste may be stored for seven (7) days above 0 degrees Celsius. Bio-hazardous waste shall not be stored above 0 degrees Celsius for more than (7) days. Shorter times may be required by the local enforcement agency if odor poses a public nuisance. 9. Bio-hazardous waste may be store for ninety (90) days below 0 degrees Celsius. 10. Approval for a longer storage time shall be requested in writing to DEHS. No storage of bio- hazardous waste for periods longer than ninety (90) days shall occur without specific approval of DEHS. 11. Storage areas for bio-hazardous waste shall be secured to deny access to unauthorized persons. 12. Storage areas for bio-hazardous waste shall be marked with warning signs on/or adjacent to exterior doors, gates, or lids. 13. Storage areas for bio-hazardous waste shall be posted with signs written in English and Spanish reading "Caution - Bio-hazardous Waste Storage Area - Unauthorized Persons Keep Out!" and "Cuidado- Zona de residuos - Biologicos Peligrosos - Prohibida la Entrada a Personas no Autorizadas." Signs shall be legible from a distance of at least twenty-five (25) feet. 14. Bio-hazardous waste shall be protected from animals, vermin, and natural elements. 8. Housing Development Code Amendment No 94-05 a-b. The amendment relates only to a change in permitted use in a church or other not-for-profit facility. Transportation/Circulation Development Code Amendment No. 94-05 a-h. Individual projects proposed under Development Code Amendment No. 94-05 would be subject to review under the provisions of CEQA. The City Traffic Engineer will review all such projects on a case-by-case basis for impacts. Projects would be conditioned to as necessary to prevent significant traffic impacts, once submitted. Conditional Use Permit No. 94-06 a-h. The City Traffic Engineer has reviewed the proposal and has determined that the additional vehicle trips resulting from the establishment of the use will not cause any significant impact on the adjoining street system. Total traffic volume will be less than the street design capacity. 10. Public Services Development Code Amendment No. 94-05 The amendment will not have a significant impact on any public service as the amendment allows a change in permitted use at existing churches and non-profit facilities. 11. Utilities Development Code Amendment No. 94-05 a-b. The proposed amendment will not have an impact on any public utility, nor will it create the need for new facilities as the amendment applies to existing development. 12. Aesthetics Development Code Amendment No. 94-05 a-b. Since the amendment is limited to existing churches and non-profit facilities, there will be no significant impact on aesthetics.The site is industrial in nature and does not include any scenic views. 13. Cultural Resources Development Code Amendment No. 94-05 -b. The amendment will only apply to existing developed sites, therefore it will not impact the Urban Archaeological District as identified in the General Plan. Conditional Use Permit No. 94-06 a. The site is located in the Urban Archaeological District. Mandatory Findings of Significance a-d. Screening and sign regulations compliance are important considerations to the developer because they will delay the issuance of a Certificate of Occupancy until they are complied with. Any exterior structural equipment, or utility transformers, boxes, ducts or meter cabinets shall be architecturally screened by wall or structural element, blending with the building design and include landscaping when on the ground. 7. The developer is to submit a complete master landscape and irrigation plan (five copies) to the Public Works Department with the required fee for review.
