Financial Impact:
The Department is requesting to increase the contract with Willdan Engineering by
$350,000.00
The Department would like to increase the contract using the following accounts: 772-
2306-192, 772-2306-193, and 001-180-5502. There are sufficient funds between these
accounts in the budget, no additional funds are being requested.
Motion: Adopt the Resolution.
Synopsis of Previous Council Action:
September 2, 2014 Council adopted Resolution 2014-327 approving a
Consultant Services Agreement with Willdan Engineering
and CSG Consultants for Plan Review, Inspection,
Stormwater Management, Fire and Life Safety Plan Review,
Building Official, and Counter Services.
October 20, 2014 Council adopted Resolution 2014-366 approving an
amended Consultant Services Agreement with Willdan
Engineering for Plan Review, Inspection, Stormwater
Management, Fire and Life Safety Plan Review, Building
Official, and Counter Services (Amendment No. 1).
February 17, 2015 Council adopted Resolution 2015-28 approving an amended
Consultant Services Agreement with Willdan Engineering for
unreinforced masonry (URM) and building inspections
(Amendment No. 2).
Background:
On September 2, 2014, the Mayor and Council approved Resolution 2014-327
authorizing the execution of an agreement and issuance of a Service Agreement to
provide Plan Review, Inspection, Stormwater Management, Fire and Life Safety Plan
Review, Building Official, and Counter Services for an amount not to exceed $355,000.

The Community Development Department strives to provide next day building
inspections for all projects. The Department achieves that goal over 90% of the time.
However, in order to achieve that goal there is a need to supplement the three full-time
in house building inspectors and additional contract inspectors through Willdan
Engineering.
Additionally, Willdan Engineering provides building and on-site engineering plan review
and building official services. The Department has one full-time on-site engineering plan
reviewer on staff. On-site Engineering plan review responsibilities are shared between
the staff member and Willdan Engineering. Building plan review is processed entirely
through Willdan Engineering. Over the past several months the Department has had to
rely more heavily on Willdan Engineering for services due to the staff turnover, the
lengthy recruitment process and an employee's long-term medical leave.
The Department is requesting an amendment to the contract in the amount of $350,000
from account numbers 001-180-5502, 772-2306-192, and 772-2306-193, which brings
the total contract amount to $705,000. The plan check fees are paid by the customer
and placed in a trust account set aside to pay Willdan Engineering. Plan check fees are
not paid from the general fund. This request is for an increase in the contract amount
only, not to the Department budget.

rescinded if the agreement is not executed and returned to the Office of the City Clerk within 0

AMENDMENT NUMBER THREE TO CONSULTANT SERVICES AGREEMENT WITH
WILLDAN ENGINEERING
THIS AMENDMENT NUMBER THREE TO CONSULTANT SERVICES AGREEMENT
WITH WILLDAN ENGINEERING ("Amendment") is made between Willdan Engineering
("Company")and the City of San Bernardino(The "City")on March 21,2016.
WHEREAS,the parties wish to amend the Consultant Services Agreement that was entered into
on October 20,2014 ("Agreement")to increase the total amount to cover the services requested for
Community Development Services;
NOW THEREFORE, in consideration of the foregoing and for other good and valuable
consideration the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as
follows:

1. This Amendment is made with respect to the following facts and purposes: o
