As a result of these allegations, the Board considered action against the City (never taken) . An agreement was reached with the City Administrator concerning corrective actions deemed necessary by the Board. Under this agreement, the City agreed to install telemetry units at all 11 lift stations, visit its operation pro- cedures with Board staff, secure an alternate electrical power source for the lift stations ' motors and make regular reports to the Board until such time as these items were completed. The work was to be completed before the end of December, 1993 . Funds for the necessary work were programmed into the budget for the current year. Because the lift stations have several different voltages, sizes and capacities of motors, this is not an item that can be "purchased off the shelf. " It was necessary to have professional designers specify a piece of equipment that would meet all of the needs. The Public Works Department prepared Requests for Pro- posals for the design and construction of the required equipment and sent it to 12 designer/builders. Only two of the 12 firms responded with proposals for the design and construction of the unit. We have consulted with the Garage Division to help in selecting the unit best suited to our needs and most easily main- tained. Johnson Power Supply was selected. A Purchase Order was prepared, however, we have been advised bN,7 Purchasing that such a procedure takes action of the Mayor and Common Council. An amount of $11 , 200 was allocated in the 1993/94 Budget, under Account No. 001-403-55800 , to finance the costs of purchasing and installing telemetry units for all lift stations. The transfer of $49 , 137 in supplemental funds to this account was approved on 11--22-93, in order to provide sufficient funds to cover the purchase price for the emergency generator. This generator will be mounted on a trailer and provide multiple voltages through a variety of different types of plugs . These features will make the unit very flexible, which will allow it to be used for emergencies and special events. We recommend that a contract be awarded to Johnson Power Systems . 12-13-93 75.0264 CITY OF SAN BERN ^RDINO - REQUEST FIR COUNCIL ACTION STAFF REPORT Page 2 of 2 URGENCY CLAUSE: "It is essential that this item be approved and ordered before the end of the 1993 year, in order to demonstrate a good faith effort to comply with our agreement with the Regional Water Quality Con- trol Board. Failure to comply could result in a Cease and Desist Order being issued. 12-13-93 75-0264 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ACCEPTING THE PROPOSAL FROM JOHNSON POWER SYSTEMS FOR DESIGN AND MANUFACTURE OF 3 AN EMERGENCY GENERATOR, AND AUTHORIZING THE PURCHASING AGENT TO ISSUE A PURCHASE ORDER. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1 . The proposal from Johnson Power Systems for 7 the design and manufacture of an emergency generator, dated 9-23- 8 93 , in the total amount of $49 , 136 . 16 , including taxes , is hereby 9 accepted, and all other proposals are rejected. 10 SECTION 2 .
