STAFF REPORT
The Public Hearing was set by Resolution No. 93-380, which was adopted on 10-4-
93. The Resolution creating Underground Utility District No. 23 (Orange Show
Road) , has been attached for your action. It is recommended that protests be
overruled and the resolution be adopted.
The proposed formation of Underground Utility District No. 23, generally located
along portions of Orange Show Road, between Arrowhead Avenue and Tippecanoe
Avenue, was recommended by the City's Underground Utility District Committee at
their meeting of May 5, 1993.
Certain utility companies are required by Rule 20 of the Public Utilities
Commission to set aside a certain portion of their revenues to finance the cost
of undergrounding overhead facilities within districts established by local
agencies. Each agency is allocated a certain amount of funds based upon the total
number of overhead services within the agency's boundaries. The Underground
Utility Committee reviews and designates areas proposed for the establishment of
a district.
Property owners within the district will be required to complete the
undergrounding from their property lines to the service points at their own cost.
No City funds will be required for this project (other than staff time).
The formation of this district was proposed as a result of the proposed extension
of Orange Show Road, which would have required that the utility lines and poles
be relocated to accommodate construction. The formation of this district would
allow the utilities to be placed underground using Rule 20 allocations, in lieu
of relocation.
All property owners within the proposed district and affected utility companies
were mailed a notice of the public meeting, which was held on 11-01-93, and the
public hearing. If the attached resolution is adopted, all effected property
owners and utility companies will be sent a notice of the formation of the
district.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
3 BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 23, GENERALLY LOCATED
ALONG PORTIONS OF ORANGE SHOW ROAD FROM ARROWHEAD AVENUE TO TIPPECANOE
4 AVENUE.
5 WHEREAS, a public meeting was held on the 15th of November, 1993,
6 at the hour of 10:00 a.m. , at the Council Chambers, 300 North "D" Street,
7 San Bernardino, California, and a public hearing was held on the 6th of
g December, 1993, at the hour of 10:00 a.m. at the Council Chambers as set
9 forth above, to determine whether the public necessity, health, safety or
10 welfare required the formation of an Underground Utility District No. 23
11 located along portions of Orange Show Road, and the extension thereof,
12 between Arrowhead Avenue and Tippecanoe Avenue, and along portions of
13 Arrowhead Avenue, North of Orange Show Road and along portions of Tippecanoe
14 Avenue, South of Orange Show Road extension, San Bernardino, California;
and
15
16 WHEREAS, notice of such meeting and hearing has been given to all
17 affected property owners as shown on the last equalized assessment roll and
18 to all utilities concerned in the manner and for the time required by law;
and
19
20 WHEREAS, such meeting and hearing has been duly and regularly held
and all persons interested have been given an opportunity to be heard.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
22 BERNARDINO, AS FOLLOWS:
23 SECTION 1. It is hereby found and determined pursuant to Chapter
24 13.36 of the San Bernardino Municipal Code of the City of San Bernardino,
25 and to definitions contained therein that the public necessity, health,
26 safety and welfare require the formation of an underground utility district,
27 located along said public streets as described herein, in order to remove
28 utility poles, overhead wires and associated structures and to underground

2 utilities along said portions of said streets.
3 SECTION 2. An underground utility district to be known as
4 Underground Utility District No. 23 is hereby established in that area
5 located along said portions of Arrowhead Avenue, Orange Show Road and its
6 extension, and Tippecanoe Avenue, more particularly shown on Drawing No.
7 8997 by the Engineering Division, Department of Public Works, City of San
8 Bernardino, on file in the office of the City Clerk's office of the City of
San Bernardino.

10 SECTION 3. All poles, overhead wires and associated overhead
11 structures shall be removed and underground installations made in said
12 underground utility district within the following times:
13 a. Underground installation by utility companies and property
14 owners and reconnections not later than May 30, 1994.
15 b. Removal of poles, overhead wires and other associated
16 structures not later than June 30, 1994.
17 SECTION 4. The City Clerk is hereby directed to mail a copy
18 hereof and a copy of Chapter 13.36 of the San Bernardino Municipal Code at
19 the City of San Bernardino, to all affected property owners as shown on the
20 last equalized assessment roll and to all affected utilities within ten (10)
21 days after the adoption of this resolution.
