Synopsis of Previous Council action:
11-21-88 Authorization to proceed with the formation of an Underground Utility
Assessment District was granted and Resolution No. 88-440 was adopted,
setting a Public Hearing for 01-03-89.
01-03-89 Public hearing was held relative to formation of Underground Utility
District.
06-05-89 Resolution No. 89-171 was adopted, creating Underground Utility Assessment
District No. 19
04-06-92, 06-16-92, 07-09-92 Authorization to proceed was given to cause the
undergrounding of certain parcels located within Underground Utility

STAFF REPORT
The attached resolution accepts the Report of Costs relative to work contracted
by the City for underground utility conversions on the respective parcels within
Underground utility District No. 19, and sets the date for a public meeting and a
public hearing, as required law. The meeting is only for discussion purposes and
no action regarding the assessments can be taken until the protest hearing. These
actions are necessary in order for the City to recover the costs of contracting
the work and the adoption of the resolution is therefore recommended.
On November 21, 1988, this office was authorized to proceed with the formation of
Underground Utility Assessment District No. 19 along Waterman Avenue, between 9th
Street and the Santa Ana River.
All property owners in the district and all affected utilities were notified and
a public hearing was held on January 3, 1989. On June 5, 1989, Resolution No. 89-
171 was adopted, creating Underground Utility Assessment District No. 19.
Notice to convert was given to all property owners within Zones 1,2 and 3 of the
district. Pursuant to S.B.M.C. Section 13.060.090, any work not performed within
the prescribed time can be caused to be completed by the Director of Public
Works/ City Engineer.
On 04-06-92, 06-15-92 and 07-09-92, the Director of Public Works/City Engineer
was authorized to proceed with causing the necessary work to be done within Zone
3, Zone 2 and Zone 1 respectively, on those parcels where their respective owners
had not completed the necessary work. The cost for completing the necessary work
was paid for out of the Assessment District Reserve fund, which will then be
reimbursed through assessments collected on the property tax rolls.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO ACCEPTING THE REPORT FROM THE
DIRECTOR OF PUBLIC WORKS/CITY ENGINEER AND SETTING A TIME AND PLACE FOR A
3 PUBLIC MEETING AND A PUBLIC HEARING TO CONFIRM ASSESSMENTS RELATIVE TO
UNDERGROUND UTILITY DISTRICT NO. 19, ALONG PORTIONS OF WATERMAN AVENUE.
4 WHEREAS, on the 5th day of June, 1989, under the provisions of Chapter
5 13.36 of the San Bernardino Municipal Code, the Mayor and Common Council of
6 the City of San Bernardino adopted Resolution No . 89-171 , creating
7 Underground Utility Assessment District No. 19, along portions of Waterman
8 Avenue, between 9th Street and the Santa Ana River; and
9 WHEREAS, all owners owning property within said Underground Utility
10 Assessment District were given Notice to convert all overhead utilities to
11 underground; and
12 WHEREAS, on the 6th day of April, 1992 and on the 15th day of June,
13 1992 and on the 9th day of July, 1992, the Mayor and Common Council
14 authorized and directed the Director of Public Works/City Engineer to cause
15 the installation of underground utilities on certain parcels within said
16 district.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SA
18 BERNARDINO AS FOLLOWS:
19 SECTION 1. That the Mayor and Common Council do hereby accept the
20 Report of Costs as submitted by the Director of Public Works/City Engineer,
21 attached hereto as Exhibit "A" and incorporated by reference as fully as
22 though set forth in length herein, for the installation of underground
23 utilities, and appurtenant facilities for certain parcels within Underground
24 Utility Assessment District No. 19.
25 SECTION 2. NOTICE is hereby given that a public meeting will be held by
26 the Mayor and Common Council of the City of San Bernardino on Monday, May
27 10, 1993 at 10:00 a.m. in the Council Chambers, City Hall, 300 North "D"
28 Street, San Bernardino, to discuss the matter and that a public hearing will
