CITY OF SAN BERK,4RDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Following a new annexation of property to the City of San Bernardino, California law allows
existing solid waste haulers to continue providing refuse services to their customers for five (5)
years. This law was enacted to provide haulers the opportunity to depreciate any equipment
investments that were made to provide service to the new annexed area.
Section 8:24.185 of the San Bernardino Municipal Code extends this period for an additional five
(5) years, thereby allowing solid waste enterprises a full ten (10) years following an annexation
to provide refuse service. The City is in the process of negotiating franchise agreements with
existing private refuse haulers and is recommending that Council repeal Section 8.24.185 of the
San Bernardino Municipal Code relating to the term for providing solid waste handling by private
companies.
This action will cause any private refuse hauler to discontinue refuse service five (5) years
following an annexation to the City, providing that they do not have an existing franchise
agreement with the City.

DO ORDAIN AS FOLLOWS:

6 SECTION 1. Section 8.24. 185 of the San Bernardino Municipal
7 Code is hereby repealed.
8 I HEREBY CERTIFY that the foregoing Ordinance was duly
9 adopted by the Mayor and Common Council of the City of San
10 Bernardino at a meeting thereof, held on the
11 day of 1995, by the following vote, to wit:
