Description) Renovation of Nunez Plunge Finance: Council Notes: Agenda Item No. �� CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution Awarding Contract to California Commercial Pools, Inc. for the Renovation of Nunez Municipal Pool located at 1717 West Fifth Street per Plan No. 9943. Background: The Director of Parks and Recreation proposed this project for CDBG funding in the 1996 cycle and received an allocation of$236,000. In February of 1999, a reallocation of CDBG funds was made and an additional $230,000 was allocated bringing the total available funding for this project to $466,000. The primary objective of the project was to correct a 40,000 gallon per day leak due to deteriorated plumbing. In the process of developing the project, several other design issues were identified in this 1950s facility: • Lack of wall circulation system as required by current design codes • Existing spit gutter is no longer permitted for new construction • A 6" curb surrounding the pool creates a trip hazard as well as creating great difficulty for bathers to exit the pool • The shallow end is not user friendly for young children • The entry steps are hazardous • The wading pool does not have a circulation system In addition to the above issues, the new design provides for water features that will enhance the water experience for both children and adults. See attached Exhibit "A" for location. Bids for construction of the project were received on May 11, 1999. Bids ranged from $442,000 to $624,000 with the lowest bid being submitted by California Commercial Pools, Inc. The estimated total project cost is as follows: Construction Contract: $442,000 Professional Design Contract (Ken King) $ 16,000 Engineering Labor Charges (W.O. 5030) $ 9,500 Inspection/Contract Administration 22,500 Subtotal: $490,000 Contingencies (10%) 44,000 Grand Total: $534,000 The Department of Parks and Recreation has requested that the project not be started prior to September 7, 1999 so as not to interfere with the Park's summer programs. If the contractor starts in September 1999, then the project could be completed as early as December 1999. FOR THE RENOVATION OF NUNEZ MUNICIPAL POOL LOCATED AT 1717 WEST FIFTH 4 STREET PER PLAN NO 9943. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 6 CITY OF SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. CALIFORNIA COMMERCIAL POOLS, INC. is the lowest responsible 8 bidder for the Renovation of Nunez Municipal Pool per plan no. 9943. A contract is awarded 9 accordingly to said bidder in a total amount of $442,000.00 but such award shall be effective 10 only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. 11 The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a 12 13 copy of the contract is on file in the office of the City Clerk and incorporated herein by 14 reference as fully as though set forth at length. 15 SECTION 2. This contract and any amendment or modifications thereto shall not take 16 effect or become operative until fully signed and executed by the parties and no party shall be 17 obligated hereunder until the time of such full execution. No oral agreements, amendments, 18 19 modifications or waivers are intended or authorized and shall not be implied from any act or 20 course of conduct of any party. 21 SECTION 3.
