COUNCIL CHAMBERS CALL TO ORDER ROLL CALL PRESENT: ABSENT: CLOSED SESSIONS 1. The Mayor and Common Council and Community Development Commission will recess to closed session for the following: a. to give instruction to the City' s/Commission' s negotiator on the purchase of property pursuant to Government Code Section 54956 .8. The real property which the negotiations concern is generally located at: b. to consider personnel matters pursuant to Government Code Section 54957; C. to meet with designated representatives regarding labor relations matters pursuant to Government Code Section 54957 . 6 d. to confer with the Chief of Police on matters posing a threat to the security of public buildings or a threat to the public ' s right of access to public services or public facilities pursuant to Government Code Section 54957; e. to confer with the attorney regarding pending litigation pursuant to Government Code Section 54956 . 9(b) ( 1) , as there is significant exposure to litigation; f. to confer with the attorney regarding pending litigation pursuant to Government Code Section 54956 .9(c) , so that Council/Commission may decide whether to initiate litigation; ,, 1 1/23/91 RECONVENE MEETING - 9 :30 A.M. ROLL CALL PRESENT: ABSENT: INVOCATION: PLEDGE: 2 . Announcements by Mayor. 3 . PUBLIC COMMENTS ON ITEMS NOT ON AGENDA: A five-minute limitation shall . apply to each member of the public who wishes to address the Mayor and Common Council on a matter not on the agenda. No member of the public shall be permitted to "share" his/her five minutes with any other member of the public. (Usually, any items received under this heading are referred to staff for further study, research, completion and/or future Council action. ) 4 . Appointments/Presentations . 5 . Service Pins Award Ceremony. (See Attached) CONSENT CALENDAR MOTION: That the motions indicated by consent calendar items 6 through 32 be adopted, except for , , , , , , and 6 . Waive further reading of resolutions and ordinances . MOTION: That further reading of all resolutions and ordinances on the regular, supplemental and Community Development Commission agendas be waived. 3 1/23/91 MOTION: That the plans for the rehabilitation of Waterman #2 Avenue, from Redlands Boulevard to Mill Street, in accordance with Plan No. 7679, be approved; and the Director of Public Works/City Engineer be authorized to advertise for bids . 11. Claims and Payroll. (See Attached) MOTION: That the claims and payrolls , and the authorization to issue warrants as listed on the memorandum dated January 15, 1991, from the Director of Finance, be approved. 12 . Personnel Actions . (See Attached) MOTION: That the personnel actions submitted by the Chief Examiner, dated January 8, 1991, in accordance with all administrative regulations of the City of San Bernardino, be approved. 13 . Joint Powers Financing Authority - Regular Meeting. MOTION: That the regular meeting of the Joint Powers Financing Authority be adjourned to February 18, 1991. RESOLUTIONS MOTION: That the following resolutions be adopted. City Clerk's Office 14. Resolution of the City of San Bernardino amending Resolution No. 82-99 entitled in part "Resolution . . amending Conflict of Interest Codes . " , by amending Appendices A and B to add, delete and change the titles of various positions within departments of the City which must file Conflict of Interest Statements. (See Attached) ,, 5 1/23/91 20 . Resolution of the City of San Bernardino authorizing the ` execution of a first amendment to lease with the National Orange Show, lessor, pertaining to a modification of the term in a lease of property to the City, and situated at the southwest corner of Mill Street and Arrowhead Avenue, in San Bernardino. (See Attached) Ward 3 21. Resolution of the City of San Bernardino amending Resolution No. 3985 entitled in part, "A resolution . . . prohibiting parking upon certain designated streets or portions thereof fl to establish a no parking any time zone on Twenty- First Street between Kenwood Avenue and Crestview Avenue, applicable to the south side only. (See Attached) Ward 2 22 . Resolution of the City of San Bernardino authorizing the execution of a joint use agreement with Southern California Edison Company, a Corporation, relating to relocation of power poles at the southeast corner of Mill Street and Pepper Avenue in connection with Review of Plans No. 89-40 (Linkletter Construction, Inc . ) . (See Attached) Ward 3 23 . Resolution of the City of San Bernardino awarding a contract to Hovey Electric, Inc. for installation of traffic signals and highway lighting at Twenty-First Street and Valencia Avenue. (See Attached) Ward .2 24 . Resolution of the City of San Bernardino making appointments in a special assessment district. (See Attached) Ward 6 25 . Resolution of the City of San Bernardino passing on the "Report" of the Engineer, giving preliminary approval, and setting a time and place for public hearing. (See Attached) Ward 6 7 1/23/91 32 . A resolution of the Mayor and Common Council, City of San Bernardino, accepting a corporation grant deed from Van Loon Mutual Water Company for two parcels of land and improvements, and all rights-of-way and easements for their distribution system, and dedicating them for Water Department use. (See Attached) Ward 2 END OF CONSENT CALENDAR PUBLIC HEARINGS * Public hearings scheduled for a time certain will not be held prior to the time scheduled; however, they may be held any time thereafter and/or continued to a subsequent meeting. TO BE HEARD AT 10:00 A.M. 33. Protest hearing - Notice to construct Chapter 12 .92 improvements. (See Attached) Wards 2, 7 Mayor to open the hearing . . . MOTION: That any objections or protests be overruled, the hearing be closed, and find and determine that the public convenience and necessity require the installation of offsite improvements in front of those parcels of land described on Exhibit "A" attached to the staff report from Roger G. Hardgrave, Director of Public Works/City Engineer, dated January 7, 1991 and order the work done (excepting Parcels No. ) and that the Director of Public Works/City Engineer be directed to cause the installation of said. improvements if the property owners have not commenced such construction by March 9, 1991. 9 1/23/91 STAFF REPORTS CONTINUED FROM JULY 2, 1990 37 . Appeal - Board of Building Commissioners ' decision to demolish building and abate weeds, trash and debris - 1642 E. Echo Drive - Margaret Buckner. (See Attached) Ward 4 MOTION: That the appeal hearing be closed; and that the appeal be denied without prejudice. CONTINUED FROM AUGUST 20, 1990 38. Report on Orange Show Road Extension and Central Avenue Extension Studies. MOTION: Table report; to be brought back when the report on the Orange Show Road Extension and Central Avenue Studies has been completed. 39 . Request for waiver of requirement to connect to the sewer system for a single family home to be constructed at 25008 Hardt Street - applicant Mary C. Backus for owner Virgil McGee. (See Attached) Ward 1 MOTION: That Sewer Waiver Request No. 90-7 , for construction of one single family house on an existing parcel located at 25008 Hardt Street (APN 281-111-12) , requesting a waiver of requirement to connect to the sewer system, be approved. ,, 11 1/23/91 RECONVENE MEETING PLANNING MATTERS 2:00 P.M. RECONVENE ROLL CALL PRESENT: ABSENT: 41. Appeal - Planning Commission' s denial of Variance No. 90-13 - request to remove an existing 40 foot tall, 220 square foot freestanding sign and install two 25 foot tall, 150 square foot freestanding signs . (See Attached) Filed by: Quiel Bros. Electric Sign Co. Applicant: Quiel Bros. Electric Sign Co. Owner: Inland Plaza, Sam Watson and Helen Chase Location: Ward 3. 955 and 965 South "E" Street Staff recommendation: Concurrence with the Planning Commission' s denial of Variance No. 90-13. Commission decision: Denial of Variance No. 90-13, based upon findings of fact. Mayor to open the hearing . . . MOTION: That the hearing be closed; and that the appeal be #1 denied and Variance No. 90-13 be denied based on the findings of fact contained in Exhibit "4" . (Supports staff recommendation and Planning Commission action. ) or MOTION: That the hearing be closed; that the appeal be #2 upheld and Variance No. 90-13 be approved in concept; and that staff be directed to prepare appropriate findings of fact for consideration at the next regularly scheduled Council meeting. (Supports applicant' s request. ) 13 1/23/91 r NOTICE: Any member of the public may address this meeting of the Mayor and Common Council on any item appearing on the agenda, by approaching the microphone in the Council Chambers when the item about which the member desires to speak is called, and by asking to be recognized. Any member of the public desiring to speak to the Mayor and Common Council concerning any matter not on the agenda but which is within the subject matter jurisdiction of the Mayor and Common Council, may address the body at the beginning of the meeting, during the period reserved for public comments, said total period for public comment shall not exceed forty- five (45) minutes, unless such time limit is extended by the Mayor and Common Council. A five minute limitation shall apply to each member of the public, unless such time limit is extended by the Mayor and Common Council. No member of the public shall be permitted to "share" his/her five minutes with any other member of the public. The Mayor and Common Council may refer any items raised by the public to staff, or to any commission, board, bureau or committee for appropriate action or have the item placed on the next agenda of the Mayor and Common Council. However, no other action shall be taken nor discussion held by the Mayor and Common Council on any item which does not appear on the agenda unless the action is otherwise authorized in accordance with the provisions of subdivision (b) of Section 54954 .2 of the Government Code. 15 1/23/91 SUPPLEMENTAL AGENDA January 23, 1991 S-1 Proposed lease of City property on Duffy Street to R. K. Allen Landscape Construction for expansion of nursery storage facilities . (See Attached) Ward 6 MOTION: To approve the proposal in concept. #1 MOTION: To instruct staff to move forward with #2 negotiations to lease property. MOTION: To instruct staff to prepare a work plan and cash #3 estimate for implementation of concept. MOTION: That the following resolutions be adopted. S-2 A resolution of the City of San Bernardino initiating proceedings and setting a public hearing for the proposed annexation of the area generally located south of Central Avenue, east of Waterman Avenue, designated LAFCO 2644 . (Documentation being prepared. ) S-3 Resolution of the City of San Bernardino modifying fees for use of buildings, sports facilities, Park and Recreation facilities, alcohol use permits, parks and parking lots, equipment and services, and Sturges Auditorium and establishing a trust fund account to be designated the "Sturges Auditorium Replacement Account, " and repealing Resolutions 80-441, 86-316, 86-480, 87-111, 88-307, 89-500, and 91-8, and amending Resolution 83-201. MOTION: That the Common Council recess to closed session pursuant to Government Code Section 54956 .9 (a) to confer with its attorney regarding pending litigation which has been initiated formally to which the City is a party as follows: City of San Bernardino vs. Dykes - San Bernardino Superior Court Case No. 254883 . 1 1/23/91
