Description) Finance: Council Notes: � � 75-0262 Agenda Item No CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTIOI STAFF REPORT PURPOSE The purpose of the attached resolution and agreement is to authorize the City's participation in a county-wide operational area organization required by Government Code 8607. BACKGROUND The 1991 East Bay Hills fire prompted Senate Bill 1841 (Petris) requiring major changes to the way California jurisdictions respond to disasters. Enchaptered as Government Code 8607, the new law creates the Standardized Emergency Management System (SEMS) . One principal requirement of SEMS. is use of the operational area concept. Under SEMS, the purpose of the operational area organization is to manage and/or coordinate information, resources and priorities among local governments within the operational area and serve as the coordination link between the local government and the regional level. California Government Code 8607 requires local governments within a county geographic area to be organized into a single operational area by December 1, 1995 as a prelude to implementing SEMS regulations by December 1, 1996. The county board of supervisors is responsible for the operational area establishment. Although technically not a state mandate, local jurisdictions must carry out SEMS regulations after December 1, 1996 to be eligible for state reimbursement of their personnel costs related to disaster response. iDEVELOPMENT OF AGREEMENT Initial efforts to organize the County and its 24 cities into an operational 'area began at the city manager/administrator level early in 1994 . On November 30, 1994, a draft agreement was reviewed by a County/City Managers organization sub-committee composed of 17 representatives from San Bernardino, Rancho Cucamonga, Fontana, Apple Valley, Victorville, Loma Linda, Ontario, Chino, Upland and the County. A smaller group of representatives further refined the agreement on December 12, 1994. On March 16, 1995, city managers, at their monthly County/City Managers Organization meeting, approved the agreement with minor revisions and agreed to submit it to their respective city councils. The County Office of Emergency Services incorporated the recommended revisions and distributed the final, attached agreement to the cities on March 31, 1995. 75-0264 CITY OF SAN BERNARDINO - REQUEST F4R COUNCIL ACTION STAFF REPORT OPERATIONAL AREA ORGANIZATION California Code 8607 states that county government shall serve as the lead agency of the operational area unless another member agency assumes that responsibility by written agreement with county government. Hence, the attached agreement specifies that the County Office of Emergency Services will be the lead agency. However, the agreement further specifies that the lead agency will be responsible for the day to day administration of the operational area in accordance with the policies and procedures adopted by the Operational Area Coordinating Council. The Coordinating Council will .consist of one representative of each of the party jurisdictions to the agreement. These representatives must have sufficient authority to speak on behalf of the jurisdiction in support of the Operational Area. It will be the responsibility of the Operational. Area Coordinating Council to establish organizational structure, policies and procedures for the functioning of the council and operational area in accordance with SEMS regulations and guidelines. In addition, any monies assigned to the operational area will be administered by the council. The attached agreement also specifies parties to the agreement to provide staff for decision making, as required, to the operational area emergency operations center (EOC) during actual disaster operations and drills. The County will provide the operational area EOC facility and its support staff. Finally, salaries, employment and workers compensation benefits of each employee participating in the operational area organization will be the responsibility of the party that employs the individual. 5-0264
