HomeMy WebLinkAboutS2- Resolution 1 2 RESOLUTION NO. 3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 4 BERNARDINO URGING THE RETENTION OF THE FEDERAL BANKRUPTCY COURT IN THE CITY OF SAN BERNARDINO. 5 6 WHEREAS, the Federal Building which houses the Federal 7 Bankruptcy Court and is located at 699 North Arrowhead Avenue, 8 in the City of San Bernardino has approximately 72 employees 9 therein; and 10 WHEREAS, the surrounding offices of attorneys, trustees 11 and other related personnel provide approximately 100 to 125 12 jobs in the downtown area of San Bernardino; and 13 WHEREAS, the presence of the Bankruptcy Court in San 14 Bernardino has brought prestige to the City of San Bernardino 15 and has significantly added to the quality and competence of 16 the local bar and bench; and 17 WHEREAS, the present lease for the Bankruptcy Court in 18 San Bernardino expires in May of 1994 and the Bankruptcy Court 19 and appropriate federal agencies are considering alternative 20 sites for the location of the Bankruptcy Court, including a 21 site in the City of Riverside; and 22 WHEREAS, retaining the Federal Bankruptcy Court in the 23 City of San Bernardino is important to the economy of the City of San Bernardino and will significantly contribute to and 24 provide further impetus for the Law and Justice Center of the 25 City of San Bernardino which can include the future site for 26 the new Federal District Court facility; and 27 28 WHEREAS, the City of San Bernardino recognizes that in � l � RE: FEDERAL BANKRUPTCY COURT IN THE CITY OF SAN BERNARDINO 1 making a decision regarding the location of the Federal 2 Bankruptcy Court there are certain needs and specifications 3 that must be satisfied so that the Bankruptcy Court facility 4 will have adequate space, parking, security and amenities 5 befitting a Federal Court; and 6 WHEREAS, the City of San Bernardino further recognizes 7 that effective communications with the local Bankruptcy 8 Judges, the Bankruptcy Clerk and other employees is necessary 9 so that their needs can be clearly identified for the purpose 10 of structuring proposals for retaining the Bankruptcy Court in 11 San Bernardino which can gain their support and approval; and 12 WHEREAS, the City of San Bernardino is in the process of 13 formulating a written proposal which will set forth three or 14 more potential sites for retaining the Bankruptcy Court in the 15 City of San Bernardino, one of which proposals will be the 16 Current location with improved parking, additional space and 17 improved security; and 18 WHEREAS, additional law enforcement presence in the 19 immediate area of the Bankruptcy Court will be made available 20 for the purpose of providing additional security to the 21 employees of the Court and the public who frequent the Court; 22 and 23 WHEREAS, the City of San Bernardino will also develop 24 additional programs and procedures for assuring the safety of 25 those persons who frequent the Court, revitalizing the area of 26 the community adjacent to the Court and assuring quick and 27 effective response to any incidences that arise at or near the 28 -2- RE: FEDERAL BANKRUPTCY COURT IN THE CITY OF SAN BERNARDINO 1 vicinity of the Court; and 2 WHEREAS, there is a strong and compelling basis for 3 retaining the Bankruptcy Court in the City of San Bernardino, 4 including the following: (i) the City of San Bernardino is the 5 most convenient location of the Court, taking into account the 6 number of bankruptcy filings in the San Bernardino County and 7 filings in the Palm Springs/Beaumont/Banning areas where 8 access to San Bernardino is more convenient than Riverside, 9 and (ii) there is larger growth expected in the next five to 10 six years in the City and County of San Bernardino as compared 11 to the City of Riverside and immediate areas. 12 NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: 13 SECTION ONE: That by the Mayor and Common Council of the 14 City of San Bernardino, the City of San Bernardino and its 15 staff are directed to communicate with the local Bankruptcy 16 Judges and Bankruptcy Court Clerk to determine their needs and 17 specifications for retaining the Bankruptcy Court in San 18 Bernardino. 19 SECTION TWO: That the City of San Bernardino will use its 20 best efforts to provide a first class site and facilities for 21 the Bankruptcy Court to assure the continued and future 22 location of the Federal Bankruptcy Court in the City of San 23 Bernardino where said Court will meet the public needs in the 24 most economical, safe and convenient way. 25 SECTION THREE: That the City of San Bernardino will also 26 use its best efforts to formulate and develop a first class 27 site and facilities in the City of San Bernardino for the 28 -3- RE: FEDERAL BANKRUPTCY COURT IN THE CITY OF SAN BERNARDINO 1 future location of a federal District Court and other Federal 2 agencies which would be housed in a local Federal Building. 3 I HEREBY CERTIFY that the foregoing resolution was duly 4 adopted by the Mayor and Common Council of the City of San 5 Bernardino at a meeting thereof, held on the 6 day of 1993 , by the following vote, 7 to-wit: 8 Council Members: AYES NAYS ABSTAIN ABSENT 9 ESTRADA 10 REILLY 11 HERNANDEZ 12 MAUDSLEY 13 MINOR 14 POPE-LUDLAM 15 MILLER 16 17 18 Rachel Clark, City Clerk 19 The foregoing resolution is hereby approved this day 20 of , 1993 . 21 22 23 W.
