On February 3, 1993, the Mayor and Common Council imposed new contract terms and conditions on Police Safety Employees. Description) Finance: Council Notes: 75.0262 Agenda Item No. �� CITY OF SAN BERNAf LINO - REQUEST FO'- COUNCIL ACTION STAFF REPORT On July 16, 1990, the Mayor and Common Council established the street lighting and street sweeping assessment district. As part of the establishment of the district, a determination was made to utilize the General Fund dollars which were previously obligated to fund street lighting services for law enforcement services. A commitment was also made in the first year of this program to use a portion of these monies to enhance police benefits. The San Bernardino Police Officers' Association (SBPOA) decided on a goal of establishing a trust fund for retired Police Safety Employees. The amount transferred to the trust fund will total $438,126. The purpose of the Trust Fund is "providing and paying . . . pursuant to the SBPOA Medical Premium Reimbursement Plan . . . a portion of the premium for coverage in an established health plan for certain retired employees of the San Bernardino Police Department who retired with 20 years of service on or after July 1, 1990." SBPOA has agreed to establish a cap for premium payments. Participation in the Trust Fund will be voluntary. New officers will be eligible to sign up for the Trust Fund during an 18-month "window period," which begins after 12 months of service and continues for another 18 months until they reach their "D" step as a Police Officer. On February 3, 1993, the Mayor and Common Council imposed new contract terms and conditions on Police Safety Employees. The terms and conditions included language on "New Employees - POA Trust Fund," stating that: "Within one (1) month of completion and ratification of rules, regulations and bylaws for the Trust Fund, an agreed-upon date will be set to meet and confer on New Employees - POA Trust Fund." The City has held three (3) meet and confer sessions with the San Bernardino Police Officers' Association on the POA Trust Fund: May 21, 1992; January 29, 1993; and, February 12, 1993. The Finance Department will designate one (1) employee to serve as a member of the Board of Directors. However, SBPOA will be responsible for orienting new officers about the Trust Fund, forwarding payroll deduction forms to the Finance Department and tracking members' deductions. The Finance Department has recommended that SBPOA select a third-party administrator for the Trust Fund. The monies will be transferred from the City to the third-party administrator for the POA Retirement Trust Fund Agreement. 75-0264 RECOMMENDATION SBPOA will execute the POA Retirement Trust Fund Agreement with a third-party administrator. The City Team (Barbara Dillon, Barbara Pachon, Dan Robbins, Fred Wilson) recommends that the Mayor and Common Council adopt the attached resolution on transferring $438,126 from the City to the POA Retirement Trust Fund Agreement. AG ENDA:REV.POA.TRUST 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE TRANSFER OF FUNDS CURRENTLY HELD IN THE POLICE OFFICERS ' 3 ASSOCIATION TRUST ACCOUNT TO THE SAN BERNARDINO POLICE OFFICERS ' ASSOCIATION FOR THE ESTABLISHMENT OF THE SBPOA RETIREMENT TRUST. 4 WHEREAS, by Resolution No. 90-207, the Mayor and Common 5 Council resolved to set aside certain funds from the street 6 lighting assessment district for law enforcement purposes; and, 7 WHEREAS, a commitment was made in the first year of the 8 assessment district program to use a portion of the monies so 9 collected to enhance police benefits; and, 10 WHEREAS, after meeting and conferring with the San 11 Bernardino Police Officers' Association ( "SBPOA" ) , it was agreed 12 that the SBPOA Retirement Trust ( "Trust" ) would be established by 13 the SBPOA to provide medical benefits to retired police safety 14 employees; and, 15 WHEREAS, the City has set aside in an account known as the 16 SBPOA Trust Account the sum of $438, 126.08 to fund said Trust; iJ BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 18 OF SAN BERNARDINO AS FOLLOWS: 19 SECTION 1. The Director of Finance is hereby authorized and 20 directed to pay to the San Bernardino Police Officers' Association 21 the sum of $438, 126.08, plus accrued interest, which has been set 22 aside in the SBPOA Trust Account, for the purpose of establishing 23 the SBPOA Retirement Trust. 24 SECTION 2.
