PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA: A three- minute limitation shall apply to each member of the public who wishes to address the Mayor and Common Council/Community Development Commission on a matter not on the agenda. No member of the public shall be permitted to "share" his/her three minutes with any other member of the public. (Usually any items heard under this heading are referred to staff for further study, research, completion and/or future Council/Commission action.) CONSENT CALENDAR MOTION: That the motions indicated by consent calendar items 6 through 16, be adopted except for , and 6. Waive full reading of resolutions and ordinances. MOTION: That full reading of the resolutions and ordinances on the regular, supplemental and addendum to the supplemental agendas of the Mayor and Common Council/Community Development Commission be waived. 3 3/1/1999 7. Council Minutes. MOTION: That the minutes of the following meetings of the Mayor and Common Council/Community Development Commission of the City of San Bernardino be approved as submitted in typewritten form: November 16, 1998 (Distributed on 2/22/99) December 7, 1998 (Distributed on 2/23/99) February 18, 1999 (Distributed on 2/24/99) 8. Claims and Payroll. (See Attached) MOTION: That the claims and payroll and the authorization to issue warrants as listed on the memorandum dated February 23, 1999, from Barbara Pachon, Director of Finance, be approved. 9. Personnel Actions. (See Attached) MOTION: That the personnel actions submitted by the Chief Examiner dated February 24, 1999, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. City Administrator 10. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the submittal of a grant application for the 1999 Transportation and Community and System Preservation Pilot Program for the purpose of developing a Santa Fe Depot Area Plan. (See Attached) (Cost to the City -- $75,000 in matching funds to be identified.) Ward 1 MOTION: That said resolution be adopted. 4 3/1/1999 'qtr►° v/ Code Compliance 11. Resolution of the City of San Bernardino awarding increases to purchase orders to weed abatement contractors for weed abatement services required by the Code Compliance Division of the City of San Bernardino. (See Attached) (Cost to the City -- $121,500 from the General Fund) All Wards MOTION: That said resolution be adopted. Development Services LAID OVER FROM FEBRUARY 15, 1999 12. Ordinance of the City of San Bernardino amending Chapter 10.52 of the San Bernardino Municipal Code establishing thirty-five mile per hour speed limits on Hill Drive between Magnolia Avenue and "E" Street, Orange Street between Highland Avenue and Piedmont Drive and Foothill Drive between Del Rosa Avenue and Sterling Avenue. FINAL READING (Backup material was distributed on February 15, 1999, Item No. 17.) MOTION: That said ordinance be adopted. 13. Resolution of the City of San Bernardino adopting the Five-Year Capital Improvement Program (1999/03) for Measure I local expenditures. (See Attached) (No cost to the City.) All Wards MOTION: That said resolution be adopted. 14. Resolution of the City of San Bernardino authorizing the execution of a ground lease with California Golf Holdings, LLC, a California Limited Liability Company, relating to certain property located 290.00 feet north of the northwest corner of Highland Avenue and Orange Street. (See Attached) (No cost to the City.) (Resolution not available at time of printing.) Ward 4 MOTION: That said resolution be adopted. 5 3/1/1999 Human Resources 15. Resolution of the City of San Bernardino repealing Resolution No. 98-88 and amending Resolution 6413, Section Thirteen, Temporary/Part-Time Employees, entitled in part a "Resolution . . . establishing a basic compensation plan . ." by updating information codifying prior Council actions. (See Attached) (No cost to the City.) MOTION: That said resolution be adopted. Public Services 16. Resolution of the City of San Bernardino, California, authorizing submittal of Waste Tire Enforcement Grant application. (See Attached) (No cost to the City.) Appeal hearing - Condition #1 on Dine & Dance/Live Entertainment Permit -- Scott Mann, Baja Broiler, 245 E. Redlands Boulevard. (See Attached) Ward 3 Mayor to open the hearing . . . MOTION: That the hearing be closed; and that the Mayor and Common Council deny Mr. Mann's request that Condition #1 of his live entertainment permit be removed. Resolution of the City of San Bernardino authorizing the execution of Amendment No. One to the Agreement for Professional Engineering Services with DMJM, Inc., for the Resident Engineer's Services for Orange Show Road extension. (See Attached) (Cost to the City -- $25,000 from the Street Construction Fund, to be reimbursed by Caltrans/IVDA.) Wards 4, 5 & 7 MOTION: That said resolution be adopted. Public hearing - General Plan Amendment No. 98-07 - from RMH (Residential Medium High) to PCR (Public Commercial Recreation) - - 21 acres located between Highland Avenue, Arden Avenue, alley south of 20th Street, and Guthrie Street. (See Attached) (No cost to the City.) Ward 7 Resolution of the City of San Bernardino adopting General Plan Amendment No. 98-07 to the General Plan of the City of San Bernardino, to amend the General Plan Land Use designation from RMH, Residential Medium High, to PCR, Public Commercial Recreation, for 21 acres bounded by Highland Avenue, Arden Avenue, the alley south of 20th Street, and Guthrie Street. Mayor to open the hearing . . . MOTION: That the hearing be closed; that the Mayor and Common Council adopt the resolution which adopts the Negative Declaration and approves General Plan Amendment No. 98-07, and direct staff to prepare an amendment to the Development Code to establish development standards for projects located in the PCR, Public Commercial Recreation, land use district. 22. Determination of Public Convenience or Necessity for an ABC Type 20 (off-site beer and wine) Liquor License for MacFrugal's Bargains Closeouts at 1269 North Waterman Avenue in the CG-2 District. (See Attached) Ward 2 MOTION: That the Mayor and Common Council determine that the public convenience or necessity is served and direct the Development Services Department to send a letter to the Department of Alcoholic Beverage Control for a Type 20 Off-sale Beer and Wine License at 1269 North Waterman Avenue subject to the Police Department's conditions of approval. (Documents not available at time of printing.) MOTION: That said resolution be adopted. 24. Luncheon workshop regarding Year 2000 Census - 12 noon - Economic Development Agency Board Room - 201 North "E" Street, 3rd Floor. 9 3/1/1999 MAYOR AND COMMON COUNCIL AND THE COMMUNITY DEVELOPMENT COMMISSION CITY OF SAN BERNARDINO RECONVENE MEETING COMMUNITY DEVELOPMENT COMMISSION MONDAY, MARCH 1, 1999 - 2:00 P.M. PRESENT: ABSENT: NOTE: There are no Community Development Commission items to be discussed at this meeting. 25. Adjournment. MOTION That the meeting be adjourned to 4:00 p.m., Tuesday, March 2, 1999, in the Economic Development Agency Board Room, 201 North "E" Street, San Bernardino, for a budget workshop. 10 3/1/1999 NOTICE: Any member of the public may address this meeting of the Mayor and Common Council/Community Development Commission on any item appearing on the agenda by approaching the microphone in the Council Chambers when the item about which the member desires to speak is called and by asking to be recognized. Any member of the public desiring to speak to the Mayor and Common Council/Community Development Commission concerning any matter not on the agenda but which is within the subject matter jurisdiction of the Mayor and Common Council/Community Development Commission, may address the body at the beginning of the meeting, during the period reserved for public comments. Said total period for public comments shall not exceed forty-five (45) minutes, unless such time limit is extended by the Mayor and Common Council/Community Development Commission. A three minute limitation shall apply to each member of the public, unless such time limit is extended by the Mayor and Common Council/Community Development Commission. No member of the public shall be permitted to "share" his/her three minutes with any other member of the public. The Mayor and Common Council/Community Development Commission may refer any item raised by the public to staff, or to any commission, board, bureau, or committee for appropriate action or have the item placed on the next agenda of the Mayor and Common Council/Community Development Commission. However, no other action shall be taken nor discussion held by the Mayor and Common Council/Community Development Commission on any item which does not appear on the agenda unless the action is otherwise authorized in accordance with the provisions of subdivision (b) of Section 54954.2 of the Government Code. Public comments will not be received on any item on the agenda when a public hearing has been conducted and closed. 11 3/1/1999
