Description) Finance: ;ouncil Notes: 5-0262 Agenda Item No. STAFF REPORT At the recent Mexican Independence Celebration held at Seccombe Lake park and hosted by the Hispanic Chamber of Commerce, the facility suffered damage to landscaping and the irrigation system, and crews had to remove litter and make miscellaneous repairs. The sponsor had posted a damage bond of $1, 000 and a clean-up deposit of $500, but total cost for all repairs and clean up was more than $2, 000. (See attached) . In addition, policing the event required 132 hours of officers' time totaling approximately $9700 over and above the amount the sponsor agreed to pay for security. The Hispanic Chamber of Commerce received $5, 000 from the City's Civic and Promotional fund to host the event. Currently, the Parks, Recreation, and Community Services Department requires users to obtain a permit and will not approve the permit until all deposits and fees are paid. Often the bond and clean-up deposit are insufficient insurance against damage. For large events or those that generate a high level of activity (i.e. concerts) the department coordinates with the Police Department to ensure security concerns are addressed. These procedures require staff time, and when these costs are combined with repair and clean up costs that cannot be recovered from a sponsor, the amount the City must pay can be very high. As a result of these circumstances, it is recommended that the bond and deposit be adjusted based on the number of people attending the event. (See attached fee schedule) . For organizations receiving special funding from the City, it is recommended that 50% of that funding be withheld until after the event so that damage costs exceeding the bond and deposit amounts may be covered without impacting the City's budget. This policy change will protect the City from incurring repair and clean up costs associated with events held by outside organizations at City facilities, particularly for events where alcohol will be served. At the February 15, 1993 Council Meeting of the Mayor and Common Council, the issue of adjustment to damage bond and clean-up deposits was referred to the Ways and Means Committee for discussion and further recommendation. On February 24, the Committee recommended adjusting the damage bond and clean-up deposits in the amounts and methods presented and that recommendation was presented at the March 8 Council meeting at which time a public hearing was set for March 22 . A resolution is attached incorporating the adjustments and is recommended for adoption. Suttle ` Subject: After Incident Report Date: September 30, 1992 Copies: Problem On Sunday, September 20, 1992, the 3rd day of the above celebration, the crowd grew to about 6,000. A small percentage (approx. 50) teenage gang types began fighting among themselves. At approximately 2000 hours two (2) CCW (guns) arrests were made. The crowd was also unruly around the pavilion and V.I .P. area. Due to the above circumstances it was necessary to request assistance from the shift 3 Watch Commander, Lt. Kraus. Eventually eleven (11) shift 2 b 3 officers and two (2) sergeants arrived and joined the eighteen (18) officers on the detail . The additional police presence was effective and the incident was resolved without further problems. Recommendations 1. Enforce the Parks b Rec rules and regulations provided in the "Use Application/Permit . 2. Ensure the police department is notified well in advance of the event and several planning meetings are scheduled with Parks, Hispanic Chamber, and Police department representatives present. Findings In all other incidents of this nature a formal notification and or request has been made to the Department by the entity for the purposes of planning for the event. In this instance no such notification/request was made. I was advised by Lt. Farmer and Sgt. Rice the event would be held this year at Seccombe Lake Park. Formerly it had been held at Plaza or Nunez Park. On 8/21/92, 1 was able to get a copy of the Chambers' request to use the park. From this document I obtained the name and number of a contact person. Mr. Jerry Esparza advised that there would be two stages with live and recorded traditional Hispanic music, several food booths and two beer gardens. Subsequently I was contacted by Mr. Alfred Enciso who requested 6 - 8 Reserve Police Officers to act as guards on a paid basis. He was informed the Department did not provide guard service (with legal explanation). Both of the above conversations occurred on the phone about a week prior to the event. On 9/15/92 at 1622 hours, I received an urgent message from Jerry Esparza of the Chamber. I returned the call but only talked to a voice-mail machine. On 9/16/92, Mr. Esparza called me at my office. He related that the Chamber did not have sufficient funding for the necessary guard service. I advised him I planned on having twelve ( 12) officers on Friday, sixteen (16) on Saturday and Sunday during peak attendance. Further, that we would keep an eye on the beer gardens but could not provide guard service in the form of fixed posts. He agreed to placing volunteers from the Chamber at strategic locations, clearly identifiable with instructions to request help from the police if necessary. We further discussed the type of music to be played. He again stated traditional Hispanic music with some oldies over by the Miller Stage. There was absolutely no mention of Rap music. On Tuesday, 9/15/92, Casa Ramona had their 6th Annual "Castillo" 16th of September Celebration. The crowd peaked at approximately 5,000 at fireworks time. The police department had ten (10) officers in the park and Casa Ramona fielded 8 - 10 security guards. With the exception of one (1) 647f and one (1) 415 warrant arrest, there were few if any other problems. On Friday, 9/18/92, the Department placed eleven (11) officers in the park for the first evening of the "Fiesta" with no problems. Attendance was estimated at 3,000. On Saturday, 9/19/92, the Department placed eleven (11) officers in the park between 1200 - 1700 hours and seventeen (17) officers between 1700 - 2230 hours. We broke up a couple of attempted fights but otherwise no problems. On Sunday, 9/20/92, the Department placed ten (10) officers in the park between 1200 - 1700 hours. At approximately 1400 hours I was contacted by a representative of KGGI Radio Station and informed that several Rap groups would by performing during the day and evening. That same representative made numerous requests for police to act as security for the Rap groups arriving and leaving. During this time frame I noticed the composition of the crowd to change from a family oriented crowd to a crowd now consisting of gang members and others drawn by the Rap music. At 1700 hours I managed to recruit three (3) more officers and placed nineteen (19) officers in the park. I also noted there were only three (3) security officers from the chamber present. At dusk, numerous roving bans of black and hispanic youths were provoking each other and several skirmishes were broken up. At 2000 hours two (2) arrests were made of people with guns. At this time I informed Lt. Kraus of the circumstances and requested assistance from patrol . It was necessary to convert a room in the Parks & Rec building into a temporary holding area staffed by an officer. At 2130 hours eleven (11) extra patrol officers had been strategicly placed in the park. I advised both Mr. Esparza and the KGGI DJ to curtail stage activity at 2200 hours. It should be noted that the last Rap group ceased at approx. 2245 hours. However, a power shortage at approx. 2220 hours lasted about 15 minutes and contributed to much of the crowd leaving. By 2300 hours all extra patrol officers were released with the exception of two (2) shift 3 officers used to transport and lodge prisoners (4). Altogether the situation was resolved without what could have been a serious riot. The additional , rsonnel presented a very formiL.-ule force to the few troublemakers. There are several reasons for the problems experienced on Sunday but not on Tuesday, Friday, or Saturday. The Hispanic Chamber needs to provide the Department with a complete plan in the future. The introduction of Rap entertainment was a complete surprise to me. That type of entertainment totally changes the complexion of the crowd and of course the number of officers required to keep the peace. Fortunately we reacted well but definitely on an emergency basis. In future events strict adherence to the rules, regulations, City Ordinances, and applicable laws is essential if the Department is to control the event. This particular event is a good example of what happens when the rules and agreements are not enforced. 1 . The application was not signed 90 days in advance (8121192) . 2. The security clause in the application was totally violated. 3. The description of planned activities failed to mention the Rap concert or carnival game booths. 4. The amplified music went well past 2200 hours every night. 5. The Police Department and Parks Department personnel need to be involved in planning any future events. Friday's hours are 1600 - 2200, Saturday from 1300 - 2200, and Sunday from 1300 - 2200. Live and recorded music is planned for two stages in the park as well as two beer gardens where beer will be sold as well as food booths. There will also be game booths. Past experience indicates attendance at approximately 2,000 people on Friday, and 2.000 - 3,000 people on Saturday, and 4,000 people on Sunday. Law enforcement presence will be necessary for peace keeping and crowd control . Recommendations I . A minimum of 12 officers per day during peak (1700-2100 hrs. ) attendance will be sufficient. 2. Officers will patrol on foot in pairs. 3. Two (2) marked police units and one (1) un-marked area command unit will be used for transportation. 4. Findings. The Mayor and Common Council hereby 7 find: 8 A. Hearing has been held by the Mayor and Common Council 9 pursuant to the provisions of Government Code Section 54990, et 10 seq. , to consider the levy of new and additional damage bonds 11 and clean-up deposits for uses of certain Parks, Recreation and 12 Community Services Department buildings, facilities and 13 equipment, which hearing was held following public notice 14 published in a newspaper of general circulation in the City of 15 San Bernardino. 16 B. The proposed damage bonds and clean-up deposits are 17 for the purpose of offsetting potential costs for repair or 18 replacement of damaged equipment or facilities and for providing 19 personnel services for clean-up of buildings or facilities. 20 Bonds and deposits are refundable in full or in part after an 21 inspection of building facilities and equipment has been 22 completed. Deductions for any damages to facilities or for 23 clean-up or repairs shall be deducted from said bond or deposit. 24 C. Policy. Public parks and recreation 6 buildings and swimming pools, under the jurisdiction of the 7 Parks, Recreation and Community Services Department, are public 8 property and as such are available for use by any person or 9 persons in accordance with the following specifications and as 10 deemed appropriate by the Director. 11 SECTION 3 . Procedure. The facilities and equipment 12 shall be used only for those meetings and activities pursuant to 13 City Municipal Code 12 .80. Any person, persons, or groups of 14 persons desiring the use of any facilities or equipment shall 15 make application on forms provided by the Parks, Recreation and 16 Community Services Department and shall provide such additional 17 information as may be required to assure compliance with City 18 Municipal Code 12 .80. 19 SECTION 4 . Cancellations: Cancellations of meetings 20 and activities may occur twenty-four (24) hours prior to 21 scheduled use of facilities or equipment without forfeiting any 22 fees and/or deposits collected by the Department. AMENDMENT. SECTION 6, Resolution 91-35, is 5 amended by adding a damage bond and clean-up deposit schedule as 6 follows: 7 "SECTION 6. Refundable Damage Bonds and Clean-Up Deposits. 8 A. Refundable damage bonds and clean-up deposits shall be 9 required for all special events, athletic events, 10 fundraisers and other events which warrant such bonds 11 and deposits based on specific numbers of people and 12 uses of facilities and equipment.
