STAFF REPORT
SUBJECT:
Resolution awarding contract to Silvia Construction, Inc. for the rehabilitation of Mill Street between
Meridian Avenue and Macy Street per Plan No. 9922.
BACKGROUND:
At the meeting of January 25, 1999, the Mayor and Common Council approved Plan No. 9922 for the
rehabilitation of Mill Street from Meridian Avenue to Macy Street and authorized the Director of
Development Services to advertise the project for bids.
This project consists of cold milling (grinding) the existing pavement, overlay with 1.5" of rubberized asphalt
concrete pavement, construction of three handicap ramps, restriping, and replacement of traffic signal loop
detectors. Bids were received on April 6, 1999 from 7 companies. Silvia Construction, Inc. of Rancho
Cucamonga submitted the low bid in the amount of$116,912.65. The projected date for the contract to begin
is June 1, 1999, with an estimated completion date of July 30, 1999.
Below is the estimated total project cost based on the low bid:
Construction Contract: $116,912.65
Engineering (W.O. 7124) $ 8,474.00
Contract Administration $ 11,613.35
Subtotal $137,000.00
Contingencies (10% ±) $ 13,000.00
CONSTRUCTION TOTAL $150,000.00
FINANCIAL IMPACT:
Funding for this project is contained in the adopted Capital Improvement Program budget under account 129-
367-5504-7124.
RECOMMENDATION:
Adopt Resolution.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
3 CONTRACT TO SILVIA CONSTRUCTION, INC. FOR REHABILITATION OF MILL
STREET FROM MERIDIAN AVENUE TO MACY STREET PER PLAN NO. 9922.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. SILVIA CONSTRUCTION, INC. is the lowest responsible bidder for
7
Rehabilitation of Mill Street"from Meridian Avenue to Macy Street per Plan No.9922. A
8
9 contract is awarded accordingly to said bidder in a total amount of$116,912.65 but such award
10 shall be effective only upon being fully executed by both parties. All other bids, therefore, are
11 hereby rejected. The Mayor is hereby authorized and directed to execute said contract on
12 behalf of the City; a copy of the contract is on file in the office of the City Clerk and
13
incorporated herein by reference as fully as though set forth at length.

15 SECTION 2. This contract and any amendment or modifications thereto shall not take
16 effect or become operative until fully signed and executed by the parties and no party shall be
17 obligated hereunder until the time of such full execution. No oral agreements, amendments,
18 modifications or waivers are intended or authorized and shall not be implied from any act or
19
course of conduct of any party.

21 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
22 within sixty (60) days of the passage of the resolution.
