STAFF REPORT
For many years the City has had an ordinance that has
prohibited begging, soliciting and advertising in certain
commercial areas of the City due to the fact that pedestrian
traffic would be impeded. Since that time the commercial areas of
the City have expanded and it is necessary to protect pedestrian
traffic in these new commercial areas while not restricting the
free speech rights of individuals.
The proposed ordinance would not only expand the area to cover
the new commercial areas but would be flexible enough to cover
future commercial areas.
It is recommended that the ordinance be adopted.

SUBSECTION E OF SECTION 5.04.360 OF THE SAN BERNARDINO MUNICIPAL
3 CODE RELATING TO SOLICITING, BEGGING OR ADVERTISING ON CERTAIN
CONGESTED STREETS

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:
6 SECTION 1. Section 5.04.360 as amended by MC-937 (therein
7 described as 55.04.355 which was a second §5.04.355 ) is further
8 amended by adding subsection 9 to subsection E to read as follows:
9 119. Any street or highway within the City of San
10 Bernardino where the property adjacent thereto is
11 zoned for commercial use, or where an adjacent
1 12 business has a current business registration
)J 13 certificate issued by the City of San Bernardino. "
